O oundine Lend Us The southerly portion of the subject property located at the northeasterly corner of Bristol Street North and Birch Street is currently undeveloped whereas the northerly portion of the site, is developed with an office f' building. To the northeast, is an office building and an athletic club; to the southeast are office uses; to the southwest, across Bristol Street North, is the right-of-way of the Corona dol Mar Freeway; and to the northwest, across Birch Street, is a mixture of office and industrial uses. At its meeting of February 4, 1988, the Planning Commission approved Amendment No, 658 which involved a request to amend the Newport Plane Planned Community District Regulations which,establishod provisions so as to ,. allow structures locatod in Industrial Site 3 A to be constructed In excess •,,�, of the 35 foot height limit, up to a maximum of 50 foot, subject to the approval of a use permit. The Planning Commission also approved Use Permit No. 3308 which included a request to allow the construction of three office buildings on a portion of the subject property (Parcels No, 1,2 and 3) which exceeded 35 fact In height. Said applications were subsequently approved by the City Council at its meeting of March 14, 1988 with the findings and subject to the conditions established by the Planning Commission. For the Planning Commission's information, staff has attached excerpts of the February 4, 1988 Planning Commission minutes and the March 14, 1988 City Council minutes. Analysis The existing parcels which comprise the subject property were established In conjunction with the approval of Resubdivislon No. 406 (recorded on November 21, 1973) and Rosubdiviaion Na. 52.9 (recorded on October 15, 1975). The applicant is proposing to resubdivide the subject property which includes 5.35 acres, into four parcels for office use. As indicated above, Parcels No, 1, 2 and 3 will Le developed In conjunction with the office development recently approved by the Planning Commlvslon and the 'City Council, whereas the proposed Parcel No. 4 is currontly developed with an existing office building. Vehicular Access As shown on the attached parcel map and as approved in conjunction with Use Permit No. 3308, vehicular access to Parcels No. 1, 2 and 3 will be provided ii by two drivoways; one on Birch Street and one on Bristol Street North, Due Lo the configuration of the proposed parcels and the limited number of permitted driveways, vehicular access to Parcels No. 1, 2 and 3 will be through reciprocal easements for ingress and egress. Staff has no objections to such an arrangement. Vehicular access for Parcel No, 4 will he from Birch Street and will be independent from Parcels No. 1, 2 and 3. a Specific Findings Saution 19.12.040 D of the Newport Bosch Municipal Code provides that the Planning Commission shall make specific findings in order to approve a resubdivision. Should the Planning Commission wish to approve the proposed resubdivision, the findings and conditions sot forth in the attached Exhibit W are suggested.
