SUBJECT: SALE OF SURPLUS PROPERTY
At the July 26, 1976, Council meeting a staff report was presented
concerning two parcels of property owned by the City located on
Bay Avenue between 18th and 19th Streets. The report recommended
that the two lots be combined through the resubdivision process
and sold to the highest bidder. After discussion by the Council,
the matter was tabled. The staff report is attached for background
information as well as an extract of the minutes of the July 26
Council meeting (Attachments 1 & 2).
The staff report was precipitated by the action taken by the Council
during the preceding month in considering the Marinapark Master Plan
& Development. On June 14, 1976, after a public hearing, the Council
adopted the recommendations of the P. B. & R. Commission with two
exceptions, one being to delete the two lots on Bay Avenue from
inclusion in the Master Plan. A copy of the proposed Master Plan
for Marinapark from the P. B. & R. Commission as well as an extract
of the minutes of the June 14, 1976, Council Meeting are attached
for information (Attachments 3 & 4).
In the ten months since the Council tabled the recommendation to sell
the two parcels, the City has received various inquiries and offers
concerning this property. If it is the desire of the Council at this
time to make a final determination regarding the sale or development
of this land, this matter can be brought back to the Council as an
ge a item at a future Council meeting.

SUBJECT: CITY OWNED LOTS BETWEEN 18th and 19th ON BAY AVENUE
The City of Newport Beach owns two surplus parcels of land, approximately
50 feet by 25 feet each on Bay Avenue between 18th and 19th Streets (see
attached exhibit). Each parcel is now leased to adjoining property owners.
An unsolicited offer was made by a private party through the City Manager's
Office to purchase both of these parcels for $50,000 in May of 1972. The
City Council referred this offer to the Parks, Beaches and Recreation
Commission for review and comment. The Commission recommended in 1972
that rather than sell the property, the City retain the parcels, purchase
additional adjacent lots and establish a municipal sailing center, as
contemplated in the Newport Peninsula Tennis and Aquatic Center (Marina -
park area) study plan. The City Council accepted the Parks, Beaches and
Recreation Commission's recommendation at that time.
In 1974, a recommendation to reconsider the possible sale of these parcels
was again referred to the Parks, Beaches and Recreation Commission, and
their recommendation at that time was that the two lots be retained until
the outcome of the Marinapark was determined. The City Council again
accepted the Parks, Beaches and Recreation Commission's recommendation.
Recently, the City has completed negotiations of the extension for the
Marinapark Mobile Home leases. Also, at the Parks, Beaches and Recreation
Commission meeting of April 6, 1976 they adopted a new master plan for the
Marinapark area which deleted the possible use of these two lots for a
sailing center or any other use.
Authorization for Sale. Section 1402 of the City -Charter entitled "Waterfront
Property' provides, in part, that "The City Council shall not sell or convey
any waterfront or beach property excepting to the State or to the. County for
use as a public beach or park." Although Bay Avenue separates the properties
from Newport Harbor, they were held to be "waterfront" properties within the
meaning of the Charter.
The City Charter was amended by a vote of the people on May 4, 1964, to
authorize the City Council to sell the two parcels. Various discussions
were then held with the two parties now leasing the parcels. These negotia-
tions were not fruitful and no action has been taken regarding the sale
since 1966.
Existing Leases. Marginal older structures are located on both of the parcels
under authority of a lease agreement cancellable without cause upon 30 days
written notice. Each lessee pays the City a modest $15 a month for utiliza-
tion of this bay front property. The City had the lessee's improvements
appraised on April 6, 1965, and the appraiser concluded that "It is our

opinion that the present improvements are of no value and that a cost of
approximately $350 will have to be absorbed by either the seller or the
buyer of the subject property. These improvements consist of a small
beach cottage partially on the easterly portion of subject and partially
on adjoining Lot 8 to the south. A small detached single car garage is
on westerly portion of subject."
Summary. It is staff's opinion that these two lots are surplus parcels to
the City and that in view of the size of these two lots, and the relation-
ship to the adjacent public property, it would appear that future public
use would be only problematical without the acquisition of a number of
additional adjoining parcels. In view of the pressing demand for other
open space and recreational facilities in the City, the feasibility and
priority of such a plan should perhaps be reassessed.
If Council were to consider selling these parcels, staff would suggest in
order to maximize the utility of the land and to preserve a lot size in
keeping with the neighborhood, that the two parcels be combined through
the resubdivision process and sold as one to the highest responsible bidder.
Council should be advised that if these parcels were sold, Council Policy
F-8 states, "Revenues from the sale of City property or the sale of
material from City property will be placed in the Capital Improvement
Fund."
Recommendations. If Council desires to sell these two parcels, staff would
ask that Council consider the following actions:
1. Instruct staff to prepare the necessary application
for resubdivision of the subject parcels and proceed
through the Planning Commission; and
2. Instruct staff to prepare specifications for a sealed
bid sale of subject parcels to the highest responsible
bidder.

On June 14, the City Council will be reviewing the Master Plan of Marinapark
as proposed by the PB & R Commission. This plan differs somewhat from the
original Master Plan that was conceived by the Council Ad Hoc Committee during
discussions with the Marinapark tenants on the renewal or extension of their
leases.
A package from the PB & R Commission has already been submitted and will be
utilized for the public hearing on the 14th. However, at the PB & R Commis-
sion meeting of June 1, the Commission placed the development proposals in a
priority basis. This differs slightly from page three of the original report
sent to City Council. I am forwarding to you one copy of the report showing
the items in their priority order as approved by the Commission.
Additionally, the Commission requested that funds be appropriated in the
1976-77 fiscal year for the development of the area surrounding Marinapark.
It was suggested that if sufficient funds were not available to do the total
project in one fiscal year, then the items be developed in the priority order
as suggested by the Commission.
If any additional information is required to give consideration for inclusion
of any of these items in the 1976-77 budget, please advise.

SUBJECT: MASTER PLAN - MARINAPARK
Several months ago the City Council directed the Parks, Beaches & Recreation
Commission to review the Master Plan of Marinapark and the surrounding area
as had been prepared by the City Council Ad Hoc Committee on Marinapark.
The Commission was directed to review this Master Plan and make recommendations
regarding the Plan. The Commission apologizes for the length of time that this
study has taken; however, in order to get input from the residents of the
surrounding area, the PB & R Commission discussed the subject at two consecu-
tive meetings and conducted one Public Hearing. After the Public Hearing, the
staff was requested to prepare a map identifying the recommendations and the
input that had been made at the Public Hearing.

On April 6, 1976 the PB & R Commission reviewed that map and took the following
action: A motion was made by Commissioner Lovell to approve the revised Master
Plan as presented, which included all of the elements of input that were reviewed
at the March meeting. Commissioner Hart asked the maker of the motion if he
would consider eliminating the proposal to make the existing sidewalk public
from the total Plan. Commissioner Lovell answered affirmatively. After
additional discussion, the motion carried four to two with Commissioner Trebler
absent.
In order to identify the changes that the new Plan represents from the previous
one submitted by the City Council Ad Hoc Committee, it would be best to take
each particular item separately:
(1) Beginning at 15th Street and working to the west, the Commission
deleted the boat -launching ramp that was proposed for the street -
end at 15th Street.
(2) The PB & R Commission deleted the Sailing Center and the
accompanying car and boat parking in the lawn bowling green
site and replaced it with a multipurpose play field and a
shelter area for senior citizens.
(3) The third area of consideration is the playground area
and restroom and with minor shifting, that remains
substantially the way it was in the Council's Master
Plan.
(4) The Commission agreed with the addition of two tennis
courts adjacent to those existing on Balboa Boulevard.
(5) The PB & R Commission recommended elimination of the
bicycle trail and pedestrian walk bayward of the bulk-
head in front of Marinapark.
(6) The Commission agreed with the relocation of the parking
lot from 17th Street to the intersection of Balboa
Blvd. and 18th Street with the entrance to Marinapark
relocated to 18th Street.

(7) The Commission recommended that the two City -owned lots on
Bay Avenue be converted to a mini -park with turf, picnic
tables, park benches, etc.
(8) That the existing restroom at Bay Avenue and 19th Street
be enlarged by 50 square feet in order to offer a better
storage area for sailboats and retain the sailing instruc-
tion program at this location.
The only other recommendation that had been made by the
PB & R Commission, but was deleted in its action, was to
make the sidewalk currently existing in front of the
Marinapark open to the public by removing the gates at
each end of this sidewalk.
When this subject is discussed by the City Council, a map showing the PB & R
Commission's proposal, as well as a map identifying the Ad Hoc Committee's
proposal, will be placed side by side so that the comparisons will be more
visible.
In addition to asking the PB & R Commission to adopt a Master Plan, the Commission
was also directed to prepare cost estimates for the implementation of these
recommendations. Attached hereto is a breakdown of the costs related to each
of the Commission's recommendations.

The following people addressed the Council in favor of
the plan: Sue Ficker representing the Central Newport
Beach Community Association, Al Barstow presented a
petition signed by 121 residents, and Angela Ficker
White.
Stan Cole addressed the Council protesting the elimin-
ation of the boat launching, and Joe Casala spoke in
favor of retaining the green area.

Councilman McInnis made a motion to accept the Master
Plan as recommended by the Parks, Beaches and Recrea-
tion Commission with the exception of the two residen-
tial lots and including the opening of the existing
sidewalk to public use by whatever means are necessary,
the fencing or landscaping on the landward side of the
sidewalk to afford some degree of privacy for the resi-
dents, and the sidewalk as shown on the east side in
the Master Plan as well as everything else in the plan,
with the opening of the sidewalk being subject to
review by the City Attorney.
