Request to permit the establishment of a dry cleaning facility on
property located in the C-1-H District.
LOCATION: Lot 7 and a portion of Lot 8 of Tract No. 1235, located at 3426 Via
Lido, on the northeasterly side of Via Lido, between Central Avenue
and Via Oporto, in the Lido Shops.
ZONE: C-1-11

Application
This application involves a request to establish a commercial dry-cleaning facility on
property located in the C-1-11 District. Section 30.35.020 of the Newport Beach Municipal
Code permits cleaning establishments in the C-1 District, subject to the securing of a use
permit in each case. Use permit procedures are set forth in Chapter 20.80 of the Municipal
Code.
Environmental Significance
This project has been reviewed, and it has been determined that it is categorically exempt
from the requirements of the California Environmental Quality Act under Class 1(Existing
Facilities).
,eject Property and Surrounding�,and Uses
The subject property is currently developed with a commercial building which contains
5,700± square feet of floor area. The ground floor of the building contains a 1,875 square
foot photographic studio; a 1,125 square foot tailoes shop, and a 1,500 square foot clothing
shop. The second floor of the building contains 1,200 square feet of office use.

Conformance with the General Plan and
Local Coastal Program, Land Use Plan
The Land Use Elements of the General Plan and the Local Coastal Program designate the
site for "Retail and Service Commercial" uses. The subject project is a permitted use within
this designation. In accordance with the provisions of the California Coastal Act, the subject
application also requires the approval of the Coastal Commission.
Analysis
The applicant proposes to establish a dry cleaning facility in a portion of the existing
commercial building which is now occupied by a photographic studio. The proposal includes
the installation of machinery and equipment to provide on -site cleaning and laundering of
clothing. The facility will occupy approximately 1,875 square feet of the ground floor
portion of the building. The facility will be open from 7:00 a.m. to 7:00 p.m. daily. A
maximum of three employees will be on duty at any time. The installation and operation
of all dry cleaning equipment will be subject to the requirements of the South Coast Air
Quality Management District so as to control any possible odors.
Off-street Parking Requirement
The existing 5,700± sq.ft. commercial building located on the subject property was
constructed prior to the requirement for off-street parking. However, the subject property
is one, of seven parcels which are commonly known as the Lido -Shops and which maintain
a parking agreement with Lido Marina 'Village which provides 24 panting spaces on a
permanent basis. Of the 24 parking spaces available, 8 spaces are designated for the subject
property. Based on the current commercial parking requirement of one panting space for
each 250 square feet, the subject building would require 23 parking spaces if it were built
today (5,700± sq.ft.+ 250 sq.ft. = 22.8 or 23 parking spaces). Therefore, the subject building
is nonconforming with regards to off-street parking. Inasmuch as the applicant's proposal
does not result in an increase in floor area, and the proposed use is of no greater intensity
than other permitted commercial uses, it is staffs opinion that the proposed dry cleaning
facility will not result in an increase in parking demand for the site.
Specific Findings
Section 20.80.060 of the Newport Beach Municipal Code provides that in order to grant any
use permit, the Planning Commission shall find that the establishment, maintenance°or
operation of the use or building applied for will not, under the circumstances of 1the
particular case, be detrimental to the health, safety, peace, morals, comfort, and gene,l
welfare of persons residing or working in the neighborhood of such proposed use or
detrimental or injurious to property and improvements in the neighborhood or the gene
welfare of the City.

FINDINGS AND CONDITIONS OF APPROVAL
FOR USE PERMIT NO.3435
Findines•
1. That the proposed development is consistent with the Land Use Element of the
General Plan and with the Local Coastal Program and is compatible with the
surrounding land uses.
2. That the approval of Use Permit No. 3435 will not, under the circumstances of this
case, be detrimental to the health, safety, peace, morals, comfort and general welfare
of persons residing and working in the neighborhood, or be detrimental or injurious
to property and improvements in the neighborhood or to the general welfare of the
City.
CONDITIONS:
1. That development shall be in substantial conformance with the approved site plan
and floor plan.
2. That any boilers shall be isolated in accordance with the requirements of the
Uniform Building Code.
3. That the use of chemicals shall be reviewed and approved by the Fire Prevention
Bureau of the Fire Department.
4. There shall be no outside storage of materials, supplies or other paraphernalia likely
to be objectionable to the adjacent property owners.
5. That any roof top or other mechanical equipment shall be screened from view and
shall be sound attenuated to be no greater thEn existing sound levels at the property
lines.
6. That the proposed dry cleaning operation shall be installed and operated in
conformance with the requirements of the South Coast Air Quality Management
District.
7. That Coastal Commission approval shall be obtained prior to the issuance of the
building permit for the dry cleaning facility.
8. That this use permit shall expire unless exercised within 24 months from the date of
approval as specified in Section 20.80.090 A of the Newport Beach Municipal Code.

The public hearing was opened in connection with4is item, and
W. Eugene Bieich appeared before the Planning Commission on
behalf of the applicant, and he concurred with the findings and
conditions in Exhibit "A"
In response to a question posed by Commissioner Edwards with
respect to the available parking for the establishment, Mr. Bleich
explained that parking is available at the front and rear entrances
of the facility.
Mr, Ward• Riggins, 3428 Via Lido, appeared before the Planning
Commission. Mr. Riggins expressed a concern that all of the
property owners adjacent to• the subject property had not been
notified of the dry cleaning plant on the basis that chemicals will
bd used in the facility, and that said requirement is a State
regulation. James Hewicker, Planning Director, explained that all
of the property owners are notified within 300 feet of the
application, and he further stated that State licensing authorities
will notify all of the property owners in the area. Commissioner
Edwards advised that Condition No. 6, Exhibit "A", states That the
roposed dry cleaning operation shall be installed and operated in
conformance with the requirements of the South Coast Air Quality
Management District. Commissioner Merrill stated that Condition
No. 3, Exhibit "A", states That the use of chemicals shall be reviewed
and approved by the Fire Prevention Bureau of the Fire Department.

9. That the Planning Commission may add to or modify
conditions of approval to this use permit, or recommend to
the City Council the revocation of this use permit upon a
determination that the operation which is the subject of this
amendment causes injury, or is detrimental to the health,
safety, peace, morals, comfort, or general welfare ,of the
community.

the construct of a drive-in and take-out restaurant facility in
conjunction with new retail commercial building on property
located in the "Ret ' d Service" area of the Koll Center Newport
Planned Community. approval also included: a request to
allow a portion of the requ. d off-street parking spaces to be
provided within the proposed -through lane of the facility; a
modification to the sign standards the Koll Center Newport
Planned Community; a traffic study, the acceptance of an
environmental document. The current prop o 1 involves a request
to amend the previous approvals by appr . g a revised
environmental document which deletes a previo mitigation
measure requiring the restriping of a portion of the inter on at
Campus Drive and Jamboree Road.
