CORRECTIONS:
1. The proposed deck is located over the public right-of-way and over submerged lands. As
such, the City of considered the property owner of the affected area and the California Coastal
Commission retains final permit jurisdiction of any permits issued over the water.
2. The proposed deck is considered an encroachment into public right of way. Permitted
encroachments into public right-of-way are addressed by Council Policies L-6, L-8, and L-12.
The proposed cantilevered deck encroachment is not covered by any of the Council Policies;
therefore, the deck is prohibited and shall be removed to avoid any further Code
Enforcement action.
3. Please provide your Code Enforcement Officer, John Murray (949-644-270-8137 or
imurray(a newportbeachca.gov), with a schedule for removal.
4. If you have any questions related to Council Policies or allowed encroachments, you may
contact David Keely, Senior Engineer (949-644-3349 or dkeely�newportbeachca.gov).
5. Please note, if this encroachment would have been located over private water or submerged
lands (not part of tidelands trust), Section 17.35.030.C.5 of the Harbor Code and Section
21.30C.050.G.5 of the Local Coastal Program Implementation Code would require that the
deck maintain a minimum setback of 5 feet from the prolongation of the side property line. The
deck plans would have been required to be modified prior to submission to the California
Coastal Commission for final approval.

5. Patio Decks. Patios are not permitted to extend over the waters of Newport Harbor unless
the waters are adjacent to the upland property and outside the areas described in the tidelands
trust, and provided the patio complies with the following conditions:
a. The maximum projection of patio decks encroachments beyond the bulkhead line shall
be limited to five feet.
b. The minimum setbacks from the prolongations of the side property lines shall be five
feet.
c. No float shall be permitted within one foot of the decks.
d. No permanent structure shall be permitted on the projecting portion of the patios
except:
i. Planters and benches not over sixteen (16) inches in height;
ii. Railings not over forty-two (42) inches in height with approximately ninety-five (95)
percent open area.

FABRICATOR AND SHOP DRAWINGS SHALL BE SUBMITTED TO ESI/FME, INC.
THROUGH THE ARCHITECT FOR APPROVAL PRIOR TO FABRICATION. STEEL
FABRICATOR SHALL SUBMIT SHOP DRAWINGS TO THE GENERAL
CONTRACTOR AND OWNER FOR REVIEW PRIOR TO FABRICATION. ANY
PROPOSED DEVIATION, ADDITION OR QUESTIONS SHALL BE NOTED
CONSPICUOUSLY AND CLEARLY ON THE SHOP DRAWINGS. STEEL
FABRICATOR SHALL FIELD CHECK ALL DIMENSIONS PRIOR TO ERECTION
TO PROVIDE FOR A PROPER FIT. ALL FIELD WELDING EXCEPT MINOR AND
TACK WELDING SHALL BE CONTINUOUSLY INSPECTED BY AN APPROVED
WELDING INSPECTOR
4. USE 3/4" ROUND MACHINE BOLTS, 13/ib" ROUND HOLES, FOR ALL
CONNECTIONS, UNLESS OTHERWISE SHOWN. ALL BOLTS SHALL CONFORM
TO ASTM A-301 FOR UNFINISHED BOLTS, EXCEPT WHERE SPECIFICALLY
NOTED AS HIGH STRENGTH BOLTS WHICH SHALL CONFORM TO ASTM
A-325 OR ASTM A-490. HI TENSILE BOLTS SHALL BE THE FRICTION
TYPE AND THERE SHALL BE NO PANT, OIL, LACQUER OR GALVANIZING
BETWEEN THE CONTACT SURFACE. HIGH STRENGTH BOLTS REQUIRE
SPECIAL INSPECTION PER SEC. M01J. PROVIDE HOLES IAA DIA
LARGER THAN NOMINAL BOLT DIA, UA0.
5. ALL STEEL EXPOSED TO WEATHER SHALL BE NOT -DIPPED GALVANIZED
AFTER FABRICATION.
6. WIDE FLANGE SECTIONS SHALL CONFORM TO ASTM A-992.
1. PIPE COLUMNS SHALL CONFORM TO ASTM A-53-5 (TYPE E OR S),
U.N.O.
S. TUBE COLUMNS SHALL CO T-OR'1 TO ASTM A-501 OR A-500 GRADE B. UND.
9. PLATES AND OTHER SHAPES NOT MENTIONED ABOVE SHALL COWORM
TO ASTM A-36, UND.
10. WHERE FINISH IS ATTACHED TO STRUCTURAL STEEL PROVIDE 1/2" BOLT
HOLES AT 4'-0" O/C FOR ATTACHMENT OF NAILERS. SEE
ARCHITECTURAL DRAWINGS FOR FINISHES, (OR NELSON STUDS 1/2" X 3"
CPL).
IL NONDESTRUCTIVE TESTING PER 2016 CBC SECTION 1103 ON STEEL
MOMENT CONNECTION BETWEEN STEEL BEAM AND STEEL COLUMN, ALL
FULL PENETRATION GROOVE WELDS CONTAINED IN JOINTS AND SPLICES
SHALL BE TESTED 100 PERCENT EITHER BY ULTRASONIC TESTNG OR BY
RADIOGRAPHY.
