NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 100 CIVIC CENTER DRIVE, NEWPORT BEACH ZOOM THURSDAY, NOVEMBER 16, 2023 REGULAR MEETING – 10:00 A.M. I. CALL TO ORDER – The meeting was called to order at 10:00 a.m.

III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF OCTOBER 26, 2023 Action: Approved
IV. PUBLIC HEARING ITEMS ITEM NO. 2 Harmon Residence Coastal Development Permit (PA2022-130) Site Location: 3405 and 3405 ½ Seashore Drive Council District 1
Liz Westmoreland, Senior Planner, provided a brief project description stating that the applicant is requesting a coastal development permit to allow the demolition of an existing two-unit dwelling and the construction of a
new two-unit dwelling, specifically a single-unit dwelling and junior accessory dwelling unit. The project is located within the VE Flood Zone, which requires properties to raise their finished floors approximately 3 to 5
feet above the ground. Ms. Westmoreland provided additional background information regarding the flood zone and an analysis regarding public views and sea level rise. Senior Planner Westmoreland also clarified that the
flood zone requirements are Federal standards that the City is required to comply with.
The owner, Tom Harmon, stated that he has reviewed the draft resolution and agrees with all the required conditions.
Zoning Administrator Zdeba opened the public hearing.
One member of the public, Jim Mosher, spoke and stated that there is a potential typo in the staff report that
references Title 21 instead of Title 20 of the Municipal Code. He commented that the staff report did not include plans and it was unclear how close the balconies are from the boardwalk. Lastly, Mr. Mosher asked if the junior
accessory dwelling unit includes a separate entrance. Zoning Administrator Zdeba closed the public hearing.
Senior Planner Westmoreland stated that there was a typo in the staff report as mentioned by Mr. Mosher. The plans were not available online due to copyright laws, but she clarified that the plans are available for viewing
in person. Senior Planner Westmoreland clarified the required setbacks for balconies, and that the project complies with all current setback requirements and does not require any variances. The junior accessory dwelling unit does include independent access with secondary access inside the single-unit dwelling. Action: Approved

ITEM NO. 3 Mariman Residence Coastal Development Permit (PA2023-0118) Site Location: 54 Linda Isle Council District 5
Jenny Tran, Assistant Planner, provided a brief project description stating that the applicant is requesting a coastal development permit to allow the demolition of an existing single-unit dwelling and construction of a new 3,991 square-foot two-story single-unit dwelling and an attached 712 square-foot two-car garage. The project includes raising the bulkhead.
Assistant Planner Tran provided information about the property as well as details about Linda Isle. A Bulkhead Conditions Report was prepared for the project and clarification was provided regarding the guardrails around the existing cantilevered deck that were not shown on the plans. Assistant Planner Tran also recommended an additional condition of approval to require fences, hedges, walls, and guardrails within setbacks to comply
with the Newport Beach Municipal Code.
Applicant Scott Laidlaw of Laidlaw Schultz Architects, on behalf of the owner, stated that he had reviewed the draft resolution and agrees with all the required conditions including the additional condition of approval. Zoning Administrator Zdeba asked for clarification on details shown in the plans and added that if any work is
proposed for the cantilevered deck, the applicant must submit for review by the Planning Division and the work may require approval from the California Coastal Commission.
Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment,
the public hearing was closed. Action: Approved as amended
ITEM NO. 4 Lewis Residence Coastal Development Permit (PA2023-0151) Site Location: 212 Tremont Drive Council District 4
Jerry Arregui, Planning Technician, provided a brief project description stating that the applicant is requesting a coastal development permit to allow the removal of an existing single-story, single-unit manufactured home
and accessory structures, and the installation of a new single story, single-unit manufactured home in compliance with state law. The development also includes a driveway, patio, walkways, and entry stairs. The
development complies with all applicable Newport Beach Municipal Code Standards and no deviations are requested.
Applicant Steve Almquist of Coastline Construction on behalf of the owner, stated that he had reviewed the
draft resolution and agrees with all the required conditions.
Zoning Administrator Zdeba opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed.
Action: Approved V. PUBLIC COMMENTS ON NON-AGENDA ITEMS
One member of the public, Jim Mosher questioned if the City sends a permit document listing all the Conditions of Approval for the project to the applicant to sign once a coastal development permit has been approved. Zoning Administrator Zdeba answered Mr. Mosher’s question by explaining that the City does not have a
permit document for the applicant to sign, but the final resolution is signed by the Zoning Administrator and then after distributed to the applicant of the project.

VI. ADJOURNMENT
The hearing was adjourned at 10:24 a.m. The agenda for the Zoning Administrator Hearing was posted on November 8, 2023, at 11:20 a.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on November 8, 2023, at 11:07 a.m.
