CITY OF NEWPORT BEACH OFFICE OF THE CITY MANAGER STUDY SESSION No.. -9 " August 22, 1977 TO: MAYOR AND CITY COUNCIL FROM: City Manager STATUS REPORT ON THE RESUBDIVISION OF SUBJECT: THE CITY -OWNED PROPERTY ON BAY AVENUE Background P r.,3 The City of Newport Beach owns two surplus parcels of land, each measuring approximately 50' x 25', which are located on Bay Avenue between 18th and 19th. The City has been leasing portions of these properties to Mrs. Josephine Fulton since May 1, 1953, and to Mr. and Mrs. Charles H. Straub since Septem- ber 23, 1964. The City Council at their meeting of July 11, 1977, directed staff to initiate the resubdivision of the two parcels. This action was intended to provide for the sale of an encroaching portion of a residence belonging to the Straubs; the removal of the encroachment on the property leased by the Fultons and the relocation onto the resubdivided parcels of a structure of historical significance for use as a community meeting facility. The purpose of this staff report is to provide information relating to the status of the project, pursuant to the completion of a survey of the subject parcels. Survey Results On June 17, 1977, a survey of the property was conducted to determine the nature and extent of existing encroachments. Two primary encroachments presently exist on the parcels, as shown in Exhibit 1 (attached). On the property leased by Mrs. Fulton there stands a one car garage measuring approxi- mately 20.2' x 12.2'. On the property leased by the Straubs there exists an encroaching portion of a residential dwelling unit which straddles the property line. This encroachment extends approximately 26' onto the City -owned parcel. Proposed Meeting Facility The structure which was proposed for relocation to the Bay Avenue site for use as a meeting facility is presently located at 15th and Bay, in the park- ing lot of the property which is being leased from the City by the American Legion. The building, which is approximately 24' x 34', is currently being maintained as a storage facility for sailing and other equipment utilized by the Parks, Beaches and Recreation Department. It once served as a headquarters for numerous scouting groups in the area, and contains a central meeting room with a fireplace, and two restrooms. An examination of the structure by the City's Building Division, indicates that it is safe and sound and could be relocated. MAYOR AND CITY COUNCIL Status Report on the Resubdivision Subject: of the City -Owned Property - Bay Ave. Page 2 - 8/22/77 Analysis The information obtained as a result of the survey, has been analyzed in relation to the proposed community meeting facility relocation, and the results of this analysis are presented in Exhibit 2 (attached). It can be seen from this Exhibit that even with the removal of the garage from the one parcel, the extent of the encroachment by the residence onto the other City- ' owned parcel is such that the resubdivided property could not physically accommodate both structures. Summary of Alternatives In response to the findings of the survey and analysis which are dealt with in this report, the following primary alternatives are available to the City with regard to the disposition of the subject Bay Avenue property: 1. Cancel the existing leases and require the lessees to remove all encroachments. Continue with the proposed resubdivision and, if desired, community meeting facility relocation. 2. Cancel the existing leases and require the removal of the encroaching garage and approximately 132' of the encroaching dwelling unit. Institute a modification procedure to adjust the rear yard setback from 10' to 5', and provide for the sale of the remaining encroach- ment to Mrs. Straub. (Exhibit 3 attached) 3.
