SUBJECT: Back Bay Drive Landslide Cleanup
This memo is to apprise you of the status of the Planning Department's involvement in the
Back Bay Drive landslide cleanup process.
As you know, The Irvine Company has been working with the City to obtain the necessary
permits and approvals for the repair and cleanup of the slope failure that occurred adjacent
to Park Newport Apartments. On March 31st the Building Director, Grading Engineer and
I met with Tom Redwitz of TIC and his consultants to discuss the review and approval
process (see attached memo).
In our meeting we noted that the site is located in the Coastal Zone and the slide extends
into Upper Newport Bay, which is owned by the state and managed by the Department of
Fish and Game (DFG). Therefore, those agencies will also be involved in the review and
approval of the cleanup process.
The Coastal Act contains provisions allowing emergency repair work to be done prior to
issuance of a regular coastal development permit. In such situations, the City is required
to notify the Commission that the proposed action is emergency work, and'the applicant is
required to process a regular permit in a timely fashion. As you recall, this process was
followed recently for the properties with slope failures along Galaxy Drive.
Planning staff contacted the Coastal Commission to advise them that the City intends to
process this as an emergency repair. Coastal staff noted that they would accept this
determination only if no work is done within the bay under the emergency permit. They
indicated that the removal of material from the bay should be done under a regular permit,
which TIC will be required to obtain after the emergency repairs begin. TIC's engineer has
indicated that this procedure will be acceptable, and removal of the slide material will be
done in a 2-phase process. Coastal staff also requested written confirmation from the City
that the project constitutes an emergency. Ray Schuller prepared the attached letter to
satisfy this request.
Department of Fish and Game staff has already informed Tom Redwitz that the slide
material must by removed from the bay. From my conversations with DFG, it is not clear
precisely what type of approval will be necessary. In the case of the Galaxy Drive
properties, a temporary right of entry grant was issued by DFG with the requirement that
a permanent easement would also be processed. I have discussed this matter with Tom
Redwitz, and he will take the lead in obtaining DFG approval with City assistance, as
required. Since the Coastal Commission will not allow work in the bay prior to obtaining
a coastal development permit (2.3 months), timing for DFG approval is no longer on the
"critical path".
TIC intends to stockpile the slide material on the San Diego Creek South property (west
of MacArthur Boulevard and north of University Drive). TIC's engineer has submitted
revised grading and revegetation plans with all corrections requested by the Building and
Planning Departments, and grading permits were issued today.
TIC's contractor will immediately begin removing slide material. The work should
be completed by the end of May.
TIC will immediately begin processing a coastal development permit for the slope
repair.
TIC will obtain any necessary approvals or permits from the state Department of
Fish and Game for removal of material from the bay prior to issuance of a coastal
development permit.

In a meeting with Tom Redwitz and TIC's civil, geotechnical and landscape
engineers, city staff consisting of Rick Higley, John Douglas and myself
discussed what needs to happen to facilitate cleanup of Back Bay Drive.
1. Prepare preliminary grading and landscape plans by Thursday,
April 8, 1993.
2. Engineers to meet with Rick Higley, Thursday, April 8, 1993.
3. Applicant to obtain city approval of grading and landscape plans and
obtain grading permit by Thursday, April 15, 1993,
4. Bids, letting contract, start work, Thursday, April 29, 1993.
5. Complete work and open Back Bay Drive, Thursday, May 27, 1993.
Other Tasks:
A.
TIC's landscape architect will check
with Fish and Game regarding
planting/seeding criteria.
B.
City will write "Urgency Repair" letter
to Coastal Commission to expedite
their review and approval process.
C.
TIC's consultants to prepare and submit final "As Built" plans to Rick
Higley for city files.
D.
TIC to provide performance agreement
for the purpose of permanently
establishing plant growth in the permit
area.

Dear Ms. Vaughn:
Back Bay Drive at the 500 block has been closed to the public since January 24,
1993 due to a massive landslide triggered by heavy rain.
Due to the extensive public use of this road by naturalists, schools, joggers and
bicyclists, there exists an urgent need to remove this debris and reopen Back Bay
Drive in the interest of public welfare and safety. Additionally, this slide
constitutes a potential threat to life and property at Park Newport Apartments.
To accomplish the removal of approximately 3500 yards of earthern material and
redeposit it at a fill site near University Road southwest of MacArthur Blvd. has
been worked out between the City of Newport Beach and the Irvine Company, and we
are proceeding with this emergency repair work and would appreciate a quick
administrative review and approval by your agency.
The second site which requires emergency cleanup is 800 San Joaquin Hills Road.
The required grading work only involves 100 cubic yards.
Please contact Genia Garcia at (714) 644-3200 in regards to these projects. She
will be sending you the Approval -In-Concept letter and three sets of plans needed
for your review.
