ENVIRONOENTAL IMPACT REPORT Findings: 1. That the environmental document has been prepared in compliance with the California Environmental Quality Act (CEQA), the State EiR Guidelines,.and City Policy. 2. That the contents of the environmental document have been consid- ered in the various decisions on this project. 3. That in order to reduce adverse impacts of the proposed project, all feasible mitigation measures discussed in the environmental document have been incorporated into the proposed project. Specific economic, social or other considerations make infeasible any other potential mitigation measures or alternative to the proposed project. Mitigation Measures: 1. Development of the site shall be subject to a grading permit to be approved by the Building and Planning Departments. 2. That a grading plan, if required, shall include a complete plan for temporary and permanent drainage facilities, to minimize any potential impacts from silt, debris, and other water pollutants. 3. The grading permit shall include, if required, a description of haul routes, access points to the site, watering, and sweeping program designed to minimize impact of haul operations. 4. An erosion, siltation and dust control plan, if required, shall be submitted and be subject to the approval of the Building Department and a copy shall be forwarded to the California Regional Water Quality Control Board, Santa Ana Region. 5. That grading shall be conducted in accordance with plans prepared by a Civil Engineer and based on recommendations of a soil engineer and an engineering geologist subsequent to the comple- tion of a comprehensive soil and geologic investigation of the site. Permanent reproducible copies of the "Approved as Built" grading plans on standard size sheets shall be furnished to the Building Department. 6. A landscape and irrigation plan for the project shall be prepared by a licensed landscape architect. The landscape plan shall integrate and phase the installation of landscaping with the proposed construction schedule. (Prior to the occupancy of any structure, the licensed landscape architect shall certify to the Planning Department that the landscaping has been installed in accordance with the prepared plan). Da Irk 7. The landscape plan shall be subject to the review of the Parks, Beaches and Recreation Department and approval of the Planning Department. 8. The landscape plan shall place heavy emphasis on the use of drought -resistant native vegetation and be irrigated with a system designed to avoid surface runoff and over -watering. 9. Street trees shall be provided along the public streets as required by the Public Works Department and the Parks, Beaches and Recreation Department. 10. Landscaping shall be regularly maintained free of weeds and debris. All vegetation shall be regularly trimmed and kept in a healthy condition. 11. That any roof top or other mechanical equipment shall be sound attenuated in such a manner as to achieve a maximum sound level of 55 Dba at the property line. 12. All structures should be sound attenuated against the combined input of all present and projected noise to meet the following interior noise criteria: Typical Use Leq (h) Private office, board room, conference room, etc. 45 General office, reception, clerical, etc. 50 Bank lobby, retail store, restaurant, typing pool, etc. 55 13. The following disclosure statement of the City of Newport Beach's policy regarding the John Wayne Airport shall be included in all leases or subleases for space in the project and shall be inc- luded in any Covenants, Conditions, and Restrictions which may be recorded against any undeveloped site. DISCLOSURE STATEMENT The lessee, his heirs, successors and assigns, herein, acknowledge that: a) The John Wayne Airport will not be able to provide adequate air service for business establishments which rely on such service; b) The City of Newport Beach will continue to oppose additional commercial area service expansions at the John Wayne Airport; -2- 1(0 c) Lessee, his heirs, successors and assigns, will not actively oppose any action taken by the City of Newport Beach to limit jet air service at the John Wayne Airport. 14. That prior to the issuance of building permits, the Fire Depart- ment shall review the proposed plans and may require automatic fire sprinkler protection. 15. That all buildings on the project site shall be equipped with fire suppression systems approved by the Fire Department. 16. That all access to the buildings be approved by the Fire Depart- ment. 17. That all on -site fire protection (hydrants and Fire Department connections) shall be approved by the Fire and Public Works Departments. 18. That fire vehicle access, including the proposed planter islands, shall be approved by the Fire Department. 19. Upon completion of construction, the applicant shall provide for weekly vacuum sweeping of all paved parking areas and drives. A weekly cleanup program around the docks and public walks shall be conducted on a regular basis. 20. The project shall be designed to conform to Title 24, Paragraph 6, Division T-20, Chapter 2, Sub -chapter 4 of the California Administrative Code dealing with energy requirements. 21. Prior to occupancy of any building, the applicants shall provide written verification from the Orange County Sanitation District that adequate sewer capacity is available to serve the project. 22. Final design of the project shall provide for the incorporation of water -saving devices for project lavatories and other water - using facilities. 23. Where feasible, reclaimed water should be utilized for non - contact purposes such as irrigation. 24. Efficient irrigation systems which minimize runoff and evapor- ation should be installed. Irrigation should be automatically timed during early morning hours to minimize waste and evapor- ation. 25. The project shall construct any additional on -site water distri- bution facilities required by the new development. 26. Trash compactors shall be utilized to the extent feasible to provide more effective trash disposal. CML �U* F.1] 27. Pedestrian walkways (handicapped accessible) shall be provided from the proposed project to to MacArthur Boulevard for conven- ient access to bus facilities. 28. Prior to the issuance of the Building Permit, the applicant shall submit to the Planning Department a cpmprehensive Transportation Demand Management Program. The applicant shall enter into an agreement with the City, the form and content of which shall be approved by the Planning Director and the City Attorney, which commits the applicant to implement the TDM program and otherwise comply with this condition. The TDM program shall be made a part of all tenant leases in the building. All tenant leases shall provide that a failure to implement the TDM Program shall be a material breach of the lease, with the applicant having the right to obtain a court order compelling compliance. The provisions of the lease relevant to the TDM program shall be approved by the City Attorney. The Applicant shall use its best efforts, and all available legal remedies, to insure compliance with the provi- sions of the lease that relate to the TDM Program. The Transportation Demand Management Program shall, at a minimum, include the following: 1. A program coordinator which shall be an employee of the property owner. The program coordinator shall have the specific assignment of developing, coordinating and over- seeing the program. Each tenant with 50 or more on -site employees shall designate one management employee to serve as a contact for the tenants and employees and program coordinator. b) A goal to reduce, by 25% or more, the a.m. and p.m. peak hour trip generation rates, the reduction to be based upon a comparison with standard City rates. I c) METHODS: The TDM program shall identify, at a minimum, the following methods for reducing peak hour trip generation rates, and each lease for each tenant shall obligate the tenant to use one or more of the following methods in implementing the TDM Program: a. Flex -time: May consist of assigned staggered hours or may allow employees to select their own hours if acceptable to the tenant's needs and results in desired trip reductions. Flex -time also includes four day or other alternate work weeks. b. Public Transportation: Each tenant shall be required to participate in the Orange County Transit District ridesharing computer match program. Public Transit route information shall be made available in the lobby of the building or any other accessible public place. Each tenant shall make subsidized transit passes available to all employees. IM C. Carpooling: This method utilizes vehicles already owned by employees for ridesharing. A variety of incentives may be used to promote carpooling, including preferential parking and periodic prize drawings limited to participants. The project shall be required to provide structure parking to carpools at no charge. d. Vanpooling: This method is similar to carpooling except that it usually includes the purchase of a large, comfortable vehicle. This method can be suppor- ted with information on vehicle acquisition and fin- ancing, and may include financial assistance or the provision of vehicles. 4. EVALUATION: A report shall be submitted to the City every six months for the first two years and annually thereafter. The report shall discuss the various methods in use and participation levels. It shall also include traffic counts entering and leaving the site for each fifteen minute period during the peak two and one-half hour period for morning and evening. (Counts are to be taken on a representative day during midweek and are subject to verification by City staff.) The report shall also discuss the extent to which the TDM Program has achieved the desired 25% reduction in a.m, and p.m. peak hour trip rates and, if the desired reduction has not been achieved, an assessment of the additional measures necessary to accomplish the goal. The City shall have the right to require the applicant, or the appli- cant's successor -in -interest, to modify the TDM Program, establishing a level of participation of tenants in each method of the program, in the event a 25% reduction in peak hour trip generation has not been achieved during any reporting period. All tenant leases shall contain a provision authorizing the property owner to require additional participation by each tenant in the TDM Program." B. TRAFFIC STUDY: Findings: 1. That a Traffic Study has been prepared which analyzes the impact of the proposed project on the circulation system in accordance with Chapter 15.40 of the Newport Beach Municipal Code and City Policy S-1. 2. That the Traffic Study indicates that the project -generated traffic will be greater than one percent of the existing morning or afternoon 2.5 hour peak period on a leg of fourteen critical intersections, and will add to an unsatisfactory level of traffic service at nine critical intersections, which will have an Intersection Capacity Utilization of greater than .90. -5- 3. That the Traffic Study suggests several circulation system improvements which will improve the level of traffic service to an acceptable level at all critical intersections. 4. That the proposed project, including circulation system improve- ments, will neither cause, nor make worsen unsatisfactory level of traffic service at on any major, primary -modified, or primary street. 5. That all identified intersection improvements shall be made by the applicant, except for the intersection of Campus Drive and Bristol Street North. The time and money necessary to complete the improvement at Campus Drive and Bristol Street North is clearly disproportionate to the size of and traffic generated by the project in that the improvement will require widening of a bridge over the Corona del Mar Freeway. It would be unreasonable for the City to condition the project on completion of this improvement. 6. That the improvement at Campus Drive and Bristol Street North is a part of the improvement program of the County of Orange assoc- iated with John Wayne -Orange County Airport, and is anticipated to commence construction in three years. The County of Orange is currently conducting necessary studies and design work, along with cost estimates for this improvement. The improvement is consistent with the Newport Beach General Plan. 7. That the project will be required to pay a fee to fund construc- tion of the improvement at Campus Drive and Bristol Street North and that the fee will be proportionate to the ratio of project generated traffic at this location, as determined by the City Traffic Engineer. This fee is in addition to any other fees, contributions or conditions imposed on the project. 8. That the project's contribution towards construction of major improvements substantially outweighs the project's temporary impact on the unimproved intersection. Conditions: 1. That prior to the occupancy of the project, the circulation system improvements identified in the Traffic Study, dated August 20, 1986 (Pages 28-30), except at the intersection of Campus Drive and Bristol Street North, shall have been constructed (unless subsequent project approval requires modification there- to). The circulation system improvements shall be subject to the approval of the City Traffic Engineer. 2. That a contribution to the improvement at the intersection at Campus Drive and Bristol Street North proportionate to the ratio of project generated traffic at this intersection as determined by the City Traffic Engineer will be made by the applicant -pursuant to section 15.40.030 A.,i(c) of the Newport Beach Munic- ipal Code. C. AMENDMENT NO. 638: Recommend to the City Council approval of Amendment No. 638, with the following revisions: 1. Page 5, Section II.B. revise to read "*Site 5.... 241,570 sq.ft. (16)(19)(20)" *If commercial uses are constructed which are ancillary to and in the same building as office uses, addition development up to a maximum of 294,600 sq.ft. may be developed, so long as the office use does not exceed 241,570 sq.ft. 2. The proposed modification for compact parking will not, under the circumstances of this particular case, be detrimental to the health, safety, peace, comfort, and general welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City and further that the proposed modification is consistent with the legislative intent of Title 20 of this Code. Conditions: 1. That all improvements be constructed as required by ordinance and the Public Works Department. 2. That a standard agreement and accompanying surety be provided in order to guarantee a satisfactory completion of the public improvements if it is desired to obtain a building permit prior to completion of the public improvements. -7- 3. That the on -site parking (including signing of compact and handicap spaces), vehicular circulation and pedestrian circu- lation systems be subject to further review by the Traffic Engineer. 4. That the intersection of streets and drives be designed to provide sight distance for a speed of 35 miles per hour. Slopes, landscaping, walls and other obstruction shall be considered in the sight distance requirements. Landscaping within the sight distance line shall not exceed twenty-four inches in height. The sight distance requirements may be approximately modified at non -critical locations, subject to approval of the Traffic Engineer. 5. That an easement be provided between parcels within the develop- ment for ingress/egress and parking. 6. That all vehicular access rights to MacArthur Boulevard be released and relinquished to the City of Newport Beach. 7. That all unused drive aprons be removed and replaced with curb, gutter and sidewalk along the Newport Place and Dove Street frontages under an encroachment permit issued by the Public Works Department. Dear Mr. Bradley: At your request we visited the above referenced office building on two separate days, 15 December 1989 and 9 January 1990. The purpose of these visits was to measure outdoor noise generated by the building equipment as would be received at the property line and to measure the received noise levels at the building interior from intrusive outdoor sounds. Based on our indoor and outdoor noise measurements, the building is in compliance with the City of Newport Beach criteria limiting property line noise levels generated by the roof top mechanical equipment to 55 dBA and requiring the interior noise levels to not exceed: 45 dBA Leq(h) for private offices, etc.; 50 dBA Leq(h) for general offices, etc..; and, 55 dBA Leq(h) for bank lobbys, retail stores and restaurants, etc. On 15 December 1989 the rooftop mechanical equipment was turned on manually at Sam and a series of noise measurements was made along the property line boundaries. The equipment was inaudible and the measured community noise level was 52.8 to 53.8 dBA. Therefore, the City of Newport Beach's limit of 55 dBA is not exceeded at the property line. On 9 January 1990 interior noise level measurements were made between 3 and 4 pm on the first, fifth, seventh, and ninth floors of the office building. At the time of measurement, no interior partitions, carpets drapes, ceiling the or furnishings were present to reduce the sound level. It was not possible to shut down the HVAC equipment therefore, the interior noise levels measured were influenced by this equipment. 3187-A Airway Avenue. It is expected that the average hourly rate would not exceed 45 dBA if long term measurements were made. Single event measurements of jet aircraft takeoffs yield SEL's of approximately 63 dB. Based on this level and 120 takeoffs per day the aircraft noise would be 34.4dB Leq(h) over the day. Adding this to the 41.3 dB without aircraft yields 42.1 dBA as an hourly noise level. Noise measurements in the restaurant and retail/bank areas on the first floor yield noise levels ranging between 41.8.and 45.5 dBA Leq(h). Based on the above on -site noise measurements, it is our expectation that, when the finished interiors are added, the noise levels will be in compliance with the City requirments. Scope of the TDM Program The TDM program consists of: o Property Ownership and Lease Requirements o Property Management Practices o Carpool Actions o Vanpool Actions o Transit Actions o Work Scheduling o Site Features TDM Actions at McLachlan -Newport Place 1.0 Property Ownership and Lease Requirements 1.1 -Covenants, Conditions and Restrictions (CC&Rs) CC&Rs will be the vehicle for securing ongoing property owner participation in the TDM program. This legal document will mandate the TDM program for the initial and any successive property owners. CC&Rs will incorporate the TDM-related City conditions of project approval in order that all property owners and their successors are aware of their commitment to the traffic objectives of the project. 1.2 Lease Agreements Tenants should be informed of the Transportation Management Program at the building through their lease agreement. Portions, of the lease pertaining to the TDM program shall be approved by the City Attorney. All leases will: require tenants'to: o Implement the TDM program, with failure to do so being a material breach of the,lease. ' Property management having the right to obtain a court order compelling compliance Transportation Management Services o Provide employee transportation information at initial occupancy o Participate in annual employee transportation surveys o Allow employees to participate in commuter activities o Designate a liaison for commuter transportation related activities o Distribute commuter information to all employees prior to relocation and to new employees upon hiring o Require additional participation in the TDM program should the performance target (i.e., 25% reduction) not be met 1.3 Site Marketing and Leasing Prospective tenants of McLachlan -Newport Place will be made aware of the TDM Program at the time of considering and leasing space. Transportation services will be highlighted as a leasing feature of the complex. 2.0 Property Management Practices 2.1 Transportation Coordinator A Transportation Coordinator will be designated to manage and coordinate all facets of the transportation program at McaLaclan-Newport Place. This individual will have have completed a training program in transportation demand management or have demonstrated experience in the field of managing commuter transportation activities, or The Coordinator will have the responsibility for all operational elements of the Transportation Demand Management program including administering all incentive activities. This includes overseeing monitoring and enforcement activities such as legitimate use of preferential parking, and other measures intended to encourage ridesharing participation. The Transportation Coordinator should be accessible to tenant representatives, employees and property owners. The Transportation Coordinator will be responsible -for the following services: 2 Transportation Management Services o Marketing including promotional campaigns o Monitoring and reporting including annual tenant/employee surveys o Providing ridematching services o Administering incentive programs o Coordination with other businesses in the area and City staff o Reviewing designs for parking and other transportation - related physical improvements o Providing new tenant firms with transportation -related assistance during relocation to the building The Coordinator will provide personalized ridematching servihes including follow-up to each tenant or employee requesting commuter information. Firms or employees who are unsuccessful in finding ' a satisfactory ridesharing arrangement will be offered extra assistance. Examples of such assistance include arranging meetings for prospective ridesharers, and personalized route planning for potential bus riders. The Coordinator should maintain a file of employees who are looking for rides, and thorough attempts should be made on the part of the Coordinator to find a satisfactory commute alternative for each one. 2.2 Ridematching Services Ridematching information will be available to all employees at the McLachlan - Newport Place office complex. Orange County Transit District's Commuter Network ridematching services will be enlisted for this effort. Ridematching services include providing lists of employees living near one another, bus routes and schedules, bike maps, and the phone number of the Transportation Coordinator. This' information should be kept current and updated when needed. The Transportation Coordinator will, at a minimum, distribute ridematching registration forms annually so that all employees are given an opportunity to receive ridematch information. Annual distribution will ensure that employee information is updated at least once a year. Employees should also be able to contact the Coordinator at any time during the work week to register or obtain ridesharing information. 2.3 Marketing and Promotions Semi-annual marketing and promotional efforts will be conducted to inform the .tenant's employees of alternative Transportation Management Services transportation services. The Transportation Coordinator will initiate these efforts which should include use of printed materials (i.e. posters, flyers) and special events (i.e. share -a -ride -day, exhibits, giveaways). The Transportation Coordinator should also organize car/vanpool formation meetings for tenant employees who live near one another so they can meet and make ridesharing arrangements. Displays of commuter information will be set up in areas that are highly visible and well travelled by employees (i.e., the parking structure.) Displayed information will include: bus schedules, ridesharing information, and the Transportation Coordinator's phone number and location. 2.4 Access Guide An "Access Guide to McLachlan -Newport Place" will be produced. This document will travel choices for getting to and from the site and is targeted to tenants and employees. This "Access Guide" will describe the variety of transportation services available, alternate routes to work, best start/stop times to avoid congestion, etc. This guidebook will be distributed to tenants or their employees prior to their relocation to the building. The guide will also be used by the building management in leasing activities, and also by the tenants for distributing to new - hires and visitors. The Access Guide will include the following information: o Transit Services o Streets and freeways serving the site o Parking facilities 0 on -site services o Best/worse commute times 2.5 Relocation Assistance The Transportation Coordinator will provide each tenant with assistance prior to, during and after their move to the project. Services will include pre -move ridematching, personal follow-up to establish ridesharing arrangements prior to the move, assistance with establishing work schedules outside the peak periods, 'and assistance with transportation services after the relocation. A tenant move -in package will be provided with Access Guides for all employees, and other related commuter information (e.g. ridematching forms, bus maps, and the Transportation Coordinator's telephone number). O Transportation Management Services 2.6 Coordination with Area Transportation Actions Potential ridesharing arrangements can be increased by expanding the employee base for ridematching, and increasing the resources available for TDM activities by working in concert with area employers, property owners, and public agency representatives. An association formed of area tenants, employees, property owners and the City could provide these coordinated transportation services. Property ,management at McLachlan -Newport Place, through the designated Transportation Coordinator, will coordinate transportation management activities with other interested employers in the Newport Beach/John Wayne Airport area. 2.7 Mid -Day Services The Transportation Office will provide tenants and employees working at McLachlan -Newport Place with a map and list identifying nearby mid -day services such as financial services, health/ fitness/recreational, personal services (e.g., barber, dry cleaners), food/convenience stores, restaurants, etc. This will provide employees with information on services within walking distance of 'their worksite at McLachlan -Newport Place, and thus reduce the need for use of a personal vehicle during the middle of the day. 2.8 Monitoring, Reporting and Enforcement The Transportation Coordinator will be the point of enforcement for the TDM program. The Transportation Coordinator will have access to sufficient data on employee commuting behavior to be able to prepare periodic reports on the status of the transportation program. The sources of this data will include parking operations, bus pass sales, vanpool administration, tenant/employers, the annual transportation survey, and periodic inspection of the parking - areas. A system will be developed for tracking the number of solo drivers, carpoolers, vanpoolers and bus passengers, bicycle - commuters. This registration process should enable the Coordinator to verify the authenticity of vehicles parked in the carpool areas and to track the participation rate for the transportation program. Annual surveys of employee travel behavior and attitudes, along with the monthly parking and ridesharing records, will provide the data necessary for preparation of reports .on the Transportation Demand Management Program and its impact on peak hour trips and parking demand. 5 Transportation Management Services Counts of vehicles entering and leaving the site for each fifteen minute period during the morning and evening peak hours will be taken on representative midweek days. These counts will be verified by the City of Newport Beach. This information will be taken to determine the number of peak hours trips generated at the site. These counts will determine the actual number of vehicles arriving and departing the facility, and the vehicle occupancy. Status reports will be prepared and made available to the City on an annual basis. A report describing the TDM program and the status of trip generation at the site will be submitted to the City of Newport Beach every six months for the first two years of occupancy commencing on the anniversary of issuance of the Certificate of Occupancy, with reports' being submitted annually thereafter. 3.0 Carpool Incentives 3.1 Preferred Parking Spaces In addition to the ridematching and personal assistance given by the Transportation Coordinator, carpoolers will also be given preferred parking privileges. Carpool parking will be located in areas of that are most convenient to the building entrance and/or easiest exiting location of the parking facility. Up to 10 percent of employee parking spaces will be identified for use by carpools and provided upon demand. 3.2 Reduced Parking Rates Carpoolers who register with the Transportation Coordinator should be offered a reduced parking rate if, and when, parking fees are assessed. Carpools with 2 participants should be given a 25 percent reduction off the established monthly parking fee, and 3 or more person carpools should be given a 50 percent parking subsidy. 3.3 Validated Parking Commuters participating in authorized carpools will be allowed one daily parking validation per month. This incentive will be attractive to commuters who must OCOnminnwlly hr;na their nersonal vehicles to work. Transportation Management Services 4.0 Vanpool Incentives 4.1 Assistance with Group Formation The Transportation Coordinator will identify potential vanpoolers and work with them to form vanpool groups. The Coordinator will assist the group in selecting a vendor of vanpool services to provide the vehicles. The Coordinator will also assist tenant employees who own vans in starting a vanpool group with their own vehicles. 4.2 Parking Privileges Vanpools will be entitled to preferentially located parking similar to carpools. Vanpool parking spaces will be located in the surface lot portion,of the parking facilities and will be -sited in an area that permits easy and safe vehicle movements to accommodate more difficult maneuvering by van - type vehicles. A minimum of 10 parking spaces (1% of employee parking) will be available for vanpool vehicles. If the parking operations include an attendant, valet service can then be offered to vanpoolers. This service would be of benefit to the vanpool driver and to the parking operator since more efficient use could be made of the available parking. Vanpool vehicles will be allowed to park for free in the parking structure. The Coordinator would .authorize vanpool parking passes. 4.3 Vanpool Easy Start During the first 3 months of start up for each 'vanpool group formed at the McLachlan - Newport Place, the cost of any empty seat will be underwritten by property management so that riders will not have to incur any additional cost to initiate the vanpool route. During this start up period, the Coordinator will assist the group in recruiting additional riders. At the end of the three month period, the vanpool group should be financially self-supporting if it is to be successful on a long-term basis. 4.4 Validated Parking Commuters participating in authorized vanpools will be allowed one daily parking validation per month if, and when, parking fees are assessed. This incentive will be attractive to commuters who must occasionally bring -their personal vehicles to work.. r Transportation Management Services 5.0 Transit Incentives 5.1 Trip and Route Planning The Transportation Coordinator will provide trip planning and orientation assistance to tenant employees interested in transit services. Each interested employee will be offered a listing of routes, schedules, stop locations and required fare media for their trip to work. If possible, a list of other employees traveling the same route should be provided. 5.2 Sale of Bus Passes OCTD bus passes will be sold on -site by the complex. The operating hours of the McLachlan - Newport Place and associated parking facilities will be established to allow employees to choose earlier arrival and later departing times. The Transportation Coordinator will work with tenants prior to their relocation to McLachlan - Newport Place to assist them in establishing alternative work hour schedules outside the peak hour (4:30-5:30 PM) for their employees. Working with nearby employers will allow the Transportation Coordinator to encourage tenants at McLachlan -Newport Place to establish work schedules that do not have employees on the road at the same time as their neighbors. 8.0 Site Design Features 8.2 On -Site Health Club The presence of a health club will allow employees to arrive earlier and/or depart later than peak hour traffic on the surrounding street network. n Y � I Transportation Management Services 8.2 Pedestrian Environment Creation of a pleasant workplace environment will complement transportation management efforts by making the complex attractive enough that employees will not be compelled to use their vehicles to leave during the day for lunch or other activities. Creating an attractive environment includes landscaping and providing amenities such as seating or picnic areas. Providing on -site retail and restaurant services should reduce some need for using a vehicle during the day. 8.3 Transportation Information Display Information displays describing the various ways of accessing McLachlan -Newport Place, including public transit and ridesharing, will be located in common areas of the project such as public common spaces, parking structures, or other suitable locations. 8.4 Passenger Pick-Up/Drop-off Zones Waiting areas for carpools and vanpools will be designated by making use of planned pedestrian areas located adjacent to buildings and parking areas. Passenger zones should include pedestrian -type features that make waiting safe, secure and comfortable. In many cases this may be easily accomplished by allowing passengers to wait inside building lobbies. These factors form the basis for developing transportation demand management strategies. 1.0 Site Characteristics 1.1 Project Descrintion (Figure 1) 4100 Newport Place Drive is located in the Newport Place Planned Community in the city of Newport Beach. It is situated between John Wayne Airport (a half mile to the north) and the University of California at Irvine (one and a half miles to the southeast). The site is bordered on the south by Newport Place Drive, a four lane street which terminates at Dove Street; 'and on the north by Dolphin Striker Way, a two lane cul de sac. The project consists of a nine story office building with an adjoining four story parking structure. The parking structure is intended for use by the proposed building as well as the existing Bank of America and Continental Plaza" buildings nearby. A general driveway proposed on Dove Street will provide direct access into the planned parking structure with additional access also being provided from Newport Place Drive and Dolphin Striker Way. 4100 Newport Place Drive will include a restaurant, an athletic club and some commercial uses. This mix of uses should accommodate the needs of 4100 Newport Place Drive tenants and employees as well as those in nearby buildings. There are several restaurants within walking distance of the 4100 Dove Street site along MacArthur Boulevard and Corinthan Way (which parallels Dove Street directly to the northeast). There is no parking along most of the streets in the vicinity " of the site although there is some parking on Dolphin Striker Way. There are several auto dealerships on Dove Street south of Newport Place Drive (between Bristol and Quail Streets) as well as a small shopping center. 2.0 Transportation Environment (Figure 2) The following features of the transportation environment in the vicinity of 4100 Newport Place Drive impact commute travel choices. r J2.1 Freeway and Street System The Newport Place Planned Community is approximately one and a half miles southeast of the interchange of State Routes 55 (the Newport Freeway) and 73 (the Corona del Mar Freeway); two and a half miles south of Interstate 405; and five miles north of State Route 1 (Pacific Coast Highway). I-405 will include a High Occupancy Vehicle (HOV) or commuter lane in the vicinity of the MacArthur Boulevard interchange. Primary access to the site is provided via Campus Drive and Birch Street which parallel each other to the north and east of the site, and via MacArthur Boulevard from the east. Dove Street also provides access off of Bristol. Major north -south arterials provide regional access to the Newport Place Planned Community. These include: Jamboree Road and MacArthur Boulevard which intersect State Routes 1 and 73 as well as Interstate 405; and Bristol Street which extends 1 through the City of Santa Ana and terminates in north and south one-way streets near Newport Place. The closest bus stops to 4100 Newport Place Drive are on Birch Street (near it's intersection with Dove Street) and on MacArthur Boulevard (near it's intersection with Newport Place Drive). The eastbound bus stop on Birch Street is located east of Dove Street and the westbound stop is located west of Dove Street. These stops are served by OCTD Routes 71 and 76/76A. Route 71 goes from Orange to Irvine at hourly intervals and the complete route takes one hour and fifteen minutes from beginning to end. Route 76/76A goes from Irvine to Huntington Beach and runs every thirty minutes with the complete route taking one hour and twenty minutes from beginning to end. There are two bus shelters on either side of MacArthur Boulevard between Newport Place Drive and Birch Street and a closer southbound stop on MacArthur Boulevard south of Newport Place Drive. These stops are served by OCTD Route 61 which goes from Santa Ana to Newport Beach at hourly intervals. The route.takes one hour and ten minutes from beginning to end. 2.3 Rail There is an Amtrak train station located in Santa Ana, approximately 10 miles from Newport Beach. 2.4 Bikeways The City of Newport Beach's Bicycle Master Plan indicates a 'sidewalk bikeway' on the easterly side of MacArthur Boulevard. 2.5 Distribution of Commute Travel Projected traffic distribution for the building found the majority of trir and northwest with only 15% arriving Study 45, Planning Commission Meeting, inferred from the close proximity (to 55 and 73, and their interchanges many of the commute trips are made on 4100 Newport Place Drive ,s arriving from the north from the south. TAA C a Irx✓ 2.6 Business Participation in Transportation Management A survey of businesses located near the John Wayne Airport in 1986 found that five out of every six employers would participate in cooperative efforts to solve traffic problems, while 95 percent viewed a joint public/private effort as the most appropriate means of organizing such an effort. (Urban Land Institute, "Mobility in Suburban Growth Centers Orange County Airport Area Case Study", April 1988). The South Coast Metro Alliance, OCTD, and the cities of Costa Mesa and Santa Ana have established a Transportation Management Association (TMA) in the South Coast Metro Area. This public -private partnership is illustrative of cooperative efforts that can help address congestion problems. Several efforts are underway to explore how business in the airport area can join together in a similar effort. 5 TAA C II. IMPLICATIONS FOR MANAGING TRAVEL DEMAND There are several options available for increasing vehicle occupancies and reducing the vehicle trips of employees working at 4100 Newport Place Drive. The following factors were taken into consideration in developing Transportation Demand Management Actions (Section III). o The parking structure will be shared with the Bank of America and Continental Plaza buildings. If the number of vehicle trips cannot be adequately, mitigated this proximity may offer the opportunity to develop a combined parking management plan that will promote ridesharing for all three buildings. This could be particularly effective in light of the limited number of parking alternatives ('e.g., limited on -street parking). o The provision of recreational facilities, building -serving commercial and restaurant facilities for use by building tenants and those in adjacent worksites could have the dual effect of reducing non -commute tripmaking and enabling employees who might not otherwise be able to rideshare to leave their car at home and use these local facilities. o There are several restaurants within walking distance to the 4100 Newport Place Drive site which, along with an on -site restaurant, will lessen the number of lunch time vehicle trips for building employees. o The development of a Transportation Management Program prior to construction and initial occupancy allows for incorporating the Transportation Management Program in tenant leases. o As occupancy occurs, relocation assistance can be provided by a Transportation Coordinator for future tenants. This type of assistance is usually well received by tenants and has a positive effect on the participation in ridesharing arrangements. o Due to the close proximity of the three freeways which provide access to Newport Place, it is estimated that many of the future employees of 4100 Newport Place Drive will commute by freeway. These commuters will probably have longer commutes than employees who don't use the freeway system and should be targeted for carpooling and vanpooling assistance. The availability of commute lanes on I-405 and SR-55 provide a time incentive for employees to rideshare. 1 1 TAA C o Employee use of transit should be encouraged. Local transit stops and routes which link Santa Ana and other high density Orange County residential areas indicates good potential for employee transit patronage. o Higher levels of congestion experienced during the PM peak period indicates a need for staggering employee departure times. o Employers in the area appear to be very receptive to cooperative transportation management efforts. This suggests the possibility of tenant participation in a transportation management association to combine efforts for a comprehensive transportation program. 7 III. TRANSPORTATION DEMAND MANAGEMENT ACTIONS TDM measures recommended for 4100 Newport Place Drive are designed to achieve a 25 percent reduction in morning and afternoon peak hour vehicle trips as compared to peak hour vehicle trips forecasted for the site as presented in the project's traffic study (Traffic Study, Wes Pringle and Associates, 26 April 1988). This requirement calls for a reduction of 51 AM peak hour vehicle trips from the forecasted 205 new vehicle trips and 68 PM peak hour vehicle trips from the forecasted 270 new vehicle trips. The TDM program consists of actions in the following areas: o Property Ownership, Management and Lease Requirements o Carpool Actions o Vanpool Actions o Transit Actions o Work Scheduling o Site Features 1.0 Property Ownership and Lease Requirements 1.1 Lease Agreements Tenants should be informed of the Transportation Management Program at the building through their lease agreement. Portions of the lease pertaining to the TDM program shall be approved by the City Attorney. All leases or rules governing use of space will describe tenant participation in the TDM Program. Tenant participation includes o Implementing the TDM program, with failure to do so being default of the lease. o Providing transportation information at initial occupancy o Participating in annual employee transportation surveys o Allowing employees to participate in commuter activities o Designating a liaison for transportation related activities o Distributing information to employees prior to relocation and to new employees upon hiring o Participating in building sponsored ridematching services 'AA c i z V k✓ . Leases will inform tenants that they will be notified if, and when, additional tenant TDM measures are needed in the event that participation in the TDM program does not reach the stated performance target (I.e., 25% reduction from the traffic generation forecasted by the City of Newport Beach as provided in the project's traffic study). 1.2 Site Marketing and Leasing Prospective tenants of 4100 Newport Place Drive will be made aware of the TDM Program at the time of considering and leasing space. Transportation services will be highlighted as a leasing feature of the complex. 2.0 Property Management Practices 2.1 Transportation Coordinator A Transportation Coordinator will be designated to manage and coordinate all facets of the transportation program at 4100 Newport Place Drive. This individual will have completed a training program in transportation demand management or have demonstrated experience in the field of managing commuter transportation activities. The Transportation Coordinator shall be certified by the South Coast Air Quality Management District to carryout a Regulation XV Trip Reduction Program. The Coordinator will have the responsibility for all operational elements of the Transportation Demand Management program including administering all incentive activities. This includes overseeing monitoring and enforcement activities such as legitimate use of preferential parking, and other measures intended to encourage ridesharing participation. The Transportation Coordinator should be accessible to tenant representatives and employees. The Transportation Coordinator will be responsible for the following services: o Marketing including promotional campaigns o Monitoring and reporting including tenant/employee surveys o Providing ridematching services o Administering incentive programs o Coordination with businesses in the area and City staff o Reviewing designs for transportation -related features o Providing new tenant firms with transportation -related assistance during relocation to the building I TAA C r r r R✓ The Coordinator will provide personalized ridematching services including follow-up to each tenant or employee requesting commuter information. Firms or employees who are unsuccessful in finding a satisfactory ridesharing arrangement will be offered extra assistance. Examples of such assistance include arranging meetings for prospective ridesharers, and personalized route planning for potential bus riders. The Coordinator should maintain a file of employees who are looking for rides, and thorough attempts should be made on the part of the Coordinator to find a satisfactory commute alternative for each one. 2.2 Ridematching Services Ridematching information will be available to all employees at 4100 Newport Place Drive. Orange County Transit District's Commuter Network ridematching services will be enlisted for this effort. Ridematching services include providing lists of employees living near one another, bus routes and schedules, bike maps, and the phone number of the Transportation Coordinator. This information should be kept current and updated when needed. The Transportation Coordinator will, at a minimum, distribute ridematching registration forms annually so that all employees are given an opportunity to receive ridematch information. Annual distribution will ensure that employee information is updated at least once a year. Employees should also be able to contact the Coordinator at any time during the work week to register or obtain ridesharing information. 2.3 Marketing and Promotions Semi-annual marketing and promotional efforts will be conducted to inform the tenant's employees of alternative transportation services. The Transportation Coordinator will initiate these efforts which should include use of printed materials (i.e. posters, flyers) and special events (i.e. share -a -ride -day, exhibits, giveaways). The Transportation Coordinator will organize car/vanpool formation meetings for tenant employees who live near one another so they can share rides. A display of commuter information will be set up in an area that is highly visible and well travelled by employees (i.e., the parking structure.) Displayed information will include: bus schedules, ridesharing information, and the Transportation Coordinator's phone number and location. 10 TAA C - K I W Mr 2.4 Access Guide An "Access Guide to 4100 Newport Place Drive" will be produced. This document will travel choices for getting to and from the site and is targeted to tenants and employees. This "Access Guide" will describe the variety of transportation services available, alternate routes to work, best start/stop times to avoid congestion, etc. This guidebook will be distributed to tenants or their employees prior to their relocation to the building. The guide will also be used by the building management in leasing activities, and also by the tenants for distributing to new -hires and visitors. The Access Guide will include the following information: o Transit Services o Streets and freeways o Parking facilities o On -site services o Cycling amenities o Best/worse commute times 2.5 Relocation Assistance The Transportation Coordinator will provide each tenant with assistance prior to, during --and after their move to the project. Services will include pre -move ridematching, personal follow-up to establish ridesharing arrangements prior to the move, assistance with establishing work schedules outside the peak periods, and assistance with transportation services after the relocation. A tenant move -in package will be provided with Access Guides for all employees, and other related commuter information (e.g. ridematching forms, bus maps, and the Transportation Coordinator's telephone number). 2.6 Coordination with Area Transportation Actions Potential ridesharing arrangements � can be increased by expanding the employee base for ridematching, and increasing the resources available for TDM activities by working in concert with area employers, property owners, and public agency representatives. An association formed of area tenants, employees, property owners and the City could provide these coordinated transportation services. Property management at 4100 Newport Place Drive, through the designated Transportation Coordinator, will coordinate with 11 TAA C r ♦ r ■..i- transportation management activities with other interested employers in the Newport Beach/John Wayne Airport area. 2.7 Mid -Day Services The Transportation Office will provide tenants and employees working at 4100 Newport Place Drive with a map and list identifying nearby mid -day services such as financial services, health/ fitness/recreational, personal services (e.g., barber, dry cleaners), food/convenience stores, restaurants, etc. This will provide employees with information on services within walking distance of their worksite at 4100 Newport Place Drive, and thus reduce the need for use of a personal vehicle during the middle of the day. 2.8 Monitoring, Reporting and Enforcement The Transportation Coordinator will be the point of enforcement for the TDM program. The Transportation Coordinator will have access to sufficient data on employee commuting behavior to be able to prepare periodic reports on the status of the transportation program. The sources of this data will include parking operations, bus pass sales, vanpool administration, tenant/employers, the annual transportation survey, and periodic inspection of the parking areas. A system will be developed for tracking the number of solo drivers, carpoolers, vanpoolers and bus passengers, bicycle - commuters. This registration process should enable the Coordinator to verify the authenticity of vehicles parked in the carpool areas and to track the participation rate for the transportation program. Annual surveys of employee travel behavior and attitudes, along with the monthly parking and ridesharing records, will provide the data necessary for preparation of reports on the Transportation Demand Management Program and its impact on peak hour trips and parking demand. JCounts of vehicles entering and leaving the site for each fifteen minute period during the morning and evening peak hours will be taken on representative midweek days. These counts will be verified by the City of Newport Beach. This information will be taken to determine the number of peak hours trips generated at the site. These counts will determine the actual 1 number of vehicles arriving and departing the facility, and the vehicle occupancy. Status reports will be prepared and made available to the City on an annual basis. 12 TAA C A report describing the TDM program and the status of trip generation at the site will be submitted to the City of Newport Beach every six months for the first two years of occupancy commencing on the anniversary of issuance of the Certificate of Occupancy, with reports being submitted annually thereafter. 3.0 Carpool Incentives 3.1 Preferred Parking Spaces In addition to the ridematching and personal assistance given by the Transportation Coordinator, carpoolers will also be given preferred parking privileges. Carpool parking will be located in areas that are convenient to the building entrance and/or exiting location of the parking facility. Up to 10 percent of employee parking spaces will be identified for use by carpools and provided upon demand. 3.2 Reduced Parking Rates Carpoolers who register with the Transportation Coordinator will be offered parking at no charge if, and when, parking fees are assessed. 3.3 Validated Parking Commuters participating in one daily parking validation attractive to commuters who personal vehicles to work. 4.0 Van000l Incentives authorized carpools will be allowed per month. Vanpool vehicles will be allowed to park at no charge. 4.3 Vanpool Easy Start During the first 3 months of start up for each vanpool group formed at the 4100 Newport Place Drive the cost of two empty seats will be underwritten by property management so 'that riders will not have to incur any additional cost to initiate the Vanpool route. During this start up period, the Coordinator will assist the group in recruiting additional riders. At the end of the three month period, the vanpool group should be financially self-supporting if it is to be successful on a long-term basis. 4.4 Validated Parking Commuters participating in authorized vanpools will be allowed one daily parking validation per month if, and when, parking fees are assessed. This incentive will be attractive to commuters who must occasionally bring their personal vehicles to work. 5.0 Transit Incentives 5.1 Trip and Route Planning The Transportation Coordinator will provide trip planning and orientation assistance to tenant employees interested in transit services. Each interested employee will be offered a listing of routes, schedules, stop locations and required fare media for their trip to work. If possible, a list of other employees traveling the same route should be provided. 5.2 Sale of Bus Passes OCTD bus passes will be the complex at a reduced responsible for issuing and 6.0 Bicycle Incentives sold on -site to employees working in price. The Coordinator would be selling bus passes. Stationary bicycle parking facilities for approximately 10 commuter bikes will be provided in well protected and conveniently located areas of the site. Specific locations of these racks would be dependent upon final site design considerations. 14 THA C Bicycle information related to routes to work, bicycle safety, repair facilities, etc., will be supplied by the Transportation Coordinator. 7.0 Work Schedulina The operating hours of 4100 Newport Place Drive and associated parking facilities will be established to allow employees to choose earlier arrival and later departing times. The Transportation Coordinator will work with tenants prior to their relocation to 4100 Newport Place Drive to assist them in establishing alternative work hour schedules outside the peak hour (4:30-5:30 PM) for their employees. Working with nearby employers will allow the Transportation Coordinator to encourage tenants at 4100 Newport Place Drive to establish work schedules that do not have employees on the road at the same time as their neighbors. 8.0 Site Design Features 8.2 On -Site Health Club The presence of a health club will allow employees to arrive earlier and/or depart later than peak hour traffic on the surrounding street network. 8.2 Pedestrian Environment Creation of a pleasant workplace environment will complement transportation management efforts by making the complex attractive enough that employees will not be compelled to use their vehicles to leave during the day for lunch or other activities. Creating an attractive environment includes landscaping and providing amenities such as seating or picnic areas. Providing on -site retail and restaurant services should reduce some need for using a vehicle during the day. 8.3 Passenger Pick-Up/Drop-off Zones Waiting areas for carpools and vanpools will be designated by making use of planned pedestrian areas located adjacent to buildings and parking areas. Passenger zones should include pedestrian -type features that make waiting safe, secure and comfortable.
