ITEM 2.0 Office and parking construction shall be type V one -hour, fully
sprinkiered. (Sprinklers substituted for one -hour construction).
2.1 Occupancy "Groups:
A. Office B-2
B. Parking Garage B-1
2.2 Horizontal occupancy separation between B-1 and B-2 to be one -hour.
2.3 Protection of exterior openings:
A. Office - 40' minimum between structures and no building closer
than 20' to any property line for unprotected openings.
B. Parking - Two hour area separation walls required at parcelized lot
lines between buildings. No extension of rated wall required
perpendicular to lot lines.
2.4 28,000 s.f. allowable area increases per building, for a total of 84,000
s.f., exceeds that limited by Planning requirements of 40,951 s.f.
maximum. The three buildings will be considered separate structures
for code purposes. No physical separation of structure required.
2.5 Building height not to exceed 3 stories for type V one hour. Planned
Community Text amendment and Use Permit limits height of building
to 40' maximum above adjacent existing grade.
ITEM 3.0 Secondary stairs required in each building since project is to be
parcelized. No sharing of stairways is allowed if the buildings are
considered separate.
3.1 Shaft enclosure required for stair between parking and office levels.
(Provides required one -hour separation between B-2 and B-1
occupancies). No enclosure required for stair between first and second
level for secondary stair.
3.2 Elevator shaft to be continuous for three levels. One -hour elevator
doors at all levels shall provide required protection of openings. No
other smoke seal devices necessary. (i.e., roll down doors, vestibules,
etc.).
3.3 Elevator shaft to be vented in accordance with UBC section 1706 (d).

3.4 Mechanical shafts extending through more than two levels to be rated
one -hour. (Also provides B-1/B-2 separation).
ITEM 4.0 Exiting - one stair to parking level, one to deck level. Deck level
exit to be continuous to a public way by means of exterior steps
Incorporated into landscape planter areas.
4.1 Stairs shall be separated by at lease one half of the overall maximum
diagonal of the building. Separation distance measured to closest point
of each stair, not to head of stair.
4.2 Parking level stair exits under building immediately adjacent to
exterior wall. This arrangement is acceptable to NB.
ITEM 5.0 Restrooms to be provided as part of tenant improvement work. Notes
on the plans shall indicate number of fixtures required at that time
based on the Uniform Plumbing Code recommendations. Completion of
this work will be required prior to building occupancy.
ITEM 6.0 Ancillary space at the parking level will be used for
telephone/electrical room, elevator machine room and mechanical
room. One hour occupancy separation required between this space and
B-1 parking garage.
ITEM 7.0 Site parking based on one stall per 225 net square feet. Planning to
determine their estimation of net square footage since no restrooms
are being done as part of shell. SAI to follow up with Planning.
7.1 Handicapped stalls or access driveways will not be located in "tuck -
under" parking area. Therefore, clearance under buildings need only be
7'-0".
ITEM 8.0 Trash enclosure size, location, design and number of bins to be
determined by General Services. SAI to follow up.
ITEM 9.0 Building addresses to be determined by Planning and Fire Department.
ITEM 10.0 Common fire sprinkler lines shall not cross parcelized lot lines. On -
site fire water loop with individual fire service assemblies for each
building should solve this condition.

10.1 Fire lane required. Fire Department to determine location and
forward lane identification information to SAL
10.2 300' maximum spacing between fire hydrants required. Existing public
fire hydrants may be adequate. Fire department to review.
10.3 Fire hydrant shall be located no further than 30' from pumper
connections. One on -site hydrant In addition to existing public
hydrants should suffice.
10.4 Fire Department knox box required for each building. Knox box shall
be located at entrance to parking level stair. Fire Department to
forward application form to SAI.
10.5 Fire extinguisher requirements per NFPA.
10.6 Fire sprinkler system design per NFPA 13.
ITEM 11.0 Building valuation based on contractor's reasonable estimate of work to
be performed. City to adjust this number as necessary.
ITEM 12.0 Submittal information sheet provided to SAI by NB. Any unanswered
questions will be forwarded to NB for response.
ITEM 13.0 if parking areas between buildings are to be covered - non conbustibie
materials or one hour construction must be used to avoid the need for
30" parapet at deck level. See UBC Section 505 (d) 3, Exceptions.
(Extension of area separation wall below - masonry wall construction,
required to be two hour by code).
ITEM 14.0 Draft stop issue discussed:
Floor joist depths not to exceed that allowed by NFPA
recommendations for elimination of sprinkler up -heads in combustible
construction. Type of HVAC system will have an effect on this
condition.

Dear Mr. Webb:
I write in follow-up to recent conversations between you and our
architects regarding our proposed development of the northeast
corner of Birch and Bristol Streets.
I understand that the City has a rule against the issuance of building
permits that would allow construction over existing lot lines, even
if the parcels in question are commonly owned. As you know, we
are in the process of recording a final map that will resolve this
problem, creating three appropriately sized and located parcels
to support the three buildings planned for the site. I believe that
our tentative map has been approved by the City, and that its provisions
are acceptable to the County. It seems, though, that the county
staff will require another sixty to ninety days to complete their
recordation process (I understand that they have a very heavy current
workload), and this delay would do us severe financial harm.
So as to be able to "pull" building permits, and in conformance
with your suggestions, I offer and acknowledge the following assurances
and conditions for the release of building permits.
The processing of our final map is now under way at the County,
and we and our consultants will be diligent in pursuing final
recordation.
2. Following on number 1 above, we understand that the building
permits are conditional on recordation of the map and that,
should we not have the map recorded within six months of
the date of this letter, the City may choose to revoke the
permits until such time as the recordation process is completed.

for new building applicable to the district in
which the proposed project is located.
2. That the proposed development is consistent with
the Land Use Element of the General Plan, and is
compatible with surrounding land uses.
3. That adequate off-street parking and related
vehicular circulation are being provided in
conjunction with the proposed development.
4. The proposed number of compact car spaces will not
exceed 25 percent of the parking requirement which
is within limits generally accepted by the Planning
Commission relative to previous similar

more public visual open space and views than is
required by the basic height limit.

more desirable architectural treatment of the
building and a stronger and more appealing visual

not conflict with any easements acquired by the
public at large for access through or use of

10. That Section 13.05.010 of the Newport Beach
Municipal Code requires that public improvements be
completed in commercial areas prior to the issuance
of Building Permits for a new structure.
11. The approval of Use Permit No. 3308 will not, under
the circumstances of this case, be detrimental to
the health, safety, peace, morals, comfort, and
general welfare of persons residing and working in
the neighborhood or be detrimental or injurious to
property and improvements in the neighborhood or
the general welfare of the City and further that
the proposed modification to allow the use of
compact parking spaces is consistent with the
legislative intent of Title 20 of this Code.
Conditions:
1. That the proposed development shall be in
substantial conformance with the approved site
plans, floor plans, elevations and sections, except
as noted below.
2. T:.at the on -site parking, vehicular circulation and
pedestrian circulation systems shall be subject to
further review by the City Traffic Engineer.
3. That the required number of handicapped parking
spaces shall be designated within the on -site
parking area and shall be used solely for
handicapped self parking and shall be identified in
a manner acceptable to the City Traffic Engineer.
Said parking spaces shall be accessible to the
handicapped at all times. One handicapped sign on
a post shall be required for each handicapped
space.
4. That a minimum of one parking space for each 225
square feet of net floor area shall be provided on -
site.
5. That a maximum of 25 percent of the required number
of off-street parking spaces may be compact spaces.

8. The following disclosure statement of the City of
Newport Beach's policy regarding the John Wayne
Airport shall be included in all leases or
sub -leases for space in the project and shall be
included in any Covenants Conditions, and
Restrictions which may be recorded against any
undeveloped site.
DISCLOSURE STATEMENT
The lessee, his heirs, successors and assigns,
herein, acknowledge that:
a.) The John Wayne Airport may not be able to
provide adequate air service for business
establishments which rely on such service.
b.) When an alternate air facility is available, a
complete phase out of jet service may occur at the
John Wayne Airport;
c.) The City of Newport Beach will continue to
oppose additional commercial area service
expansions at the John Wayne Airport;
d.) Lessee, his heirs, successors and assigns, will
not actively oppose any action taken by the City of
Newport Beach to limit jet air service at the John
Wayne Airport.
9. That all improvements be constructed as required by
Ordinance and the'Public Works Department.
10. That a standard use permit agreement and
accompanying surety be provided in order to
guarantee satisfactory completion of the public
improvements, if it is desired to obtain a building
