Pursuant to Government Code Section 57200, this Certificate is issued by the Executive Officer of the Local
Agency Formation Commission of Orange County, California.
1. The short-term designation, as determined by LAFCO, is:
East Santa Ana Heights Annexation to the City of Newport Beach — Area 8 (CA 01-07)
2. The name of each district or city involved in this change of organization or reorganization and the
kind or type of change of organization ordered for each city or district are as follows:

3. The above listed cities and/or districts are located within the following county(ies): Orange
4. A description of the boundaries of the above cited change of organization or reorganization is shown
on the attached legal description and map, marked Exhibit A and B, and by this reference
incorporated herein.
5. The territory is inhabited:
6. This change of organization has been approved subject to the following terms and conditions:
a) Payment by the applicant of the Recorder and State Board of Equalization fees.
.b) The City shall accept and adopt the County's Master Plan of Drainage (WD) in effect
within the annexation territory. Any deviation from the MPD shall be submitted to the
Orange County Flood Control District (OCFCD) for review of conformity with the
General Plans of the OCFCD and County of Orange.

c) Upon annexation of the territory, the city shall be responsible for the administration of
floodplain zoning and Federal Emergency Management Agency (FEMA) floodplain
regulations within their City's annexation area.
d) Upon annexation, the city shall coordinate development adjacent to any existing flood
control facilities, which OCFCD has a recorded flood control easement or owns fee
interest, by submitting plans and specifications to the Director of Public Works, County
of Orange Public Facilities and Resources Department, for review, to ensure necessary
flood control right-of-way and improvements are provided for OCFCD facilities, and to
ensure that improvements comply with standards and engineering criteria of OCFCD.
e) Upon the effective date of annexation, the annexing City shall assume ownership and
maintenance responsibilities for all County drainage devices, storm drain channels, and
appurtenant facilities, site drainage, and all master plan storm drain facilities that are
presently operated and maintained by the County of Orange. OCFCD owned and
operated facilities for which OCFCD has fee title or an easement for flood control (not
floodplain) purposes will continue to be maintained by OCFCD.
f) Upon annexation of the territory to the city, all right, title and interest of the County,
including underlying fee title where owned by the County in any and all public roads,
adjacent slopes, sidewalks, tiails,'landscapedareas; medians,-open'spac8, streetlights,
traffic signals, storm drains and bridges shall vest in the City, except for those properties
to be retained by the County specifically listed by these conditions except as otherwise
agreed to by the City and the County.
g) The city shall agree to the continuance of the Acoustical Insulation Program
implementation in the applicable areas of the western portion Santa Ana Heights (Area
7).
h) The applicant agrees to defend, hold harmless and indemnify LAFCO and/or its agents,
officers and employees from any claim, action or proceeding against LAFCO and/or its
agents, officers and employees to attach, set aside, void or annul approval of LAFCO
concerning this proposal or any action relating to or arising out of such approval.
i) The effective date of the annexation shall be July 1, 2003.
7. The resolution (No. CA 01-07P) ordering this change of organization with notice and hearing was
adopted on December 2, 2002 by the Local Agency Formation Commission. (Attached)

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF ORANGE COUNTY, CALIFORNIA
MAKING DETERMINATIONS AND ORDERING THE
EAST SANTA ANA HEIGHTS ANNEXATION TO THE
CITY OF NEWPORT BEACH — AREA 8
December 2, 2002
Pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000,
Division 3 of Title 5 of the California Government Code, the following Resolution was adopted:
WHEREAS, pursuant to Government Code Section 57000(c), the Local Agency Formation
Commission of Orange County has delegated the authority and functions for protest proceedings to
the Executive Officer and directed the Executive Officer to conduct protest proceedings for the "'East
Santa Ana Heights Annexation to the City of Newport Beach — Area 8" (CA. 01-07) with notice and
hearing in compliance with LAFCO Resolution CA 01-07 and Government Code Section 57000 et
seq.; and
WHEREAS, the proposed annexation, designated as "East Santa Ana Heights Annexation to
the City of Newport Beach — Area 8" (CA 01-07), was considered by the Local Agency Formation
Commission of Orange County and approved by LAFCO Resolution CA 01-07 on September 16,
2002;and
WHEREAS, notice of this proceeding was provided in accordance with Government Code
Section 57025;and
WHEREAS, the annexation site consists, of approximately 200 acres of unincorporated
territory known as East Santa Ana Heights generally located adjacent to the City of Newport Beach,
and as described in Exhibits A and B; and
WHEREAS, the reasons for the change of organization are as set forth in the application on
file with the Local Agency Formation Commission; and

WHEREAS, in accordance with Government Code Section 57000 et seq., a period of protest
was established by the'Commission in which registered voters residing in the East Santa Ana Heights
annexation territory and landowners owning property within the East Santa Ana Heights annexation
territory may protest the Commission's approval of the East Santa Ana Heights Annexation to the
City of Newport Beach by submitting written protests to the LAFCO Executive Officer; and
WHEREAS, in accordance with Government Code. Section 57050 et seq. a period of protest
was legally noticed to begin on October 17, 2002 and conclude at the close of the Protest Hearing held
on December 2, 2002, and
WHEREAS, a legally noticed Protest Hearing was held on December.2, 2002 in which
written protests were collected by the Executive Officer; and
WHEREAS, the number of valid registered voter protests submitted represented less than 25
percent of the total number of registered voters within the annexation territory; and
WHEREAS, in accordance with Government Code Section 57075 et seq, the Commission is
required to order the change of organization without an election if written protests are filed by less
than 25 percent of the registered voters; and
WHEREAS, the regular County assessment roll will be utilized; and
WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness
of any agency whose boundaries are changed; and
WHEREAS, the terms and conditions as imposed by the Orange County Local Agency Formation
Commission are as follows:
a) Payment by the applicant of the Recorder and State Board of Equalization fees.

Formation Commission of Orange County does hereby find and determine as follows:

2. The Orange County Local Agency Formation Commission delegated the authority and
functions for protest proceedings to the Executive Officer pursuant to Government Code Section
57000(c) and directed the Executive Officer to conduct proceedings for the "East Santa Ana Heights
Annexation to the City of Newport Beach — Area 8" (CA 01-07) with notice and hearing in
compliance with LAFCO Resolution CA 01-07 and Government Code Section 57000 et seq.;

than 25 percent of the total number of registered voters residing within the East Santa Ana Heights
annexation territory;
BE IT FURTHER RESOLVED that, acting as the conducting authority pursuant to the
Cortese -Knox -Hertzberg Act and pursuant to direction from the Orange County Local Agency
Formation Commission, the Executive Officer does hereby order the "East Santa Ana Heights
Annexation to the City of Newport Beach — Area 8" (CA 01-07) without an election.

This change of organization has been approved,subject to the following terms and conditions:
a) Payment by the applicant of the Recorder and State Board of Equalization fees.
,b) The City shall accept and adopt the County's Master Plan of Drainage (MPD) in effect
within the annexation territory. Any deviation from the MPD shall be submitted to the
Orange County Flood Control District (OCFCD) for review of conformitywith the
General Plans of the OCFCD and County of Orange.

c) Upon annexation of the territory, the city shall be responsible for the administration of
floodplain zoning and Federal Emergency Management Agency (FEMA) floodplain
regulations within their City's annexation area.
d) Upon annexation, the city shall coordinate development adjacent -to any existing flood
control facilities, which OCFCD has a recorded flood control easement or owns fee
interest, by submitting plans and specifications to the Director of Public Works, County
of Orange Public Facilities and Resources Department, for review, to ensure necessary
flood control right-of-way and improvements are provided for OCFCD facilities, and to
ensure that improvements comply with standards and engineering criteria of OCFCD.
e) Upon the effective date of annexation, the annexing City shall assume ownership and
maintenance responsibilities for all County drainage devices, storm drain channels, and
appurtenant facilities, site drainage, and all master plan storm drain facilities that are
presently operated and maintained by the County of Orange. OCFCD owned and
operated facilities for which OCFCD has fee title or an easement for flood control (not
floodplain) purposes will continue to be maintained by OCFCD.
f} Upon annexation ale territory to the city, all right, title and interest of the County,
including underlying fee title where owned by the County in any and all public roads,
adjacent slopes, sidewalks, trails, landscaped areas, medians,-op(in space, streef lights,
traffic signals, storm drains and bridges shall vest in the City, except for those properties
to be retained by the County specifically listed by these conditions except as otherwise
agreed to by the City and the County.
g) The city shall agree to the continuance of the Acoustical Insulation Program
implementation in the applicable areas of the western portion Santa Ana Heights (Area
7).

agents, officers and employees to attach, set aside, void or annul approval of LAFCO

MAKING DETERMINATIONS AND ORDERING THE
EAST SANTA ANA HEIGHTS ANNEXATION TO THE
CITY OF NEWPORT BEACH — AREA 8
December 212002
Pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000,
Division 3 of Title 5 of the California Government Code, the following Resolution was adopted:
WHEREAS, pursuant to Government Code Section 57000(c), the Local Agency Formation
Commission of Orange County has delegated the authority and functions for protest proceedings to
the Executive Officer and directed the Executive Officer to conduct protest proceedings for the"East
Santa Ana Heights Annexation to the City of Newport Beach — Area 8" (CA 01-07) with notice and
hearing in compliance with LAFCO Resolution CA 01-07 and Government Code Section 57000 et
seq.; and
WHEREAS, the proposed annexation, designated as "East Santa Ana Heights Annexation to
the City of Newport Beach — Area 8" (CA 01-07), was considered by the Local Agency Formation
Commission of Orange County and approved by LAFCO Resolution CA 01-07 on September 16,
2002;and
WHEREAS, notice of this proceeding was provided in accordance with Government Code
Section 57025;and
WHEREAS, the annexation site consists of approximately 200 acres of unincorporated
territory known as East Santa Ana Heights generally located adjacent to the City of Newport Beach,
and as described in Exhibits A and B; and
WHEREAS, the reasons for the change of organization are as set forth in the application on
file with the Local Agency Formation Commission; and

WHEREAS, in accordance with Government Code Section 57000 et seq., a period of protest
was established by the'Commission in which registered voters residing in the East Santa Ana Heights
annexation territory and landowners owning property within the East Santa Ana Heights annexation
territory may protest the Commission's approval of the East Santa Ana Heights Annexation to the
City of Newport Beach by submitting written protests to the LAFCO Executive Officer, and
WHEREAS, in accordance with Government Code. Section 57050 et seq. a period of protest
was legally noticed to begin on October 17, 2002 and conclude at the close of the Protest Hearing held
on December 2, 2002, and
WHEREAS, a legally noticed Protest Hearing was held on December. 2, 2002 in which
written protests were collected by the Executive Officer; and
WHEREAS, the number of valid registered voter protests submitted represented less than 25
percent of the total number of registered voters within the annexation territory; and
WHEREAS, in accordance with Government Code Section 57075 et seq, the Commission is
required to order the change of organization without an election if written protests are filed by less
than 25 percent of the registered voters; and
WHEREAS, the regular County assessment roll will be utilized; and
WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness
of any agency whose boundaries are changed; and
WHEREAS, the terms and conditions as imposed by the Orange County Local Agency Formation
Commission are as follows.
