The transit bus and both storm water pumps scheduled for replacement meet condition replacement criteria as established by City Council Policy F-9 (City Vehicle/Equipment Replacement Guidelines). City Council approval is required per City Council Policy F-14 (Authority to Contract) since the purchases exceed the City Manager's contract authority of $120,000. It is also recommended that the City Council consider approval of the request for an appropriation to cover increases in costs associated with these purchases. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Approve Purchase Order 22201093 for a Ford E-450 Type B Glaval Bus from A-Z Bus Sales, Inc. for a total amount of $123,570.76; c) Approve the Sole Source purchase of two Pioneer Engine Driven Storm Water Pumps from Charles King Company of Signal Hill, the sole distributor for Pioneer Pumps in the Southern California region, and authorize the execution of a Purchase Order for a total amount of $255,745.97; Approval to Purchase One Ford E-450 Type B Glaval Bus from A-Z Bus Sales and Two Engine Driven Storm Water Pumps from Charles King Company May 9, 2023 Page 2 d) Approve Budget Amendment No. 23-066, appropriating $102,817 in increased expenditures in Account No. 7529032-911016 (Rolling Equipment) from unappropriated fund balance reserves within the Equipment Fund; and e) Authorize a contingency of $19,000 (approximately 5% of total quotes) to cover the cost of unforeseen changes to the current quotes. DISCUSSION: Transit Bus The OASIS Senior Center (OASIS) offers an affordable transportation service for Newport Beach older adults who are retired from driving. This serves approximately 350 residents per year with over 12,000 rides to OASIS, pharmacies, grocery stores, medical appointments, etc. Th service provides older adults the option to age in place. Additionally, each ride is only $3, where car service with a wheelchair lift could cost over $150 per trip. The 10-passenger capacity of the bus allows drivers to service more senior citizens by making group trips. Also, the residents have an opportunity to socialize during "Breath of Fresh Air" outings organized by OASIS. This program has been an essential service for the community. The Fiscal Year 2022-23 budget includes a budget carryover from the previous year for the replacement of Unit 7901, the existing 10-passenger bus utilized by OASIS. Staff from the Public Works Department and OASIS worked with A-Z Bus Sales of Colton, California to develop specifications for a passenger bus ideal for the OASIS program and compliant with the California Association for Coordinated Transportation (CaIACT). CalACT is a nonprofit organization that represents the interests of small, rural and specialized transportation providers since 1984. CalACT consists of individuals and agencies from diverse facets of transportation, planning and government agencies, social service agencies, suppliers and consultants. The City of Newport Beach (City) has been a member since 2017. CalACT provides information, legislative advocacy, training and resources to members. One of these resources is access to a variety of transit vehicles through a purchasing cooperative that reduces the cost of goods and services by leveraging volume purchases nationwide through competitively solicited contracts. CalACT's cooperative agreements are compliant with federal and California state purchasing requirements and the City's purchasing staff found the cooperative agreement and bidding process met the minimum requirements of the City's administrative procedures. The Morongo Basin Transit Authority (MBTA) on behalf of CalACT, released RFP #20-01 in October 2020 for the procurement of accessible transit/paratransit vehicles. Seven proposals were received and six were awarded contracts based on pricing and other evaluation criteria such as warranty, service and support, proposer experience, references, and vehicle type(s). MBTA awarded contract #20-01 AZ (ICE-1) to A-Z Bus Sales, Inc. in September 2021, which is available for use by all members of CalACT. Approval to Purchase One Ford E-450 Type B Glaval Bus from A-Z Bus Sales and Two Engine Driven Storm Water Pumps from Charles King Company May 9, 2023 Page 3 On October 8, 2021, staff obtained a quote from A-Z Bus Sales, Inc. for a 10-passenger shuttle bus equipped with a wheelchair lift for a total of $94,394.42. The original quote was for a bus with a narrow chassis capable of navigating alleys and small streets in neighborhoods such as Balboa Island. The vendor reported supply chain issues and informed staff the purchase was on back order. Due to the lack of availability, staff worked to adjust the specifications to a unit with more availability, for a quote of $98,680.08 (Attachment A). The larger chassis increased costs and the vendor reported inflation had since affected pricing as well. In December 2022 staff was notified by A-Z Bus Sales that all orders in progress were impacted by a Force Majeure price adjustment through the manufacturers (Attachment B). The latest quote, received on January 9, 2023, reflects a final total cost of $123,570.76 (Attachment C). Since this purchase exceeds the City Manager's contract authority, City Council approval is required. Staff requests approval for purchase of a Ford E-450 Type B Glaval Bus from A-Z Bus Sales, Inc. for a total amount of $123,570.76 Storm Water Pumps The Utilities Department operates and maintains the storm drain infrastructure throughout the City, which includes two large engine driven storm water pumps strategically placed on the Balboa Peninsula. One pump is at 44th Street and River Avenue and the other is at 30t" Street and LaFayette Avenue. These pumps are activated during rain and high tide events when portions of the Balboa Peninsula are below sea level and threatened by catastrophic flooding. They are considered critical infrastructure. The pumps have exceeded the recommended service life and condition criteria as established by City Council Policy F-9 guidelines; therefore, staff recommends replacing both units. The Fiscal Year 2022-23 budget includes the replacement of two stationary engine drive storm water pumps (Units 3694 and 3696). In 2015, staff from the Utilities and Public Works Departments developed criteria for new pumps that would replace older units currently in service. Arrangements were made to rent a variety of machines, place them in service, and conduct onsite testing. The ideal pump would incorporate a robust design and protective structure, industry proven engine and pumping apparatus, simple and intuitive operational controls, and be available through a local vendor that could provide same day parts and technical support. Furthermore, many storms and high tide events occur at night and during the winter season. Staff from other departments assist with operations, therefore, having a fleet of equipment that is familiar and dependable is critical for an effective and safe response. Staff settled on models built by Pioneer Pump and sourced through Charles King Company of Signal Hill, California, concluding Pioneer Pumps met the objective criteria of superior design and ease of operation, and same day parts and product support are available through a local vendor. The first Pioneer Pump was purchased in 2016 and another five units have since been added to the Utilities Department. Staff is satisfied with these new pumps and seeks to continue the effort to replace existing units. UN Approval to Purchase One Ford E-450 Type B Glaval Bus from A-Z Bus Sales and Two Engine Driven Storm Water Pumps from Charles King Company May 9, 2023 Page 4 As the sole source distributer for Pioneer Pumps in Southern California, Charles King Company provided quotes for these two Pioneer Pumps totaling $255,745.97. The cost for the storm water pumps is approximately 30% higher than the original amount budgeted for replacement, which is largely due to an increase in manufacturing costs to comply with new clean air standards for diesel engines recently imposed by the State of California. In addition, there has been a significant increase in costs associated with supply constraints caused by production delays. FISCAL IMPACT: The FY 2022-23 budget includes funding for the purchase of the new Oasis 10-passenger Transit Bus and the two Pioneer Engine Driven Storm Water Pumps in the amounts of $98,000 and $178,500, respectively. Budget Amendment 23-066 will appropriate the additional $25,571 and $77,246 needed to cover the costs beyond the amounts that were originally budgeted. The purchases will be expensed to the Rolling Equipment account (7529032-911016) in the Equipment Fund (Fund 752), which has a reserve balance of approximately $8 million. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
