SUBJECT: FINDINGS AND CONDITIONS OF APPROVAL FOR
VARIANCE APPLICATION NO. VA2013-004 (PA2013-110)
3235 OCEAN BOULEVARD
FINDINGS:
1. That the proposed design of the development conflicts with the existing 4-foot
wide sewer easement along the southeasterly property line. Therefore, the
existing sewer easement shall be vacated prior to Building Permit issuance.
2. That public improvements will be required of the Applicant per the Municipal
Code and the Subdivision Map Act.
CONDITIONS:
1. All improvements shall be constructed as required by Ordinance and the Public
Works Department.
2. Construct new concrete curb and gutter per City standards along the Breaker's
Drive frontage.
3. New driveway along Breaker's Drive shall be constructed per STD-162-L.
4. All existing private, non-standard improvements within the public right-of-way
and/or extensions of private, non-standard improvements into the public right-of-
way fronting the development site shall be removed.
5. An encroachment permit is required for all work activities within the public right-
of-way.
6. In case of damage done to public improvements surrounding the development
site by the private construction, additional reconstruction within the public
right-of-way could be required at the discretion of the Public Works Inspector.
7. All on-site drainage shall comply with the latest City Water Quality requirements.

8. New sewer cleanouts shall be installed on all existing sewer laterals per STD-
406-L adjacent to the property line in the Breakers Drive public right-of-way.
9. No structural components wil l be permitted to encroach into the Ocean
Boulevard right-of-way, inclu ding , but not limited to tie backs and foundations for
the new lower level addition within the front yard setback.
10. Breaker's Drive is a public street.
11. New and existing stairs and walls (retaining or not) proposed to be constructed
along Ocean Boulevard require City Council approval.

Per Council Policy L-2 (Section F), the existing curb opening along Ocean
Boulevard shall be plugged and proposed driveway shall not be permitted as
garage access is available along Breaker's Drive. No permit shall be issued for a
driveway on Ocean Boulevard without City Council approval. Although a .
driveway cut exists, this project is new construction for the site.
