Please be advised that after reviewing the subject application, your submittal has been
deemed incomplete and further information is required before we are able to proceed
with the application process.
The following documentation is required to complete the application:
1. Preliminary Title Report:
Provide a copy of a Preliminary Title Report not more than six (6) months old from
the date of the application that identifies the legal description of property and property
owner.
2. Plans:
The submitted plans are the plans that were submitted for the permit for Il Barone
Restaurant. New plans for Kalaveras Restaurant must be submitted showing the
patio area that was allowed with the Emergency Temporary Use Permit that is now
proposed to be permanent. Please see attached for the complete Plan Check
Corrections List.
3. Parking:
a. The required parking spaces must be recalculated for the additional patio
area. The previous parking spaces for Il Barone Restaurant were calculated
at 1 space per 40 SQ FT of net public area as follows:

The patio as allowed with the Emergency Temporary Use Permit is
approximately 1,100 SQ FT. The parking for outdoor dining areas is counted
for the area that exceeds 25% of the interior net public area and is calculated
as follows:
Net public area = 2070 SQ FT
2070 x .25 = 517.5
1,100 – 517.5 = 582.5
2070 + 582.5 = 2652.5 SQ FT ÷ 40 = 67 parking spaces (rounded up)
The required parking spaces is 4 more than the existing 63 parking spaces.
b. Submit a Parking Study to justify the reduction in required parking spaces and
to propose a waiver of the required number of parking spaces. Otherwise, the
size of the patio area must be reduced approximately 160 SQ FT to
accommodate the existing amount of parking spaces on-site.
c. Ensure the resubmitted plans provides new parking calculations and a parking
layout plan that shows the number of on-site parking spaces.
4. Fire Sprinklers:
The request to retain the outdoor patio area increases the occupancy of the facility.
Fire sprinklers are required if the building is not currently protected. See attached Fire
Response Sheet.
5. Pending Project Review:
The project is still pending review from the Police Department. Once the review is
complete, any comments or conditions will be forwarded and must be addressed in
order to deem the application as complete.

Upon verification of completion, the application will be processed and scheduled for a

1. The submitted plans were for the previous Il Barone Restaurant. Provide updated plans for
Kalaveras Restaurant including a complete project scope of work. If any additional work is
to be proposed such as relocation or removal of any structures, changes to the interior
walls, changes in doors or windows, etc., ensure they are included in the plans.
a. FYI: Additional corrections may apply once new plans are submitted for Kalavera
Restaurant.
2. Provide a Site Plan that shows the area of the existing outdoor patio area and include on
the plans that the patio area is proposed to be permanent. Ensure the plans shows any
walls, fences, or gates and include the height and material on Floor Plans and Elevations.
3. Include an updated parking calculation (See #2 on the Notice of Incomplete Filing). Include
a parking layout showing the number of on-site parking spaces.
4. Indicate the amount of proposed landscaping. If any landscaping is proposed, it must
comply with the Water-Efficient Landscape Ordinance and a Landscape and Irrigation Plan
must be submitted.
Please submit written responses to this corrections list and redlined plans at the time of
resubmittal.

An amendment to Minor Use Permit No. UP2017-009 (PA2017-082) which allowed for a Type 47 (On-
Sale General – Eating Place) alcohol license. The amendment is proposing to increase the hours of
operations from 11:00 am – 11:00 pm, Monday through Sunday, to 10:00 am – 2:00 am, Monday
through Sunday and to make the temporary patio area permanent which was allowed through an
Emergency Temporary Use Permit No. UP2020-092 and extended for one year term to expire on
December 31, 2022.
