ZONE: SP-4 APPLICANT: Salvin Construction, Costa Read OWNER: Creative Way, Inc., Costa Mesa Application This is a request to convert a portion or an existing commercial building into a take-out ice cream shop, and to waive a portion of the required offstreet parking spaces in conjunction with this use. In accordance with Section 20.61.060 of the Newport &rach Municipal Code, take-out restaurants are a permitted use in the SP-4 District, subject to the securing of a use permit in each case. Use Permit procedures are set r.rth in Section 20.80 of the Municipal Code. Background At its meeting of October 29, 1981, the Planning Commission continued this request to the meeting of November 19, 1981, so as to permit the operator of an ex.tstinq take-out restaurant on the subject property to submit the application for a use permit. A use permit application has now been received for the "Bun-n-Barrel" restaurant facility and is tentatively scheduled for the Planning Commission meeting of December 10, 1981. Environmental Significance This project has been reviewed, and it has been determined that it is categorically exempt under Class 1 (Existing Facilities) from the requirements of the California Environmental Quality Act. 0 To: Planning Commission -2 Conformance with the General Plan and Draft Local Coastal Plan The Land Use Element of the General Plan and the Draft Local Coastal Plan designate the site for "Retail and Service Commercial" uses. The proposed restaurant facility falls within the uses permitted upon securing a Use Permit. Sub7cct Property and Surroundina Lard Use A single -story multi -tenant commercial structure and related parking areas exist on the subject property. To the north, across Newport Shorcu Drive, are residential uses; to the east are commercial uses; to the south is a restaurant facility (The Spaghetti Sender) and related parking area; to the south, across West Coast Highway, are residential uses; and to the west, is the Travel Lodge Motel and parking area. Background City Building records indicate that the exintrng commercial building was constructed in 1965. Various Suildbag, plumbing And electrical permits have been issued since then for minor alterationu to the interior of the multi - tenant structure. Analysis The applicant proposes to convert a portion of the existing building into a take-out ice-cream parlor. Based upon a letter submitted as A part of this request, the facility is being designed to provide off -site eating, delivery and party catering only. There are no tables or chairs planned for the patrons of the proposed facility. The proposed hours of operation are from 11:00 a.m. to 9:00 p.m. daily. A maximum of 1 employee is anticipated during peak hours of operation. Drive In and Outdoor Restaurant Requirements Chapter 20.72, Drive In and Outd or Restaurants, of the Newport Beach Municipal Code was adopted in 1967 by the City in order to give the Planning Commission the opportunity to review any proposed "take-out" restaurant through the use permit procedures. Development standards are included in Chapter 20.72 to ensure that any proposed development would be aesthetically compatible to adjoining properties and streets. Said development standards include specific requirements for building setbackn, parking and traffic circulation, walls surrounding the take-out restaurant site, landscaping, exterior illumination, signing, underground utilities, and storage. , 3:4" 10: Planning Commission -3. The following outline describes the subject property and structure and the conformance with the standards set forth in the municipal Code: Setbacks The existing structure maintains a 0 foot front setback from 62rd Street, a 0 foot side yard setback adjacent to l:ewpurt Snores Drive, a 30 foot f interior side yard and a 9 foot rear yard. The Zoning Code permits zero yard setbacks for commercial buildings in the Newport Shores Specific Plan Area where the property does not abut a residential district. No changes are proposed which would alter any existing setbacks. Landscaping Section 20.72.080 of the municipal Code sets forth the design standards for landscaping, which includes the requirements of a maximum of 10% of the total site area to be landscaped planting area. No landscaping is proposed for the subject property. Exterior Lighting The plans do not indicate that the parking lot will be lighted as set forth in Section 20.72.090, nor has any provision been made to place all utility services underground as set forth in Section 20.72.110. The Planning Commission may, as previously indicated, waive any of these requirements, upon making the findings outlined in Section 20.72.130. Staff, however, is of the opinion that the parking lot should be adequately lighted, of the proposed facility is to be oper. after 6:00 p.m. Offstreet Parking Requirements The municipal Code requires one parking space for each employee on duty during peak hours and one parking space for each 50 squire feet of gross floor area within a take-out restaurant facility unless modified or waived by the Planning Commission. Based upon the proposed grouu tloor area of 540 sq.ft. and a maximum of 1 employee on duty during peak hours, a total of 12 parking spaces (540 sq.ft. - 50 sq.ft. - 11 + 1 space) are required. Existing uses on the Subject Property The subject commercial structure contains approximately 2,290 i sq.ft. of floor area. The subject ace -cream parlor is proposed to be located in a vacant space at the westerly end of the structure. Adjacent to this space is an existing commercial use ("Robbies Rag -a -Mop") that occupies approximately 660 sq.ft. of floor area. At the easterly and of the structure is the "Bun-n-Barrel" Restaurant facility. it should be noted that the "Hun-n-Barrel" is operating without a use permit as required by the Code. The owner was notified of the need to secure a use permit. Subsequently, the TO: Planning Commission -4. owner indicated to staff that the restaurant use would be changed to a delicatessen that would not require a use permit. To date, this change has not occurred and the restaurant continues to operate illegally. A use permit application has now been filed for this use. The existing restaurant contains approximately 1,090 sq.ft. of floor area. Although no plans are available, it appears that approximately 680 sq.ft. of "net public area" exists within the restaurant use, containing five tables with twenty-nine chairs, a dining counter and a service counter. On -site Parking Requirements The subject property is striped to provide 6 parking spaces. Based upon tht current City parking standards, the following outlines the existing on -site parking requirements: Commercial Use: 660t sq.ft. of net floor area - 250 sq.ft. - 2.6 or 3 spdccs. Restaurant Use: (Not approved) 6001 sq.ft. of "net public area" - 40 sq.ft. of n.p.a " 17 spacus TOTAL: 20 Spaces As previously indicated, the proposed Ice-cream parlor would require 12 parking spaces in addition to the 20 spaces that are normally required by the Code for the existing uses on -site. Therefore, a total of 31 spaces are required or. the subject property where only 6 standard parking spaces exist. Waiver of Parking Spaces The applicant is requesting that the parking spaces required for the subject take-out restaurant be waived inasmuch as the ma)ority of the patrons are expected to be predominantly "walk-ins" from nearby residences, the hotel and local beaches. Staff has no mayor ob)ections to the waiving of a portion of the required parking spaces. Staff is of the opinion however, that parking should be provided on the subject property for the 1 ice-cream parlor employee and at least one customer parking space at a minimum. This would reduce the amount of vehicles generated by this facility parked on adjacent residential streets. The following outline describes the nunject property and structure and the conformance with the standards net forth in the Municipal Coda: Setbacks The existing structure maintains a 0 foot front nntback from 62ndStreet, a 0 foot side yard setback adjacent to Newport Shores Drive, a 30 foot f interior side yard and a 9 foot rear yard. The Zoning Code permits zero yard setbacks for commercial bufldinga in the flewport Shores Specific Plan Area where the property does not abut a residential district. No changes are proposed which would alter any existing setbacks. Landscaping Section 20.72.00D of the Municipal Code note forth the design standards for landscaping, which includes the requirements of a maximum of 10% of the total site area to be landscaper planting area. No landscaping is proposed for the subject property. Exterior Lighting Section 20.72.090 of the Municipal Code requires that parking arean shall be illuminated and that said lighting system shall be designed to minimize the reflection of light to ntreetx and properties adjoining the restaurant site.
