Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Bob Stein, Assistant City Engineer, rstein@newportbeachca.gov PHONE: 949-644-3322 TITLE: Peninsula Encroachment Removal Project— Notice of Completion for Contract No. 8814-1 (22M14) On June 14, 2022, the City Council awarded the Peninsula Point Encroachment Removal Project to SDG Enterprises (SDG). The work is now complete and staff requests City Council acceptance to close out the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. DISCUSSION: Under the authority of Consent Orders signed by the California Coastal Commission (CCC), the City of Newport Beach (City) was tasked with implementing a program designed by the City's design consultant, Glenn Lukos Associates Inc. (GLA), to first remove private encroachments on the public beach from west of F Street to Channel Road (see attached location map), and then restore the area with native plants and a hydroseed mix of native seeds. Per the GLA plan, the project would be performed in five phases and be completed in Winter 2025. With the approval of the CCC, City staff revamped the design so that it could be constructed in a single phase and in a manner that would be less stressful to residents. Under the revised plan, the City's construction contractor, SDG, began removing encroachments in September 2022 and completed the removals the first week of December 2022. 5-1 Peninsula Encroachment Removal Project — Notice of Completion for Contract No. 8814-1 (22M14) May 9, 2023 Page 2 After removals were performed, hydroseed was spread over the 2.2-acre area, just ahead of the seasonal rains. A post -and -rope fence was installed around the hydroseeded area. In addition, 1,332 one -gallon plants were installed along the beach access sidewalks at the street ends at F, G, I, L and M Streets. Subsequently, SDG maintained the plants for a 120-day duration, which included weeding nearly every week. This plant maintenance task was completed on March 31, 2023. Staff has found that this season's abundant rain has already produced very good germination of some of the native seed within the hydroseed mix, resulting in approximately 20 percent coverage of the restoration area. The City will annually report restoration results to the CCC for the next five years per the requirements of the Consent Orders. The contracted work has now been completed to the satisfaction of the Public Works Department. The summary of the overall construction cost is as follows: Original Bid Amount: $ 588,024.00 Actual Cost of Bid Items Constructed: $ 502,454.00 Total Change Orders: $ 78,090.00 Final Contract Cost: $ 580,544.00 The final contract cost was $580,544.00, which is approximately one percent lower than the original bid amount. There were four contract change orders approved for the project. The change orders included removing additional trees and areas of invasive ice plant, spreading sand in areas of the removals and remobilizing for two additional planting efforts. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
