Leung, City Manager - 949-644-3001, gleung@newportbeachca.gov PREPARED BY: Paul Blank, Harbormaster pblank@newportbeachca.gov PHONE: 949-270-8158 TITLE: Resolution No. 2023-50: Amending the Staff Structure of the Harbor Department ABSTRACT: The Harbor Department staffing structure presently includes four, full-time Lead Harbor Service Workers and two, full-time Harbor Service Workers. In filling these positions, staff has revisited the department's operational needs and is requesting an amendment to the staffing structure. To further promote efficiency in the department, the proposed resolution, if adopted, would eliminate one full-time Harbor Service Worker position and replace it with the addition of one full-time Lead Harbor Service Worker position. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Change the staffing structure of the Harbor Department by eliminating one full-time Harbor Service Worker position and replacing it with the addition of one full-time Lead Harbor Service Worker position; and c) Adopt Resolution No. 2023-50, A Resolution of the City Council of the City of Newport Beach, California, Amending the Staffing Structure in the Harbor Department. DISCUSSION: The Harbor Department proposes the elimination of one full-time Harbor Service Worker position and the addition of one full-time Lead Harbor Service Worker position. Currently, the Harbor Department's staffing structure consists of four full-time Lead Harbor Service Workers and two full-time Harbor Service Workers. Those positions were created with the Council's approval of a requested program enhancement for Fiscal Year 2023-24. Between the time the program enhancement was developed (late in 2022) and the recruitment was authorized (July 1, 2023), the operational needs of the Harbor Department changed. 8-1 Resolution No. 2023-50: Amending the Staff Structure of the Harbor Department August 22, 2023 Page 2 Staff has reviewed the duties and qualifications of both positions as well as the evolving department needs. Department leadership has seen several instances where more experienced team members delivered the required services more effectively, more cost -efficiently and ultimately with a better outcome for the department's customers and stakeholders than less experienced team members. The proposed reclassification will allow the Harbor Department to more effectively deliver the services offered using the skills, experience and abilities of candidates for the Lead Harbor Services Worker position while still providing an opportunity to develop the skills and abilities of less experienced candidates. Both positions can be filled from the pool of qualified candidates participating in the current recruitment. If approved, Resolution No. 2023-50 would amend the staffing structure in the Harbor Department by eliminating one full-time Harbor Services Worker position and replacing it with one full-time Harbor Services Lead position. ;IM91-11MIIVA1:7_\;"IF The Fiscal Year 2023-24 budget includes sufficient funding for this staffing change. The four Harbor Service Worker positions and one Lead Harbor Service Worker position approved in the budget were budgeted at a higher rate than they will be filled at, yielding sufficient projected salary savings to cover the increased cost of the staffing change. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A - Resolution No. 2023-50 8-2 ATTACHMENT A RESOLUTION NO. 2023- 50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING THE STAFFING STRUCTURE IN THE HARBOR DEPARTMENT WHEREAS, City of Newport Beach ("City") Charter Section 601 requires the City Council to provide the number, titles, qualifications, powers, duties and compensation of all officers and employees; WHEREAS, Newport Beach Municipal Code Section 2.28.010 provides, upon recommendation of the City Manager, for the City Council establish by resolution the classification of positions in City employment and a salary range or rate for each class of position; WHEREAS, the City's Harbor Department ("Harbor Department") staffing structure presently includes four (4) Full Time Lead Harbor Service Workers and two (2) Full Time Harbor Service Workers; WHEREAS, due to changing operational needs and to promote efficiency in the delivery of services by the Harbor Department, the City Council, upon the recommendation of the City Manager, desires to amend the staffing structure of the Harbor Department by eliminating one (1) Full Time Harbor Service Worker position and replacing it with one (1) Full Time Lead Harbor Service Worker position; WHEREAS, the salary range and Job Description/Classification Specification for these positions were previously established by the City Council; and WHEREAS, the City Manager has reviewed the position classification and salary range provided in this resolution and recommends approval. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: One (1) Full Time Harbor Service Worker position assigned to the Harbor Department shall be eliminated and one (1) Full Time Lead Harbor Service Worker position shall be added to the Harbor Department's staffing structure. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Any previously adopted resolution, Ilm Resolution No. 2023- Page 2 of 2 or portion thereof, in conflict with the provisions of this resolution is hereby repealed to the extent it conflicts. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act (°CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
