Hogan, Director Department bf Community Development FROM: Assistant City Attorney SUBJECT: Use Permit No. 1129 August 17, 197E We feel that Use Permit No. 1129, issued to the Irvine Company is no longer necessary nor, for that matter, is the Use Permit valid due to the fact that the State, and its subdivisions, acting in their primary capacities, are not subject to local zoning control. I would suggest that the letter from James G. Wilson, Assistant Vice Chancellor, Business Affairs, is entirely appropriate and that we should notify the University of California that the Use Permit for the operation of the rowing facility on Shellmaker Island is no longer required due to the State ownership of the parcel and State use of the parcel. This operation has been subject to the above captioned Use Permit issued by the City of Newport Beach. In April 1975 the State of California-, acting through the Department of Fish and Game, became the owner of certain real property in the Upper New- port Bay area including Shellmaker Island, The -Department of Fish and Game has approved the University's request to continue the rowing program on Shellmaker Island. A formal agreement is now in the process of execution by both parties. The attached notice of expiration of Use Permit No. 1129 indicates action ` necessary to extend the permit beyond June 4, 1976. It is my understanding that the State of California and subdivisions thereof are exempt from local planning and zoning controls and therefore a Use Permit is no longer appropriate.
