ZC2022-019 APPLICANT: Burns Family Survivor’s Trust A of The Burns Living Trust Dated June 4, 1991 LOCATION: 215 Poinsettia LEGAL DESCRIPTION Lot 11 and the southwesterly 25 feet of Lot 13, Block 142, Corona del Mar Tract On May 25,2022, Zoning Clearance No. ZC2022-019 was approved authorizing the development of a new 775 square foot Accessory Dwelling Unit (ADU) ADU located above an attached garage. This approval is based on the following standards. 1. The project is for an Accessory Dwelling Unit 2. The project is located in the R1 zoning district and is a permitted use. 3. There is an existing single-unit dwelling on the lot. 4. The project is classified as the construction of a new attached ADU to a single-unit dwelling 5. The project complies with all conditions and applicable development standards of Section 20.48.200 (Accessory Dwelling Units). 6. The project is located in the coastal zone but is exempt from obtaining a Coastal Development Permit per Newport Beach Municipal Code chapter 21.52.035 (Projects Exempt from Coastal Development Permit Requirements) subsection (C)(1) as the ADU is an improvement to an existing single-unit residential building. None of the exceptions to the exemptions apply. 7. A deed restriction will be recorded prior to the issuance of a building permit related to occupancy restrictions (if applicable), prohibition on the separate conveyance, and restrictions on short-term rentals.
