Request to permit the operation of a restaurant

Assistant ^ommunity Development Director Hewicker
reviewed the request with the Planning Commission
and clarified the location of the restaurant In
question since there was another restaurant being
proposed which would not require a use permit.
Community Development Director Hogan advised that
the use would be compatible with other uses in the
area.
Public hearing was opened in connection with this
matter.
Fred Doehring, 109 Collins, Balboa Island, appiica�t,
appeared before the Planning Commission to answer
questions and stated he agreed with the conditions
as recommended in the staff report.
Ginger Page, 2412 Cliff Drive, appeared to question
the matter of entertainment on the premises.
There being no others desiring to appear an' be
heard, the public hearing was closed.
Following discussion, Planning Commission approved
Use Permit Application No. 1662 subject to the
following conditions:
1. That development shall be in accordance with
the approved plot plan except for minor
modifications which may be approved by the
Department of Community Development.

Application
This application is a request to permit a proposed restaurant to
serve on -sale alcoholic beverages in the C-Z-H District. Section
20.08.030 of the Newport Beach Municipal Code specifies that
establishments serving liquor within two hundred feet of a resi-
dential district may be allowed after first securing a use permit,
and Section 20.26.040 of the Municipal Code states that restaurants
are permitted in the C-2 District subject to the securing of a use
permit in each case.
Subject Property and Surrounding Land Use
The proposed restaurant is located in a portion of the existing
Mariner Shopping Center that consists of commercial and office uses.
To the north is the main U.S. Post Office, and across Avon Street
is a steep bluff up to a City park and single-family dwellings in
Newport Heights; to the east, across Riverside Avenue, are commercial
uses and an off-street parking lot; to the south is a service station
and across West Coast Highway are commercial uses; and to the west
is a machine shop and an auto parts store.
Analysis and Recommendation
The Mariner Center is comprised of two large buildings consisting of
various commercial and office uses. The proposed restaurant is to
.� be located in Suites A, B, and C of the building nearest Riverside
Avenue, but will be facing West Coast Highway. (The former tenant
was a catering and food take-out business.) Based upon an occupancy
of approximately forty-seven persons permitted in the restaurant,
sixteen off-street parking spaces would be required for the proposed
use (one stall per three seats).

Excluding the area of the restaurant, the two buildings in the
Center have approximately 12,500 sq.ft. of area, requiring ap-
proximately fifty off-street parking stalls. Approximately sixty-
six stalls would therefore be required in Mariner Center with the
addition of the restaurant. Eighty-five stalls are currently pro-
vided on-si.te (19 stalls in excess of ordinance requirements.)
The applicant has also indicated that approximately 80% of the
restaurant traffic during the day will be "foot traffic." After
5:00 P.M. and on weekends, approximately 90% of the Center parking
lot is empty.
The proposed hours of operation of the restaurant are from 11:00 A.M.
to 2:00 A.M. the following morning. A maximum of three employees
will be working in the restaurant during peak hours.
Staff feels that the proposed use will be compatible with the other
uses in Mariner Center and the adjoining commercial uses in the
area and will net be detrimental to nearby residential uses which
are approximately 550 ft, away on the bluff to the north. Staff
therefore recommends approval of Use Permit Application No. 1662
subject to the following conditions:
1. That development shall be in accordance with the
approved plot plan except for minor modifications
which may be approved by the Department of Com-
munity Development.
2. That all signs shall be approved by the Department
of Community Development.
