Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED Tom Sandefur, Assistant City Engineer - 949-644-3321, tandefur@newportbeachca.gov TITLE: OASIS Senior Center Site Lighting Project — Award of Contract No. 9009-2 (23F02) ABSTRACT: The City of Newport Beach received construction bids for the OASIS Senior Center Site Lighting project and requests City Council approval to award the construction contract to SacTown Contractors Corporation of Sacramento. This project updates the existing light fixtures in the fitness room, dance room, art center, and seven classrooms at the OASIS Senior Center to new energy efficient Light Emitting Diode (LED) light fixtures that comply with California Assembly Bill 2208 (AB 2208). RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(a), Class 1 (Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances) of the CEQA Guidelines, because this project has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Relieve Innovative Engineering Systems, dba Agilitech of its bid due to a clerical error; d) Award Contract No. 9009-2 to SacTown Contractors Corporation for the total bid price of $365,795 for the OASIS Senior Center Site Lighting project, and authorize the Mayor and City Clerk to execute the contract; and e) Establish a contingency of $54,205 (approximately 15% of total bid) to cover the cost of unforeseen work not included in the original contract. DISCUSSION: The existing compact fluorescent light fixtures at the OASIS Senior Center are nearing the end of their service life, provide inadequate lighting in certain locations, and require replacement to LED fixtures to comply with California Assembly Bill 2208. AB 2208 prohibits the purchase and sale of fluorescent lighting fixtures and went into effect on January 1, 2024. 9-1 OASIS Senior Center Site Lighting Project — Award of Contract No. 9009-2 (23F02) February 13, 2024 Page 2 The new, more energy efficient LED fixtures and lighting control system will comply with AB 2208, improve lighting conditions, and have an expected longer service life than the existing light fixtures have had at the Senior Center. At 2 p.m. on January 4, 2024, the City Clerk opened and read the following bids for this project: BIDDER TOTAL BID AMOUNT Low Innovate Engineering Systems Inc., dba A ilitech* $ 273,569* 2nd SacTown Contractors Corporation $ 365,795 3rd Seniors & Juniors $ 383,800 4th AMTEK Construction $ 619,333 5th At Your Service Construction & Energy $ 974,000 6th American Wholesale Lighting $ 999,375 *Non -responsive Bid The City of Newport Beach received six bids for this project. The apparent low bidder, Innovative Engineering Systems Inc., dba Agilitech, was deemed non -responsive since the contractor did not submit the necessary bid documents as required and submitted a letter requesting withdrawal of its bid due to clerical errors (Attachment B). Staff recommends accepting the request and awarding to the second lowest bidder, SacTown Contractors Corporation, which possesses a California State Contractor's License Classification "B" and "C-10", as required by the project specifications. A review of references for SacTown Contractors Corporation shows satisfactory completion of similar contracts for school districts and other public agencies. SacTown's bid came in at approximately 8% below the Engineer's Estimate of $395,300. Pursuant to the contract specifications, the contractor will have 40 consecutive working days to complete the project. Work is scheduled to begin in spring 2024. The project plans and specifications will be available for review at the February 13, 2024 City Council meeting or upon request. FISCAL IMPACT: The adopted budget includes sufficient funding for this contract. It will be expensed to the Facilities Maintenance Master Plan (General Funds) accounts in the Public Works Department, 57101-980000-23F02. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(a), Class 1 (restoration or rehabilitation of deteriorated facilities involving negligible or no expansion of existing use) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
