RATIONALE: The proposed project will have no adverse impacts on coastal
resources as it is a remodel for an existing flower shop and will not increase
the intensity of use of the facility. Adequate parking exists for the
shopping center. The project is consistent with the Coastal Act, the City's
Land Use Plan and past Commission actions.
This waiver will not become effective until reported to the Commission at their
June 12-15, 1990 , meeting and the site. of the proposed
development has been appropriately noticed, pursuant to 13054(b) of"the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the

of a portion of the common patio seating area. The
proposal also includes a change in the operational
characteristics of the take-out restaurant use so as to
allow the use of compact parking spaces for a portion of
the required off-street parking.

3. That the final parking layout shall meet the
approval of the City Traffic Engineer prior to the
issuance of building permits.
4. Prior to occupancy, the applicant shall provide a
separate plan acceptable to the City Engineer which
will provide for the required 306 parking spaces
without utilizing the southwesterly portion of the
site which will be used for the widening of Newport
Boulevard.
5, That handicapped parking shall be provided as
required by Code, and that the required number of
handicapped parking spaces shall be designated
solely for handicapped self parking. One
handicapped sign on a post shall be required for
each handicapped space.
6. - That Condition No. 11 of Use -Permit No. 3284 shall

Coastal Commission Procedures for Permits and Appeals
Because the State Coastal -Commission now issues all coastal permits for areas without
LCPs, it has developed new, streamlined procedures for considering these permits. Appli-
cants should submit their permit applications at the appropriate office. Because
regional commissions no longer exist, the state commission's workload has increased
tremendously. The following procedures are intended to speed up the process without
nec3ecting important coastal issues.
IF Y00 ARE AN APPLIMT: In most cases, your application rill be reviewed by the district,
staff and placed on the state commission agenda for the earliest possible meeting. Staff
will determine if the application can be put on either the consent or administrative
calendar or whether it must receive a full public hearin4.
AD"MIMTRATIVE CALENDAR: Administrative permits may be °ranted by the executive director
for projects which are minor new developments, additions to existing structures (not
exceeding $100,000 in cost),single family residences, or nulti-family projects of four
units or less The Coastal Act requires that all administrative permits be reported
to the Commission at its next meeting before they take effect. Administrative permits will
be reported on the administrative calendar. if four or more commissioners request that
an item be held for public hearing, the project will be removed from the administrative
calendar and scheduled for a public hearing and possible vote at the next regular com-
mission meeting.' Conditions may be attached to an administrative permit. Applicants
and other interested parties may speak in opposition to the project or its conditions.
Testimony is limited to 3 minutes for each side.
CONSENT CALENDAR: Projects considered by staff to be consistent with the Coastal Act
but which do not qualify for the administrative calendar nay be placed on the consent
calendar. Projects on the consent calendar will be approved by the commission with a
single vote for the entire calendar. If three or more commissioners wish to pull an item
off consent, that item will normally be rescheduled for a regular public hearing and
possible vote at the next regular commission meeting. Conditions may be attached to
consent calendar permits. Applicants who accept these conditions need not speak.
Opponents should tell the commission why the project is inconsistent with the Coastal Act.
Three minutes will be allowed for each side to speak to the commission. If there are
several persons wishing, to address an item, efforts should be made to consolidate pre-
sentations in order to stay within the time -limits. Interested persons should check with
the commission staff regarding subsequent hearings.
REMIAR CALENDAR PERMIT APPLICATIONS: Projects potentially inconsistent with the Coastal
Act or which can be approved only with conditions for which there are no clear precedents
will be placed on the regular calendar and will be considered after a full public hearing.
Persons supporting or opposing the project should tell the commission why they think•the
project is or is not consistent with the Act. Testimony must address coastal act
policies and environmental impacts of the project and should not be redundant. Each
side is allotted 10 minutes, with the applicant speaking "irst and then the opposition.
Spoken rebuttal is not allowed, but written rebuttal or other pertinent material may be
submitted to the staff following the hearing. Projects on the regular calendar will
normally be scheduled for continued hearing and voting at the next regular commmiskion
meeting.
On some projects, the staff may have enough information to make a preliminary recommen-
dation for approval after the public hearing has been held. Ir. that case, the commission
may vote that day and not postpone the decision.
'When a staff recommendation is+presented to the commission, -both the applicant and
opponents have five minutes each to comment on the recommendations. After the hearing
is closed, the commission will discuss the matter and vote.

If it is convenient, you say also wish to bring 20 copies of your spoken testimony to
the hearing for distribution to the comissioners.
Speakers may use saps, slides, photographs, models# and other visual materials in their
presentations to the eosmission. Sine* such materials become part of the public record
on the permit# reproductions of the materials shown must be submitted to the cOMMissict
staff before or during the commission meeting, or the originals will be retained by the
commission for 60 days. A garousal slide projector and screen will be available at the
meetings.

session has adopted regulations (Sections 15025.1 and liodS) prohibiting a Commissioner
frost voting on a permit setter it be or she has received a campaign contribution from an
interest*d party. If you intend to speak on a permit wetter, pl*ase indicat* on your
speaker slip and/or in your testimony, it you have made campaign contributions in excess
of $100 to any Cmodssioner within the lost year, and if so, to which Commissioner you con-

Dear Gina:
This letter is in response to your question relating to the former location
of the Pavilions flower shop adjacent to Via Lido Drug Store. As a part of the
tenant improvements associated with the newly opened Via Lido Drugs, the
aforementioned flower stand was demolished. The area where the flower shop
was previously located now contains both a customer and delivery entry door
to include a wall and staircase as shown on the aforementioned improvement
plans.
Adjacent to the new wall is a self-contained and free-standing newsstand
and the previous awning cover has been replaced utilizing the new color
schemes associated with the site renovations currently underway.
I hope that this adequately answers your question, however, should it

I am enclosing a large memo from Pat Galvin to Fritz Duda
regarding the Lido Marina Village parking requirements. I am also
enclosing a letter from an attorney representing The Warehouse
regarding a standstill agreement between the parties pending
resolution of various parking issues.
During the hearing on The Thunderbird, we learned that Lido
Marina Village had leased the parking structure to California Valet
Parking. The terms of that lease are unknown, but California Valet
Parking does more than just operate the structure for Lido Marina
Village. The numerous use permits in Lido Marina Village, and the
failure of those permits or the Code to clearly and accurately
describe parking requirements for various uses, have created some
problems. The use permits issued to Lido Marina Village businesses
assume that parking requirements will be satisfied in the
structure. ' However, the structure is operated on a first come,
first served basis, (without spaces assigned to specific
businesses) and in the evening they charge rates which encourage
people to park in Lido Plaza or the residential areas on the west
side of Newport Blvd., in the City Hall lot, or on Via Lido east of
Lido Marina Village.
I hate to get involved in a matter which is in litigation, but
I think Galvin has asked some very valid questions, and the City
should either review the parking requirements for LMV in
particular, or generally evaluate our parking requirements,
especially as they relate to charges and the lack of any obligation
on the part of permittees to provid parking to customers of the
business.

For several months, the manager of the Wherehouse Restaurant has been calling me to try
to solicit city involvement with the parking problems related to the management of the
parking structure located in Lido Village. The attached letter represents some the
problems that seem to be occurring. I have told them that we cannot get involved in civil
matters, but they seem to feel that the property owner of the structure is in violation of
their parking agreement with the city. Bob Burnham said he gave you the packet on the
Fritz Duda study and that this all appears to be tied together. I am passing this on to you
for your information.

Dear Genia;
First of all, Percy and I would like to thank you for taking the time to see us on Monday. We
appreciate your suggestions for us to conduct a survey of the allotted parking spaces available
after 6:00p.m. in Lido Marina Village Parking Structure.
Attached, is a summary that I personally conducted in the parking structure. As it clearly shows,
there are only 360 total spots available, without accounting for the spots designated for valet
parking! If you account for the 175 spots designated for us and the 189 spots designated for
Thunderbird after 6:00 p.m., the total is already 364 not accounting for the additional 69 spots
designated for the other restaurants and shops.
Therefore; when California Parking blocks off the 96 spots that they designate for valet parking,
this reduces the area for guest parking to 264 spots after 6:00 p.m.. Obviously at this stage, they
can't accommodate our required 175 spaces.
