Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer, tandefur@newportbeachca.gov PHONE: 949-644-3321 TITLE: Gateway Park Improvements — Notice of Completion of Contract No.8791-1 (231-01) ABSTRACT: On January 10, 2023, the City Council awarded Contract No. 87976-1, Gateway Park Improvements, to Armstrong Cal Builders, Inc. (Armstrong Cal) of Signal Hill, California. The project consisted of replacing turf and landscaping, reconstructing landscape walls, and installing new lights and signage. The work is now substantially complete and staff requests City Council acceptance and closeout of the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release the Faithful Performance Bond one year after acceptance by the City Council. Old vegetation was replaced. New palm trees were installed along with groundcover and accent plants. New lighting and signage was installed. A previously closed walkway was repaved and reopened between Newport Boulevard and the Lido Marina Village. 9-1 Gateway Park Improvements — Notice of Completion of Contract No. 8791-1 (231-01) August 22, 2023 Page 2 The contract has been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original Bid Amount: $ 540,233.50 Actual Cost of Bid Items Constructed: $ 540,233.50 Total Change Orders: $ 29,049.97 Final Contract Cost: $ 569,283.47 The project incurred five change orders. Additional demolition costs were approved for the unusually thick concrete pathway on the Lido side of the park; additional waterproofing was added to the existing planters; an existing electrical pull box was moved to clear the way for a palm tree planting; the existing wall on the Balboa side was given an additional coating to match the new portions of the wall; and a sprinkler lateral line was added to the Balboa turf grass area for better coverage. A summary of the project schedule is as follows: Estimate Start of Construction per Annual Baseline Schedule November 15, 2022 Actual Start of Construction per Notice to Proceed April 3, 2023 Extended Contract Completion Date Inclusive of Extra Work July 28, 2023 Actual Substantial Construction Completion Date July 5, 2023 FISCAL IMPACT: The Gateway Park Improvements Project was included in the FY 2022-23 Capital Improvement Program (CIP) Budget, Landscape Enhancement Program. Neighborhood Enhancement funds were used for the design and construction of the project. The Neighborhood Enhancement fund was developed for installation or rehabilitation of various citywide improvements, including landscape projects that beautify neighborhoods. Funds for the construction contract were expended from the following budget accounts. Account Description Account Number Amount Neighborhood Enhancement 53601-980000-23L01 $ 569,283.47 Total: $ 569,283.47 ENVIRONMENTAL REVIEW: On January 10, 2023, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302 (c) (reconstruction of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. 9-2 Gateway Park Improvements — Notice of Completion of Contract No. 8791-1 (231-01) August 22, 2023 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
