Agenda Item No. 7
TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: Leilani I. Brown, City Clerk - 949-644-3005,
(brown@newportbeachca.gov
PREPARED BY: Leilani I. Brown, City Clerk
TITLE: Resolution No. 2023-36: Confirmation of Nominations to the Water
Quality/Coastal Tidelands Committee
ABSTRACT:
A total of three seats on the Water Quality/Coastal Tidelands Committee (Committee) will
be available for appointment by the City Council after June 30, 2023. Two of the seats
are scheduled vacancies with members reaching their maximum term limits, and the third
seat is an unscheduled vacancy due to a resignation. City Council Policy A-2 (Boards,
Commissions and Committees) states that it is the intent of the City Council that at least
two separate individuals be considered for each vacancy; however, there is an insufficient
number of applicants to nominate to create a pool of at least two individuals per vacancy
unless the City Council considers the two existing members of the Committee who have
reached their maximum term limits. Both of the members who have reached their
maximum term limits have requested to continue to serve on the Committee. Additionally,
the Ad Hoc Appointments Committee recommends that the City Council confirm the
nominations of both members for an additional term, which the City Council may do via
the adoption of a resolution. All vacancies were noticed according to the Maddy Act and
City Council Policy A-2.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Adopt Resolution No. 2023-36, A Resolution of the City Council of the City of Newport
Beach, California, Waiving the Term Limits Established by Resolution Nos. 2012-115,
2021-11, and City Council Policy A-2, Boards, Commissions and Committees; and
c) Confirm the nominations of the following applicants to fill the three available
Committee seats, each with terms scheduled to expire June 30, 2027:
Lawrence (Tom) Houston
Craig Hudson
Steve Patterson
Spencer Pirdy
George Robertson, and
John Wadsworth.

DISCUSSION:
The purpose of the Water Quality/Coastal Tidelands Committee is to advise and make
recommendations to the City Council on policies, projects and programs that support and
strengthen existing regulations to protect water quality and habitat in the bay and ocean.
The Committee is comprised of seven members appointed by the City Council and
two non -voting Council Members appointed by the Mayor, subject to confirmation by the
City Council. The seven members appointed by the City Council serve a four-year term
with a limit of two consecutive terms. The two non -voting Council Members serve a
one-year term. The Committee is subject to the open meeting laws of the Ralph M. Brown
Act. The three seats on the Committee that are scheduled for vacancy on June 30, 2023,
are comprised of two scheduled vacancies due to members reaching their maximum term
limit and one unscheduled vacancy due to a member resigning from the Committee.
The two Committee members who have reached their maximum term limits are Lawrence
(Tom) Houston and George Robertson. Both members were originally appointed to the
Committee on January 22, 2013, and reached their term limits on January 22, 2021. Due
to an insufficient number of applicants, on February 23, 2021, the City Council adopted
Resolution No. 2021-11 which, in part, waived term limits and extended their terms to
June 30, 2023. Both members could continue to serve on the Committee if the City
Council adopts the attached resolution (Attachment A), which further waives term limits
on the Committee. Both members have requested to continue to serve on the Committee.
The unscheduled vacancy on the Committee is due to the resignation of Louis Denger
who resigned in March 2023. His term was scheduled to expire on June 30, 2023.
Pursuant to City Council Policy A-2, the City Council may appoint an individual to fill the
unscheduled vacancy through the remainder of the existing term, June 30, 2023, and
additionally, the following four-year term commencing June 30, 2023, and expiring
June 30, 2027, because the vacancy occurred within six months of the end of the existing
term.
On Friday, March 31, 2023, the City Clerk posted the Notice of Vacancies in the City
Clerk's Office and on the City Hall bulletin board, placed the Notice of Vacancies on the
City's website, and on Saturday, April 8, 2023, the City Clerk published the Notice of
Vacancies in the Daily Pilot. The deadline to submit applications was Wednesday,
May 10, 2023.
Pursuant to City Council Policy A-2, Mayor Noah Blom established a Council Ad Hoc
Appointments Committee (Appointments Committee) comprised of himself, Mayor Pro
Tern Will O'Neill, and Council Member Lauren Kleiman who were charged with reviewing
the applications and making recommendations to the full City Council.
At the conclusion of the application period, the Appointments Committee reviewed the
applications and recommends that Lawrence (Tom) Houston, Craig Hudson, Steve
Patterson, Spencer Pirdy, George Robertson, and John Wadsworth be nominated for the
seats on the Committee.

COMMISSIONS AND COMMITTEES
WHEREAS, pursuant to the 1978 Beacon Bay Bill, as amended, the City of
Newport Beach ("City") acts on behalf of the State of California as the trustee of tidelands

WHEREAS, the City has a long history of protecting the water quality of Newport

provides guidelines, rules, and regulations applicable to committees, including a limit on
the terms of service,
WHEREAS, on February 23, 2021, the City Council adopted Resolution No. 2021-
11, which staggered the service terms for the seven citizen members of the Committee,
and, due to an insufficient number of applicants to fill available seats, waived term limits

Section 4: If any section, subsection, sentence, clause or phrase of this

affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or

I have lived in wonderful Newport Beach my entire life, and I am continually amazed by our vast coastline
and waterways. The ocean and the waters surrounding Newport Beach have been an integral part of my life
since I was a child and all the way through to present day. Our access to the Pacific Ocean and bay is one
of our greatest qualities as a city. I want to be able to preserve our beautiful beaches, waterways and
tidelands the best as I can for future generations. lt's my hope that joining this committee will allow me to
have a positive impact on the future of our city. I thank you for your consideration.

I have been a home owner in Newport Beach (formerly Santa Ana Heights) since 1989. Prior to retiring in
July 2022, 1 was employed as a Sr. Scientist with the Orange County Sanitation District's (OC San) Ocean
Monitoring Program. During my 33+ years with QC San, I worked on a variety of water quality programs
affecting the beneficial uses of Orange County beaches and near -shore ocean waters. This work entailed
extensive collaboration with both internal and external parties. As a current member of the WQ1CT
committee, I have endeavored to bring my knowledge of local conditions and important pubic and
environmental health issues for the city's benefit. With complex and expensive issues, like sea level rise,

Summarize why you wish to serve the Cityof Newport Beach on a board, commission or committee. Include any special qualifications
you have which are particularly appropriate to the position for which you are applying.
As a 30 year resident of NB, specifically on the Baiboa Peninsula, I realize the community and public benefit our ocean,
beaches and harbor bring to our amazing city. While our local coastline and harbor are the economic engine that fuels N6,
environmental preservation and a better sustainabillty plan is Critical to ensure our most precious resources are protected now
and forfuture generations of residents and visitors. I would welcome the opportunity to serve on the WQTC to advise on
policies, projects and programs that protect water quality, bay and beach habitat and critical tidelands infrastructure. Note, 1
have been a regular attendee to WQTC meetings since 2019 and have a good understanding of the roles, responsibilities and
goals of the committee. A unique qualification for the WQTC posi#ion is my involvement with the Surfrider Foundation
(www.surfrider.org). I have had a leadership role at Surfrider since 2017 and currently hold the position of co chair of the North
OC Chapter (includes NB).
