TITLE: FY 2023-24 Traffic Signal Rehabilitation Project — Award of Contract
No. 9416-1 (24T01)
ABSTRACT:
The City of Newport Beach (City) has received construction bids for the Fiscal Year 2023-
24 Traffic Signal Rehabilitation Project and requests City Council approval to award the
construction contract to Elecnor Belco Electric, Inc. of Chino, California. The project will
address signal system improvements on Balboa Boulevard, as well as signage on
Balboa Boulevard and Bristol Street.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Approve the project plans and specifications;
c) Award Contract No. 9416-1 to Elecnor Belco Electric, Inc. for the bid price of
$1,206,888 for the FY 2023-24 Traffic Signal Rehabilitation Project, and authorize the
Mayor and City Clerk to execute the contract; and
d) Establish a contingency of $120,000 (approximately 10 percent of total bid) to cover
the cost of unforeseen work not included in the original contract.
DISCUSSION:
The Public Works Department operates 123 City -owned traffic signals. Annually, a plan
is developed to replace and rehabilitate older traffic signals that are nearing or at the end
of their service life. The work consists of replacing aging poles, controller cabinets,
equipment, and wiring, to maintain the existing traffic signal operation and increase the
reliability of the traffic signal system. For this budget year, the project consists of the
following three locations:
• West Balboa Boulevard at 22nd Street/23rd Street
• West Balboa Boulevard at 21 st Street
• East Balboa Boulevard at Main Street

In addition, due to the similar nature of work, the following components were included in
the project:
• Installation of a new dynamic message sign at Newport Boulevard and 29t" Street
• A fiber optic communication upgrade on West Balboa Boulevard from
River Avenue to 32nd Street, and 32nd Street from West Balboa Boulevard to
Newport Boulevard
• Replacement of signs & lighting on overhead sign bridges at the following three
locations:
➢ Bristol Street North east of Campus Drive
➢ Bristol Street South west of Jamboree Road
➢ Jamboree Road south of Bristol Street South
At 10 a.m. on October 11, 2023, the City Clerk opened and read the following bids for the
Fiscal Year 2023-24 Traffic Signal Rehabilitation Project:

The low bid amount is 21 percent above the Engineer's Estimate of $1,000,000. The low
bidder, Elecnor Belco Electric, possesses a California State Contractors License
Classification "C-10" as required by the contract documents. The contractor has
successfully completed similar projects within Newport Beach and a check of the
contractor's references indicates satisfactory completion of similar projects for other
public agencies.
Pursuant to the contract documents, Elecnor Belco Electric has 100 consecutive working
days to complete the project. Failure to complete the work within the specified time will
result in liquidated damages set at a daily sum of $500.
The project plans and specifications will be available for review at the October 24, 2023
City Council meeting or upon request.
FISCAL IMPACT:
Sufficient funding is available within the Fiscal Year 2023-24 Capital Improvement
Program (CIP) budget for completion of this contract. In addition to General Fund CIP
and Gas Tax funding, the project includes funding from the Information Technology (IT)
Replacement Fund for the fiber optic installation on Balboa Boulevard. The following
funds will be expensed:

Staff recommends establishing $120,000 (approximately 10 percent) for contingency
purposes and unforeseen conditions associated with construction.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
