The proposed amendment involves a request to delete a previous condition of approval of said use permit which required the removal of the building at the conclusion of the project sales activity, so as to allow the structure to be retained as a private community recreational facility. Environmental Significance This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). TO: Planning Commission - 2. Conformance with the General Plan The Land Use Element of the General Plan designates the site for "Single Family Attached" uses. The proposed private recreational facility is a permitted use within this designation. Subject Property and Surrounding Land Uses The subject property is part of the Villa Balboa Condominium development and is currently developed with a building which, is used as offices in support of the sales activities associated with the last phase of development within the Versailles Planned Community. To the north of the Villa Balboa Condominiums is the Versailles Condominiums; to the east is the upper portion of Hoag Hospital; to the south is the Hoag Hospital Cancer Center currently under construction; and to the west, across Superior Avenue, is the Newport Crest Condominium development. Background At its meeting of February 18, 1971, the Planning Commission approved Use Permit No. 1514 which permitted the construction of a temporary rental/model pavilion and related parking area for the rental of units in the "Versailles on the Bluffs at Newport" Planned Community. Said action was taken with the findings and subject to the conditions of approval set forth in the attached excerpt 'of the Planning Commission minutes dated February 18, 1971. In accordance with Conditions No. 4 and No. 5, the temporary rental/model facility was permitted for two years at the end of which time the building was to be removed from the site. At its meeting of January 22, 1973, the City Council approved a settlement agreement with the original project developer, which established the allowable development limits for the remaining development of the Versailles Planned Community. Said agreement also included language which allowed the temporary rental/model facility to be remodeled and retained for general office use in conjunction with the display and sale of said development. However, it should be noted that the settlement agreement did not eliminate the previously approved Use Permit No. 1514, but only extended the effective period of the use permit until the conclusion of the sale of condominium units within the project, at which time said building is required to be removed from the site. Analysis The property containing the subject building is currently owned by the applicant, Villa Balboa Community Association, who received the complex from Summerhill Development Company which is the current developer of the last three condominium lots within the project. In accordance with the applicant's agreement with the developer, Summerhill Development Company is required to demolish the subject building and construct a parking lot in its place, unless the Villa Balboa Community Association decides to retain TO: Planning Commission - 3. the structure for a private community recreational facility. As reflected in the subject application and the attached plans, the Community Association has opted to retain the structure and use it for a private community recreational facility. Said facility will contain 5,280 square feet and will include a lounge/meeting room with bar, an exercise room, a library/conference room with a service kitchen, two hobby rooms, a storage room, and two offices to be use by the Villa Balboa Community Association. As indicated in the applicant's statement of purpose for the subject use permit, the activities for which the facility will be used include, Board of Directors, committee and membership meetings, social -and recreational functions such as, exercising, hobbies, cooking and reading. Management and maintenance offices and storage for equipment and records are also planned. No commercial enterprises are proposed for the structure and no portion of the property will be rented for any purpose. It should also be noted that although the subject building was originally approved as a temporary structure, its actual construction was permanent in nature. Therefore, the subject building will be compatible with the surrounding development. Staff has no objections to the applicant's request to retain the structure. Off -Street Parking As shown on the attached Villa Balboa Site Plan, there are currently 250 open parking spaces within the Villa Balboa Condominium development. The Community Association is also arranging for the construction of 12 additional parking spaces, 5 of which will be located adjacent to Paris Lane and 7 adjacent to Cagney Lane, in front of the community recreation building. The twelve proposed parking spaces will bring the total number of open parking spaces to 262. It should also be noted that although only 7 parking spaces will be immediately adjacent and available to the community building, there are 31 parking spaces on Stare Lane which will be available to the community building for visitor parking. In accordance with the parking requirements set forth in the Versailles Planned Community Development Regulations, 737 parking spaces are required for the 449 dwelling units within the project. Of the parking spaces provided, a minimum of 449 spaces must be covered (one covered parking space for each unit). The project provides 566 covered parking spaces; therefore, the total parking provided will be 828 spaces (566 covered spaces + 262 open spaces = 828 spaces). It is staffs opinion that the amount of covered and open parking spaces provided are adequate for the overall development. Soecific Findings -and Recommendation Section 20.80.060 of the Newport Beach Municipal Code provides that in order to grant any use permit, the Planning Commission shall find that the establishment, maintenance or operation of the use or building applied for will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, morals, comfort, and general U TO: Planning Commission - 4. welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Should the Planning Commission wish to approve Use Permit No. 1514 (Amended), the findings and conditions of approval set forth in the attached Exhibit "A" are suggested. Inasmuch as the subject project is consistent with the Land Use Element of the General Plan and the requirements of .the Versailles Planned Community Development Regulations, staff cannot reasonably make findings for denial and, therefore, no exhibit for denial has been provided. However; the possibility remains that information may be provided at the public hearing which may provide adequate basis for denial of the project should the Planning Commission wish to take such an action.
