When I first started plan check on this use back in January, I had researched the building permits and checked with you regarding the fair share fees. Of course, I can't remember the details of what I found ..... but we did conclude that fair share fees were required. I'll check the records and let you know what I find. The appellant also claims that the building was previously a medical office. Rich asked me to check with you about the following: 1) Was 300 Old Newport building previously a legitimate medical office use? 2) If it was, did they pay their fair share fees then? 3) When was the 300 Old Newport a medical use? If it was before 1984, then there were probably no Fair Share fees paid. The Ordinance did not become effective until then.
