HomeMy WebLinkAboutC-4i - Funding for City Dump Site Study! 2.08 CITY OF NEWPORT BEACH OFFICE OF THE CITY MANAGER December 22, 1967 TOi CITY COUNCIL FROM: City Manager SUBJECT: FUNDING FOR CITY DUMP SITE STUDY On October 14, 1966, a contract was executed with C, E, Hurley Contracting Company to replenish 60,000 cubic yards of sand in West Newport for $51,000, The total amount was encumbered. The City has to this date paid $38,165 which we consider payment in full, This leaves an unexpended balance of $12,835. The contractor has filed a suit against the City claim - ing that the amount paid is insufficient. Litigation is pending on this matter and in all probability will not appear on the Court calendar for at least six months. If at that time a judgment should be rendered in favor of the plaintiff, we would be into the 1968 -69 fiscal period. Since the City would have the right to appeal�finaljudgment could very well be extended into the 1969 -70 fiscal period, With this prospective time table, it is illogical to continue the encumberance on the $12,835 and it would appear much more appropriate to return this money to the Unappropriated Contingency Reserve to be utilized in the current fiscal period, It is recommended that the Council make this budgetary transfer and in turn utilize a portion of these surplus funds to provide for the $5,700 Economic Land Use Study of the City Ihmp Site which was approved at the last Council meeting„ This will result in a net increase to the Un- appropriated Contingency Reserve of $7,135 for a total balance of $22,828, HLH:ep JNJ:: d7 -67 HARVEY L.
