Dear Mr. Jeannette:
The Planning Division is in receipt of your request for a time extension of the above-
referenced permit which was approved by the Newport Beach Planning Commission on August 8, 2013.
As the subject property is located in the coastal zone and a Coastal Development
Permit is required for the development of a new single-family residence, the 24-
month time limit will not begin until the effective date of Coastal Development Permit which was signed and approved on January 23, 2015. A one-year time extension to
March 12, 2017, for the approved Coastal Development Permit was issued. A second
extension is being requested.
Pursuant to Section 20.54.060.B of the Municipal Code, the expiration date of Variance No. VA2012-003 is extended to March 12, 2018.

Variance2013‐004 and determined that it can be extended administratively. Ros will be contacting Martin today with

Subject: Expired Variance VA2013‐004 (3235 Ocean Blvd.)
Hi Kim.
I hope that you are having a great week. Sorry to bother you, but we need your assistance. I will give you the short
story here, but I would be happy to come in and walk through it in person if that would be helpful. We obtained a
variance (VA2013‐004) for the new home we designed at 3235 Ocean Blvd. that allowed us to encroach below‐grade
into the front yard setback and for the stair in the side yard to exceed the 6’ height limit in the side yard setback. Then,
we submitted to CCC, ultimately being approved on March 12, 2014. The project has stretched out due to rising
construction costs and we were careful to extend our building plan check and CCC approvals (attached is the CCC
extension from 2016 to 2017 and the current request to extend one more year to March 2018). Unfortunately, we
mistakenly assumed that the variance would track along with the Coastal approval.
We have been through multiple planning plan checks in the last year and the fact that the variance had expired did not
come up until last week when Martin, from our office, met with Rosalinh to go through the final plan check
comments. He submitted a request to extend the Variance per her suggestion, but we heard yesterday that there is
nothing that she can do since it expired last year.
We are actively working with all of the City departments to get the project permit ready. In addition, our client is in
negotiations with a potential buyer, so time is of the essence. Would you please let us know how to go about
“reinstating” the Variance or what our options are?
