TITLE: 2022-2023 Citywide Facilities Painting Project (Project No. 23F02) —
Notice of Completion for Contract No. 8940-1
ABSTRACT:
On February 14, 2023, the City Council awarded Contract No. 8940-1 for the 2022-2023
Citywide Facilities Painting project to Tony Painting. The project consisted of painting
various City of Newport Beach facilities throughout the community. The work is now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

This project included removing rust, preparing surfaces to receive improvements, priming
surfaces, and installing two coats of new paint.
The contracted work has been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

Final Contract Cost:

The final total contract amount was $351,800, which was approximately 7% lower than
the original bid amount. The cost decrease was primarily due to the $60,000 incidental
repairs to damaged surfaces bid item which was not utilized for this project. Change
orders, in the amount of $34,625, were approved to add painting for 14 lifeguard towers
and additional areas at Mariners' Library, OASIS Senior Center, and Marina Park
Lighthouse.

FISCAL IMPACT:
The 2022-2023 Citywide Facilities Painting project was included within the FY 2022-23
Capital Improvement Program (CIP) Budget. Funds for the construction contract were

On February 14, 2023, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 Class 1 (maintenance of
existing facilities involving no expansion of an existing use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
