BOX 1768, NEWPORT BEACH, CA 92658.8915 BUILDING DEPARTMENT - MEMORANDUM TO: City Manager FROM: Building Director SUBJECT: #7 Upper Newport Plaza (SJHTC Fee) DA TE: February 25, 1986 Departmental investigation reveals that Permit No. 4986 for #7 Upper Newport Plaza was issued on January 6, 1986 without collecting the San Joaquin Hills Transportation Corridor Fee of $17,212.00. Collection was missed because plans 1were approved and ready to be issued on November 26, 1985; SJHTC Fee became effective December 72, 1985 and the Building Permit was subsequently issued January 6, 1986 without noticing that an additional fee was due. By the attached chronology you can see that permit issuance on this project was an extensive and laborious process spanning over a ten month period (February 28, 1985 to January 6, 1986). It is my opinion that this Fee is due and payable whether we collected it or not at the time of permit issuance. With your concurrence I would like to write a letter to Mr. Davis informing him that his permit is suspended until the $17,212.00 for the Transportation Corridor Fee is paid. Please advise. It should be noted that prior to the first Building Department Submittal several informal meetings were held with the Building, Traffic, Planning and Public Works Departments to review the project. A. February 25, 1985: First Submittal for Building Permit Plan Check to the City. We were informed that plans would be internally distributed to the Building Department, Planning Department and Fire Department for review and content. B. March 17, 1985: First Submittal of Title 24 documentation to the State Plan Checking Agency in Santa Ana. C. March 8, 1985: Plans submitted to the City of Newport Beach Public Works Department for courtesy review. No work associated with this project affects the publ is right-of-way. After repeated attempts to clarify this issue the architect was requested to assist the owner in resolving this issue. By November 8, 1985, I had obtained the remaining checks for fees, permits and deposits payable to the City of Newport Beach for our Building Permit. Please find enclosed copies of these checks dated November 7, 1985. On November 11, 19850 I tried to pick up the Building Permit; however, the clerk at the front counter stated that the landscape plans had not been signed off. I contacted Steve Malefyt, our Landscape Architect. He stated that he was informed by the City that they had been signed off. Hewicker February 11, 1986 Around November 20, 1985, I attempted to pay our Building Permit fees, but again was denied. This time I was informed that several signatures from the Building Department were missing. I contacted Brian Dougherty, our architect. He sent his representative to the City to correct the problem and obtained the signatures needed. Around November 29, 1985, I again went to the City and was again told that I still didn't have all the signatures needed. I contacted Brian Dougherty's office again. He called the City Building Department and was told there must have been a mistake at the front desk, and in fact the plans were permit ready. �ff1 6 i VIM�— On December 100 1985, I again went to obtain our building permit, and again I was told that not every Department Head had signed our plans. The girl at the front desk contacted the Department Heads in the Building Department while I was present. Each man who came out had jigned the plans and showed the staff at the front desk. One of the gentlemen stated that he had signed several times. After having received the signatures, I was told we needed to pay an additional $1,109.97 because the plan check fee had expired. Upon returning, I was finally able to obtain the Building Permit. Please find the enclosed copy of the Memorandum from our architect, Brian Paul Dougherty of Dougherty & Dougherty, and the copy of the letter from Stephen J. Male£yt, our landscape architect collaborating my recollection. Paying the Transportation Corridor Fees is a severe financial hardship. I believe that under the unique and very special circumstances which I have outlined above, that in fairness we should not be required to pay this fee. (A) A building permit applicant, as a condition of issuance of a building permit, shall pay a fee in an amount and,manner as provided in this chapter to defray the costs of constructing bridges over waterways, railways, freeways and canyons, or consructing major throroughfares. Section 15.42.020. Definitions. (1) The term 'construction' as used in this section includes preliminary studies, design, acq'uisi'tion of right-of-way, administration of construction contracts, and actual construction. (2) The term 'major thoroughfare' means those roads designated as transportation corridors and major, primary, secondary or corm' uter highways on the Orange County Master Plan of Arterial Highways, the Circulation Element of the General Plan of the City of Newport Beach. The primary purpose of such roads is to carry through traffic and provide a network connecting to the State highways system. (A) The provisions herein for payment of a fee shall apply only if the major thoroughfare or bridge facility has been included in an element of the City's General Plan or an element of the General Plan of, the County of Orange which was adopted at least thirty (30) days prior to the application for a building permit. (B) Payment of fees shall not be required unless the proposed major thoroughfares) are in addition to, or a widening or reconstruction of, any existing major thoroughfare(s) serving the area at the time of the adoption of the boundaries of the area of benefit. (C) Payment of fees shall not be required unless the proposed bridge facility is a new bridge serving the area or an addition to an existing bridge facility serving the area at the time of the adoption of the boundaries of the area of benefit. Section 15.42.040. Notice of Hearing. (A) Action to establish an area of benefit may be initiated by the City Council upon its own motion or upon the recommendation of the Public works Director. The City Council shall set a public hearing for each proposed area benefited. Notice of the time and place of said hearing including preliminary information related to the boundaries of the area of benefit, estimated costs and the method of fee apportionment shall be given in the following manner: (B) Notice shall be given at least ten (10) calendar days before the hearing by the following: (1) Notice published at least once in a newspaper of general circulation within the proposed area of benefit. (2Y Notices posted throughout the proposed area of benefit with at least three (3) notices posted' at arterial highway intersections within the proposed area of benefit. (3) Notices sent by first-class mail addressed to each property owner within the boundary of the proposed area of benefit. (4) Notices sent by first-class mail to all known homeowners' Associations within the proposed area of benefit. A certified copy of such resolution shall be recorded by the City Clerk with the Orange County Recorderts Office. (B) Such apportioned fees shall be applicable to all property within the area of benefit and shall be payable as a condition of issuing a building permit authorizing certain construction on such property or portions thereof. Where the area of benefit includes lands not subject to the payment of fees pursuant to this section, the City Council shall make provisions for payment of the share of improvement cost apportioned to such lands from other sources. Section_15.42.060. Protests. (A) Written protests shall be received by the City dlerk at any time prior to the close of the public hearing. If written protests are filed by the owners of more than one-half of the area of the .property to be benefited by the improvement, and sufficient protests are not withdrawn so as to reduce, the area represented by the protests to less than one-half of the area to be benefited, then the proposed proceedings shall be abandoned, and the City Council shall not, for one year from the filing of said written protests, commence or carry on any proceedings for the same improvement under the provisions of this section. Any protests may be withdrawn by the owner making the same, in writing, at any time prior to the close of the public meeting. (B) If any majority protest is directed against only a portion of the improvement, then all further proceedings under the provisions of this section to construct that portion of the improvement so protested against shall be barred for a period of one year, but the City Council shall not be barred from commencing new proceedings not including any part of the improvement so protested against. Such proceedings shall be commenced by a new notice and public hearing as set forth in Section 15.42.040 (A) above. If the area of benefit encompasses one or more bridges and one or more thoroughfares and all lands within the area of benefit are subject to the same proportionate fee for all bridges and thoroughfares, a single fund may be established to account for fees paid. Monqys in such fund -shall be expended solely for the construction or reimbursement for construction of the improvements serving the area to be benefited and from which the fees comprising the fund were collected, or to reimburse the City for the costs of constructing the improvement. Section 15.42.080. In Lieu Consideration. The City Council may approve the acceptance of consideration in lieu of the payment of fees established herein. Section 15.42.090. Advances From Other Funds. The City Council may approve the advancement of money from the General Fund, the capital improvements fund or the contributions fund to pay the costs of constructing the improvements covered herein and may reimburse these funds for such advances from planned bridge facility or major thoroughfare funds established pursuant to this chapter. Section 15.42.100. Reimbursement. If the build'ing permit applicant, as a condition of the issuance of the building permit, is required or desires to construct a bridge or major thoroughfare, the City Council may enter into a reimbursement agr-cement with the applicant. Such agreement may provide for payments to the applicant from the bridge facility or major thoroughfare fund covering that specific project to reimburse the applicant for costs not allocated to the applicant's property in the resolution establishing the area of benefit. If the bridge or major thoroughfare fund covers more than one project, reimbursements shall be made on a pro rata basis reflecting the actual or estimated costs of the projects covered by the fund." Hill Ltd. dated January 15, 1986, a copy of which is enclosed for your convenience. I contacted Mr. Garcia by telephone after receiving the letter to explain that we intended to detail in writing what we believe are special circumstances regarding the delays in our permit and the hardship of the Corridor Fees being imposed at this time. In October we received notice by mail that our plans were permit ready. The notice requested that we pay our fees and receive our stamped plans. On October 24, 1985, I obtained the necessary checks payable to the City for the grading permit. Please find enclosed copies of the checks dated October 24, 1985. I picked up the Grading,• Permit on November 5, 1985. By November 8, 1985, I had obtained the remaining checks for fees, permits and deposits payable to the City of Newport Beach for our Building Permit. Please find enclosed copies of these checks dated November 7, 1985. On November 11, 1985, I tried to pick up the Building Permit; however, the clerk at the front counter stated that the landscape plans had not been signed off. I contacted Steve Malefyt, our Landscape Architect. He stated that he was informed by the City that they had been signed off. He contacted Jack Brook, who stated that they were signed off by him and that he had sent the plans over to the front desk;(W%kK however, his approved landscape plans had been lost or misplaced. We once again submitted landscaping plans and received approval from Jack Brook. Steve Malefyt and myself picked them up and hand -carried them over to the front desk. V*oFt qas -) Page Two James D. Hewicker February 11, 1986 Around November 20, 1985, I attempted to pay our Building Permit fees, but again was denied. This time I was informed that several signatures from the Building Department were missing. I contacted Brian Dougherty, our architect. He sent his representative to the City to correct the problem and 9 obtained the signatures needed. s' Around November 29, 1985, I again went to the City and was again told that I still didn't have all the signatures needed. I contacted Brian Dougherty's office again. He called the City Building Department and was told there must have been a mistake at the front desk, and in fact the plans were permit ready. On December 10, 1985, I again went to obtain our building permit, and again I was told that not every Department Head had signed our plans. The girl at the front desk contacted the Department Heads in the Building Department while I was present. Each man who came out had signed the plans and showed the staff at the front desk. One of the gentlemen stated that he had signed several times. After having received the signatures, I was told we needed to pay an additional $1,109.97 because the plan check fee had expired. I put in a check request for the fee the next day. On December 12th I left on my Christmas through New Years vacation. Upon returning, I was finally able to obtain the Building Permit. Y Please find the enclosed copy of the Memorandum from our architect, Brian Paul Dougherty of Dougherty & Dougherty, and the copy of the letter from Stephen J. Malefyt, our landscape architect collaborating my recollection. Paying the Transportation Corridor Fees is a severe financial hardship. I believe that under the unique and very special circumstances which I have outlined above, that in fairness we should not be required to pay this fee.
