TITLE: FY 2021-2022 Playground Improvements — Notice of Completion of
Contract No. 8716-1 (22P01)
ABSTRACT:
On July 12, 2022, the City Council awarded Contract No. 8716-1, 2021-2022 Playground
Improvements, to R.E. Schultz Construction, Inc. (R.E. Schultz) of Orange, California.
The project consisted of removal and reconstruction of rubber surfacing and playground
equipment of two playgrounds at West Newport Park. The work is now substantially
complete and staff requests City Council acceptance and closeout of the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of the
Civil Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.

The work necessary for the completion of this contract consisted of removing and
disposing of existing improvements including existing rubber surface wear course and
playground equipment; furnishing and installing flexible play surface systems, play
equipment, flat work and a drinking fountain; and other incidental items to complete the
work in place as required by the contract documents.

The contract has been completed to the satisfaction of the Public Works Department and
Recreation and Senior Services Department. A summary of the construction cost is as
follows:

The project incurred one change order. During demolition it was discovered the existing
Orange Street playground was built on a gravel base rather than the more typical concrete
subbase. Therefore, a change order was issued to remove the gravel base and install a
concrete subbase throughout the playground area so the rubber surfacing had a more
stable layer to be constructed upon.

FISCAL IMPACT:
The FY 2021-22 Playground Improvements Project was included in the FY 2022-23
Capital Improvement Program (CIP) Budget as a re -budget. Building Excise Tax (BET)
funds were used for the design and construction of the project. The BET fund was
developed to account for property development taxes imposed on construction and
occupancy of all residential, commercial, industrial units, and mobile home parks for
which a building or construction permit is issued. BET funds are used for acquiring,
improving, expanding and equipping City of Newport Beach (City) fire stations, City
libraries and City parks as provided by Chapter 3.12 of the Newport Beach Municipal
Code. Other funds used for the construction and the playground equipment includes the
General Fund and the Recreation and Senior Services Department's Equipment/
Equipment Replacement funds.

ENVIRONMENTAL REVIEW:
On July 12, 2022, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301_Class 1 (rehabilitation of
deteriorated facilities) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because this project results in no expansion of an existing use.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
