Leung, City Manager - 949-644-3001, gleung@newportbeachca.gov PREPARED BY: Tara Finnigan, Assistant City Manager, tinnigan@newportbeachca.gov PHONE: 949-644-3035 TITLE: Resolution No. 2023-15: Reestablishing the Newport Beach City Council Homeless Ad Hoc Committee ABSTRACT: At its February 28, 2023 meeting, the Newport Beach City Council voted unanimously, via a straw poll, in favor of staff returning with a resolution for its consideration that would reestablish the City Council Homeless Ad Hoc Committee (Committee). If adopted, Resolution No. 2023-15 would reestablish the Committee and it would be comprised of Mayor Noah Blom and Council Members Robyn Grant and Lauren Kleiman. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2023-15, A Resolution of the City Council of the City of Newport Beach, California, Reestablishing the Newport Beach City Council Homeless Ad Hoc Committee. DISCUSSION: At the request of Mayor Blom, at the February 28, 2023 City Council meeting, the Council considered placing a resolution on a future agenda that, if adopted, would reestablish the City Council Homeless Ad Hoc Committee for the purpose of evaluating the contract services under the City of Newport Beach's (City's) homeless outreach program. The City Council voted unanimously, via a straw poll, in favor of staff bringing forward a resolution for its consideration. The Homeless Ad Hoc Committee (Committee) was first formed by the City Council in November 2019 to analyze issues related to people experiencing homelessness. The Committee expired on December 31, 2020. The City Council reestablished the Committee in March 2022 to evaluate whether the City's contract services were adequately serving individuals experiencing homelessness in Newport Beach. The Committee expired on December 31, 2022 without making a recommendation to the City Council. 3-1 Reestablishing the Newport Beach City Council Homeless Ad Hoc Committee March 14, 2023 Page 2 If adopted, Resolution No. 2023-15 would reestablish the City Council Homeless Ad Hoc Committee and it would be comprised of Mayor Blom and Council Members Grant and Kleiman. The reestablished Committee would be responsible for evaluating the homeless outreach services being provided by the City's existing contractors and consider whether additional contract services should be provided as part of the City's program. The Committee would expire upon making its recommendations to the full City Council. FISCAL IMPACT: There is no fiscal impact related to the reestablishment of the City Council Homeless Ad Hoc Committee. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2023-15 3-2 ATTACHMENT A RESOLUTION NO. 2023- 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, REESTABLISHING THE NEWPORT BEACH CITY COUNCIL HOMELESS AD HOC COMMITTEE WHEREAS, on March 26, 2019, the City Council adopted Resolution No. 2019- 25 establishing a City Council/Citizens' Committee known as the Newport Beach Homeless Task Force ("Task Force") to study the impacts of homelessness on the City of Newport Beach ("City") and develop solutions to end homelessness; WHEREAS, on May 14, 2019, the City Council adopted Resolution No. 2019-42, increasing the membership of the Committee to three (3) councilmembers and seven (7) residents; WHEREAS, on September 14, 2019, the City Council adopted Resolution No. 2019-85 declaring a shelter crisis pursuant to Senate Bill 850 as codified in California Government Code Section 8698.2; WHEREAS, as a result, on November 12, 2019, the Task Force recommended that the City Council reconstitute the character, membership, and purpose to form a City Council Ad Hoc Committee ("Committee"); WHEREAS, on November 19, 2019, the City Council adopted Resolution No. 2019-100 reconstituting the character, membership, and purpose of the Committee; WHEREAS, pursuant to Resolution 2019-100, the Committee expired on December 31, 2020; WHEREAS, at the January 29, 2022, City Council Planning Special Meeting, the City Council expressed interest in evaluating whether the City's existing programs adequately serve individuals experiencing homeless within Newport Beach, particularly in the wake of COVID-19; WHEREAS, on March 8, 2022, the City Council adopted Resolution No. 2022- 18, reestablishing the Committee, comprised of three (3) members of the City Council, to evaluate whether the City's established contract services adequately serve individuals experiencing homelessness within the City; WHEREAS, pursuant to Resolution 2022-18, the Committee expired on December 31, 2022, without making a recommendation to the City Council; 3-3 Resolution No. 2023- Page 2 of 3 WHEREAS, at the February 28, 2023, City Council meeting, the. City Council expressed interest in reestablishing the City Council Homeless Ad Hoc Committee to evaluate the services currently being provided by the City's contractors and to consider whether additional contract services should be provided as part of the City's homeless outreach program; and WHEREAS, the City Council wishes to reestablish the Committee. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The Committee shall be comprised of three (3) councilmembers appointed by the Mayor and confirmed by the City Council. By approval of this resolution, the City Council confirms Mayor Blom's appointment of the following Council Members to the Committee: (1) Mayor Blom; (2) Council Member Grant; and (3) Council Member Kleiman. The term of the appointed members of the Committee shall be indefinite pending City Council action or expiration of the Committee as set forth in this resolution. Section 2: The sole purpose and responsibility of the Committee shall be to evaluate the services being provided by the City's existing contractors and to consider whether additional contract services should be provided as part of the City's homeless outreach program. Section 3: The Committee shall function as an ad hoc committee and shall not be subject to the Brown Act. Section 4: The Committee shall expire upon making its recommendations to the entire City Council, at a noticed public meeting of the City Council. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The recitals provided in this resolution are true and correct and are incorporated into the substantive portion of this resolution. 3-4 Resolution No. 2023- Page 3 of 3 Section 7: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 8: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
