SUBJECT: QUITCIAIMING CITY'S INTEREST IN UNUSED PROPERTY AT
NORTHWESTERLY CORNER OF BA,YSIDE DRIVE AND EL PASEO DRIVE
LOCATION: A parcel of land in Block 94 of Irvine's Subdivision of
Ranchos San Joaquin and Lomas de Rancho Santiago de Santa
Ana as shown on a map recorded in Book 1, Page 88 of
Miscellaneous Maps, Records of Orange County, California,
located on the north westerly corner of Bayside Drive and
E1 Paseo Drive.
RECOMMENDATIONS:
Approve the Quitclaim Deed; and authorize the Mayor and
the City Clerk to execute the deed.
DISCUSSION:
The Irvine Company, in February of 1950, granted the
subject property to the City exclusively for water reservoir and
pump station purposes with the provision that the property would
revert back to The Irvine Company or its successors and assigns at
such time as the City ceased to use the property for water
reservoir or pump station purposes for the period of one year.
The City has had no facilities located within the subject
property for a number of years and has no future plans to utilize
the property for water reservoir or water pump station purposes.
The Irvine Company is in the process of preparing the
property for sale and has requested that the City quitclaim their
interest in the subject property in accordance with the provisions
of the Grant Deed recorded in Book 1971, Pages 122 through 127
inclusive, in the Orange County Recorders Office.
It is recommended that the property be quitclaimed in
accordance with the provisions of the Grant Deed.
A copy of the Grant Deed is attached for reference.

hereby acknowledged, THE IRVINB COMPANY, a corporation, does
hereby grant. and convey to CITY OF NEWPORT BRACH, a municipal
corporation, the real property situated in tlil , County of
Orange, State ofCalifornia, particularly described as
follows:
A parcel of land in Block 94 of Irvine's
Subdivision of Ranohoe San Joaquin and Lomas de
Santiago and Flint and Bixby's Allotment of
Rancho Santiago de Santa Ana as shown on a map .>
recorded in Book 1, page 68 of Misoellaneoua '
Maps records of Orange County, California, more
part oularly desctibea as follows:
Beginning at a point in the northeasterly
line of Bayside Drive 50 feet wide, as shown on
map attached to and described in Deed recorded
June 11, 1936, in Book 830, page 217 of Official
Records, records of Orange County, California;
said point of beginning being opposite the north-
westerly and of Course 14 and also tho beginning of
a curve as shop on said map attached to said Deed;
thence North 40 05130" West along the Northeasterly
life of said Bayside Drive 113.90 feet; thence North
49 54'30" East 51.6s feet; thencer South 60053125"
East 84.11 feet; thence South 40005130" East 82.37
feet; the= South 62033155" West 67.61 feet to the
beginning of a curve concave to the north end having
a radius of 20 feet; thence southwesterly, westerly
and northwpterly alone said curve through a central
angle of 78°02136" an are distance of 27.24 feet to a
point in the northeasterly line of said Course 14;
said point being a point �n curve concave southwesterly
and having a radius of 1025.00 feet; thence northwesterly
along said curve, (said curve being the northeasterly
line of said Course 14,) through a central angle of
0042101" 12.53 feet to the point of beginning.
RESh,RVING therefrom, for highway purposes, a
strip of land 20 feet wide, the northeasterly line
of said 20 foot strip of land being parallel to and
45.0 feet northeasterly from the center line of said
Bayside Drive, as described in said Deed.
SUBJECT to unpaid taxes and/or nssessmen' for
the fiscal year 1949-1950, and to covenants, c n-
ditions and reservations of record, if any .

benefit and shall bind the parties hereto and their respective
successors or assigns in interest, to -wits
1. That said property shall be used exclusively
for the erection and maintenance thereon by the grantee of
a water reservoir and water pumping plant, and its appurtenances,
for the distribution of water to portions of said City of New-
port Beach and to lands adjacent thereto; and if at anytime
hereafter said property is abandoned, or ceases to be used for
said purposes, for a period ofone year, then all right, title
and Interest therein of grantee shall revert to grantor, Its
successors and assigns.
2. Grantee shall at Its expense keep and main-
tain the reservoir, pumping plant, pipelines and other appur-
tenances thereto erected on said property In Food order and
condition and shall repair any and all leaks therein so as
to prevent any injury -or -damage to adjoining property from
overflow or escape of water; and in the avant second party shall
s. fall to do so within ton days after written notice from grantor
to grantee, then all right, title and interest of grantee In
and to said property shall, at the option of grantor, cease and
terminate and shall revert to grantor, its successors and assigns.
