TITLE: Approval of Amendment No. 1 to the Services Agreement for Public
Safety Helicopter Services Between the City of Huntington Beach
and the City of Newport Beach
ABSTRACT:
The City of Newport Beach contracts with the City of Huntington Beach for public safety
helicopter services to support police, fire and marine safety operations. The current
agreement ends on December 31, 2023, and the Police Department is requesting City
Council approval for a six-month extension of the contract (Amendment No. 1) in an
amount not to exceed $225,000.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Approve Amendment No. 1 to the services agreement for public safety helicopter
services between the City of Huntington Beach and the City of Newport Beach in an
amount not -to -exceed $225,000 and authorize the Mayor and City Clerk to execute
the Amendment.
DISCUSSION:
Since September 2011, the City of Newport Beach has contracted with the City of
Huntington Beach for public safety helicopter service. Due to the critical nature of this
service, the Police Department seeks City Council approval of a six-month extension of
the agreement term to better coincide with the ending date of Huntington Beach's
contracts for public safety helicopter services with the cities of Irvine and Costa Mesa.
The proposed amendment (Attachment A) maintains all other terms and conditions of the
original agreement. The current hourly rate is billed at $840 per hour. The proposed
amendment has a not -to -exceed budgeted amount of $225,000 and it would allow for
approximately 1.5 hours of exclusive flight time per day, if necessary.

FISCAL IMPACT:
The adopted budget includes sufficient funding for the amendment. Funds are only
expended when the services are utilized. It will be expensed to the Contractual Services
- Helicopter account in the Police Department Patrol Division, 01035353-811025.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

AMENDMENT NO. 1 TO SERVICES AGREEMENT FOR
PUBLIC SAFETY HELICOPTER SUPPORT
BETWEEN
THE CITY OF HUNTINGTON BEACH AND
THE CITY OF NEWPORT BEACH
THIS AMENDMENT is made and entered into by and between the CITY OF
HUNTINGTON BEACH, a California municipal corporation, hereinafter referred to as
"Huntington Beach," and the CITY OF NEWPORT BEACH, a California municipal
corporation, hereinafter referred to as "Newport Beach."
WHEREAS, Huntington Beach and Newport Beach are parties to that certain
agreement, dated September 15, 2020, entitled "Services Agreement for Public Safety
Helicopter Support Between the City of Huntington Beach and the City of Newport
Beach" which agreement shall hereinafter be referred to as the "Original Agreement";
WHEREAS, the Original Agreement is set to expire December 31, 2023; and
WHEREAS, Huntington Beach and Newport Beach wish to amend the Original
Agreement to extend the term.
NOW, THEREFORE, it is agreed by Huntington Beach and Newport Beach as
follows:
1. TERM
The term of the Agreement is extended for an additional six (6) months until
June 30, 2024.
2. REAFFIRMATION
Except as specifically modified herein, all other terms and conditions for the
Original Agreement shall remain in full force and effect.

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be
executed by and through their authorized officers on 12023.
