Background
At the March 14, 2023 City Council meeting, Mayor Pro Tern O'Neill
introduced an "A-1 Item" to:
"Consider directing staff to develop a pilot program that allows
Newport Beach Community Homeowners Associations, that represent
at least 50 homeowners, to install solar powered security cameras,
signs and other related improvements in the public right-of-way"
On April 25t", 2023 City Council meeting, Council held a Study Session to
discuss the idea to develop said pilot program. As an outcome of this
discussion, Council gave staff general direction to develop and bring back
the framework of such a pilot program for review and approval.
Elements of Proposed Pilot Program
➢ Pilot program would run for one year, beginning June 27, and ending July 1, 2024
➢ Pilot program would allow up to ten (10) qualified Homeowner's Association
(HOA), with at least fifty (50) single -unit dwellings within a contiguous
neighborhood, to install private security cameras within the public right-of-way.
➢ Program would Waive Council Policy L-6 language so as to allow for private
security cameras within the public right-of-way.
➢ Pilot program would temporally waive the collection of any rent for use of the
public right-of-way, however any encroachment permit and agreement fees
would still need to be paid.
➢ HOA Applicants will need to abide by the conditions of the Encroachment Permit
➢ Standard Advisory Signage will be used by all HOA's (see Attachment D)
➢ Police Department will provide City Council with a follow-up report at the
conclusion of the pilot program regarding the crime reduction impacts associated
with the program

Primary Conditions for Camera Installation
■ Complete application and pay application fees
■ Provide necessary HOA supporting information/documentation/and contact info
■ Provide camera information, camera & signage installation site plan, installer and
operator information
■ Security cameras shall be self-contained with solar or battery power and wireless
communications, fix directed as allowed, not have pan/tilt/or zoom capabilities,
and shall not utilize facial recognition nor capture audio
■ The HOA shall agree to relocate any security camera system, or portion thereof, if
requested to do so by the City
■ Upon request, HOA shall share statistical information with the NBPD so it can
assess the Pilot Program
■ The HOA shall agree to defend, indemnity, and hold the City harmless from all
claims associated with security camera installation/operation

expressed an interest to participate in Pilot Program:
1) Spyglass Hill Community Association
2) Harbor View Community Association Board (Port streets — Phase 1)
3) The Newport Hills Community Association (Port streets Phase 2)
4) Dover Shores Community Association
