Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Andy Tran, Senior Civil Engineer, atran@newportbeachca.gov PHONE: 949-644-3315 TITLE: Concrete Replacement Program FY 2023-24 (Project No. 24R06) — Award of Contract No. 9378-1 ABSTRACT: City of Newport Beach (City) staff received construction bids for the Concrete Replacement Program Fiscal Year 2023-24 project and requests City Council approval to award the construction contract to Grigolla & Sons Construction Company, Inc. of San Dimas, CA. This project will replace deteriorated concrete sidewalks, driveways, curbs and gutters, and access ramps in the Mariners and Dover Shores neighborhoods. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities involving negligible or no expansion of use) of the CEQA Guidelines, because this project has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Award Contract No. 9378-1 to Grigolla & Sons Construction Company, Inc. for the bid price of $989,250 for the Concrete Replacement Program FY 2023-24, and authorize the Mayor and City Clerk to execute the contract; d) Establish a contingency of $200,000 (approximately 20 percent of total bid) to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 24-023 appropriating, $77,756 in increased expenditures in 01201927-980000-24R06 from the General Fund Capital Projects Fund's unappropriated fund balance. DISCUSSION: The City's annual Concrete Replacement Program involves replacing deteriorated concrete sidewalks, driveways, curbs and gutters, and access ramps. This program precedes the annual slurry seal program, which is scheduled to start in spring 2024. This year's project focuses on concrete improvements in the Mariners and Dover Shores neighborhoods. 6-1 Concrete Replacement Program FY 2023-24 (Project No. 24R06) — Award of Contract No. 9378-1 September 26, 2023 Page 2 At 10 a.m. on August 31, 2023, the City Clerk opened and read the following bids for this project: BIDDER TOTAL BID AMOUNT Low CJ Concrete Construction, Inc.* $ 979,450* 2nd Grigolla & Sons Construction Co. The apparent low bidder, CJ Concrete Construction, Inc., was deemed non -responsive since it did not submit the necessary bid documents as required and described in the Instructions to Bidders. The second lowest bidder, Grigolla & Sons Construction Company, Inc., possesses a California State Contractor's License Classification "A", as required by the project specifications. A review of references for Grigolla & Sons Construction Company, Inc. shows satisfactory completion of similar contracts for the City and other municipalities. The second lowest bid was 4.1 percent above the Engineer's Estimate of $950,000. The minor difference between the second lowest bid and the Engineers Estimate was due to the steady rising prices of concrete materials and the ongoing inflationary construction environment. Pursuant to the contract specifications, the contractor will have 60 consecutive working days to complete the work. Work is scheduled to start in late October. The project plans and specifications will be available for review at the September 26, 2023 City Council meeting or upon request. FISCAL IMPACT: Upon approval of the proposed budget amendment, sufficient funding is available from the current CIP budget for the award of this contract. $105,000 in contribution funding is also included to address final restoration work related to the Balboa Boulevard Undergrounding (UUD-22 Phase 2) and will be billed to the utility companies upon completion. The following funds will be expended. Construction Contingency $ 200,000 Printing & Incidentals $ 1,750 Total: $ 1,191,000 The source of funding for this project is the General Fund Capital Projects Fund, which is the City's primary fund for financing its annual Concrete Replacement Program, and a contribution from utility companies as described above. Staff recommends establishing $200,000 (approximately 20 percent of total bid) for contingency purposes and unforeseen conditions associated with construction as well as the added utility company's concrete related restoration, not in the original bid. Bid pricing is favorable and the contractor has performed well for the City on past projects. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities involving negligible or no expansion of use) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
