Any development located between the near- est public road and the sea is in conformity with the public access and public recreation policies of Chapter 3. Additional reasons for this determination, and for any special conditions, may be discussed on the reverse (Page 2). NOTE: The Commission's Regulations provide that this permit shall be reported to the Commission at its next meeting. If one-third or more of the appointed membership of the Commission so request, a permit will not be issued for this permit application. Instead, the application will be removed from the admin- istrative calendar and set for public hearing at a subsequent Commission meet - Ling. Our office will notify you if such removal occurs. Additionally 312 square feet of existing space will be enclosed and used for storage. There will be no changes to the second floor residential use. The City of Newport Beach granted an amendment to the project use permit which limits the commercial floor area to 500 square feet to allow the storage area. Additional conditions restrict the use of the shop to the preparation of ice cream and related products and prohibits any cooking. The project is located approximately 20.O.'feet from the beach in an area of beach related vistor-serving commercial uses. Existing on -site parking consists of two C2)_ residential parking spaces and two C21 retail employee parking spaces. The Executive Director finds that the proposed project does not represent an intensification of use that will result in an increased parking demand for the area since it can be assumed that the patrons would be beach.goers, would walk to the proposed ice cream shop. Dedicated accessway shall not be required to be opened to public use until a public agency or private association agrees to accept responsibility for maintenance and liability of the accessway. Public vertical access to the Rialto Channel is by way of the street ends in the area. The project is located 60 ft. from the end of Finley Street (see Exhibit 1). The Executive Director determines that adequate vertical access exists in the area. The project is located in an area where public lateral access is impeded along the sandy beach seaward of the Rialto bulkhead by private boat docks adjacent to the bulkhead. The ramps leading from the residences to these docks present physical barriers to lateral access along the narrow sandy beach. 5-83-182 It should be noted further that the sandy beach along the Rialto is of varying widths which at times is so narrow so -as -to present minimal capacity and usability. Nevertheless, if the public were not limited by the numerous physical -barriers the limited sandy , beach area may be usable. The Executive`birector'therefore determines that a lateral access easement dedication. -is not feasible and, therefore, that the proposed project is consistent with the access policies of.Chapter 3_of.the Coastal Act. The Executive Director further determines that the.;project is not inconsistent with the certified Land Use Plan and will -not prejudice the ability of the City of Newport Beach to prepare implementing ordinances consistent with -and adequate to .carry out.that certified Land Use --Plan. The application is to demolish an existing storage garage an to construct a 5,887 sq. ft. 3-story building with 7 office condominiums, 2 residential condominiums and 14 car garage. The project includes the garage and 2 office condominiums on the first floor, 5 office condominiums and portions of two residential condominiums on the second floor and the remaining portion of 2 residential units on the third floor. B. Local Coastal Pro,ram Consistent . The City of Newport Beach Land use an P was certi ie on May 19, 1982 by the Commission. According to the cerfitied LUP, land use designation for the project site is "Recreational and Marine Commercial". The site is not located along a waterfront. The certified LUP states: u- On o^-wat=ztrort lots, t1-e-, requiremnt to provide incentive uses conjunction with certain specified uses shall not apply. Retail scecial.ty shops shall be permitted. Residential uses shall be permitted on t.e second level or above where the ground floor is occupied by a permitted use, subject to re•:io:: and apprc al of a Use Permit. " The City has approved the Use Permit. The Commission finds that the project is consistent with the land use designation of the Certified LUP and shall not prejudice the City's ability to prepare implement- ation ordinances consistent with and to carry out the certified LUP. C. Land Uses. Section 30255 of the Coastal Act states: Section 30255. Coastal --dependent developments shall have priority over other developments on or near the shoreline. Except as provided elsewhere in this division, coastal -dependent developments shall not be sited in a wetland. When appropriate, coastal -related developments should be accommodated within reasonable proximity to the coastal - dependent uses they support. In the vicinity of the beaches and bays, coastal -dependent use are perfered and the Commission is concerned about locating general offices in such areas. The project is approximately three blocks from the beach and approximately two blocks from the West Lido Channel; and the present trend in the vicinity is consistent with the proposed project. Because of the location, the Commission finds that the project is consistent with Section 30255 of the Coastal Act. D. Public Access.
