Request to permit the establishment of a specialty food service use on property located in the RSC
District.
The Planning Department on December 28. 1994, approved the application subject to the following
conditions:
1. That development shall be in substantial conformance with the approved site plan, and floor
plan, except as noted in the following conditions.
2. That maximum seating and/or stand-up counter space for no more than 20 customers shall be
maintained inside the subject specialty food use. Any further increase in the number of seating
and/or stand-up counter space for customers shall be subject to the approval of a use permit.
That no tables located outside of the subject facility shall be permitted unless an amendment to
this application is first approved or unless otherwise approved by the Planning Department.
4. That trash receptacles for patrons shall be conveniently located both inside and outside of the
proposed facility.
5. That trash generated by the business shall be screened from view from adjoining properties except
when placed for pick-up by refuse collection agencies. A trash enclosure shall be provided for any
dumpster units at the rear of the property. Also, any mechanical equipment shall be screened from
view of adjacent properties and the public alley and street.
6. That the hours of operation shall be limited between the hours of 6:00 a.m. and 10:00 p.m., daily.

7. That no outside paging system shall be utilized in conjunction with this specialty food
establishment.
8. That should this business be sold or otherwise come under different ownership, any future owners
or assignees shall be notified of the conditions of this approval by either the current owner or the
leasing company.
9. That no on -sale alcoholic beverages shall be permitted on the premises.
10. That no live entertainment or dancing shall be permitted in conjunction with the permitted use.
11. That no temporary "sandwich" signs or similar temporary signs shall be permitted, either on -site or
off -site, to advertise the specialty food establishment.
12. That kitchen exhaust fans shall be designed to control smoke and odor to the satisfaction of the
Building Department.
13. That where grease may be introduced into the drainage systems, grease interceptors shall be
installed on all fixtures as required by the Uniform Plumbing Code, unless otherwise approved by
the Building Department and the Utilities Department.
14. That the Planning Department may add to or modify conditions of approval to this specialty food
service permit, or recommend to the Planning Commission or City Council the revocation of this
permit upon a detern ination that the operation which is the subject of this approval causes injury,
or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community.
The Planning Department determined in this case that the proposal would not be detrimental to
persons, property or improvements in the neighborhood and that the specialty food services permit as
approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal
Code, and made the following findings:
That the proposed specialty food service is retail in nature, serving mainly persons residing or working
in the neighborhood, maintains a gross floor area of 2,000 sq.ft. or less, and is not necessarily a
destination point. It is anticipated that the proposed use will have parking demand characteristics
similar to a retail use.
1. That the proposed development is consistent with the Land Use Element of the General Plan (and
the Local Coastal Program), and is compatible with the surrounding land uses.
2. That the required number of off-street parking spaces exist for the proposed specialty food
establishment as required by Chapter 20.72 of the Municipal Code.

3. That the approval of Specialty Food Service Permit No. 24 will not, under the circumstances of
this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of the
city.
NOTE: This approval shall expire unless exercised within 24 months from the end of the appeal
period, and cannot be extended.
The decision of the Planning Department may be appealed by the applicant to the Planning
Commission within 14 days of the date of the decision. Any appeal filed shall be accompanied by a
filing fee of $399.00,

SUBJECT: Application for The Health Emporium at
3347 E. Coast Highway.3n7Corona:del'Mar.
The Corona del Mar Chamber of Commerce supports the request
of Torin Pavia and Seth. Siegel for their market plans at the
above address. Our City Council has repeated many times that
they are "business friendly" and we need some of that friend-
liness'shown in this endeavor to supply a demand for this type
of business in Corona del Mar.
Several markets at this location have failed and it is felt
this enterprise is needed for the community and will be very
successful. That success will benefit the surrounding busi-
nesses, supply much needed revenue to this city and fill a
need in our business retail mix.
The Chamber will assist the applicants in whatever way is
needed to enable them to complete their plans for this loca-
tion.

DEAR MRS GARCIA,
PURSUANT TO OUR TELEPHONE CONVERSATION THIS DATE REGARDING
THE REFERENCED MARKET ESTABLISHMENT, THE FOLLOWING RESTATES
THE ON GOING PROBLEM WE HAVE HAD WITH THE OPERATORS OF THE
SUBJECT BUSINESS.
THOUGH THE CONSTRUCTION REMODELING HAS STOPPED AT THIS TIME, I
WOULD LIKE TO ESTABLISH THE PROBLEMS WE HAVE HAD WITH THE
OPERATORS OF THE REFERENCED MARKET.
IT IS MY BELIEF, AFTER SPEAKING TO THE CITY CODES ENFORCEMENT
DEPARTMENT AND THE NEWPORT BEACH POLICE DEPARTMENT, THE
CONSTRUCTION HOURS CODE ALLOWS CONSTRUCTION BETWEEN 7 AM
AND 6 PM MONDAY THROUGH FRIDAY, 9 AM TO 6 PM ON SATURDAYS AND
NO WORK ON SUNDAYS.
WHAT ACTUALLY HAPPENED WAS WORK COMENCMENT AT THE EARLY
HOURS OF 5:30 AM MOST DAYS UNTIL SOMETIMES AS LATE AS 9 PM. WE
DISCUSSED THE DISTURBANCE WITH THE OWNER ONLY TO BE LAUGHED
AT AND IGNORED.
I CALLED THE POLICE NUMEROUS TIIviES AND WAS TOLD THE AREA WAS
THAT OF OFFICER EVANS AND HE WOULD PUT A STOP TO THE EARLY AND
LATE NOISE. THIS NEVER HAPPENED. IN FACT WE FINALLY QUIT CALLING
THE POLICE.
SEPTEMBER 5, 1995 WE LEFT ON AN EXTENDED VACATION, HOPING THE
CONSTRUCTION WOULD BE COMPLETE BEFORE WE RETURNED. WE
RETURNED OCTOBER 7, 1995 ONLY TO FACE GREATER PROBLEMS. THE
NEW AIR CONDITIONER AND FREEZING UNTP MOTERS WERE INSTALLED ON
THE ROOF TOP OF THE EMPORIUM AND THOUGH THEY POSE NO NOISE
PROBLEMS DURING THE DAY, IT IS A DIFFERENTSTORY AT NIGHT. THIER
DRONE THROUGHOUT THE NIGHT DISTURBS OUR SLEEP.

I SPOKE TO THE PROPRIETOR SETH SIEGEL ABOUT THE DISTURBANCE AND
HE ASKED ME NOT TO DISCUSS THE PROBLEM WITH THE CITY AND AS
SOON AS HE WAS GIVEN THE RELEASE ON HIS PERMIT, HE WOULD BUILD A
NOISE BARRIER AROUND THE MOTERS AND DEFLECT THE NOISE. THAT
CONVERSATION TOOK PLACE ABOUT OCTOBER 10. SINCE THAT TIME
THERE HAVE BEEN SO MANY OTHER DISTURBANCES OF EARLY AND LATE
DELIVERIES, CONSTRUCTION AND CLEANING SERVICES, AND WITH HIS
FAILURE TO SOLVE PROBLEMS WITH HIS NEIGHBORS, I DECIDED I SHOULD
DISCUSS THESE PROBLEMS WITH THE CITY BUILDING DEPARTMENT. THAT
IS THE PURPOSE OF THIS LETTER.
IN THE LAST WEEK OF OCTOBER, THE EMPORIUM, WITHOUT NOTICE BY
ANYONE, CONVERTED THE PARKING LOT ADJACENT TO OUR HOUSE INTO
A TENT COVERED DINING ROOM COMPLETE WITH A ROCK BAND. THEY
ALSO CLOSED OFF MARIGOLD AVE AND ADJACENT ALLEYS WITH CITY
FURNISHED BARRICADES. THE NOISE WAS SO LOUD, WE LEFT FOR THE DAY
AND RETURNED AT APPROXIMATLY 9 PM.
AFTER THE GRAND OPENING CELEBRATION, THE CLEAN UP CREWS
WORKED UNTIL AFTER MIDNIGHT WITH "GETTO BLASTERS" PLAYING. WE
HAD NO SLEEP OR REST UNTIL AFTER THAT.
SINCE THE GRAND OPENING NIGHT, EVEN THOUGH WE HAVE DISCUSSED
THE NOISE PROBLEM WITH SETH SIEGEL, THE OWNER, HE HAS IGNORED US
AND THERE CONTINUE TO BE UNREASONABLE PRE 7 AM NOISES INTO THE
LATE HOURS EACH DAY.
ON NOVEMBER 30, AFTER AN UNREASONABLE AMOUNT OF EARLY 6 AM
NOISES CREATED BY DELIVERY TRUCKS AND THIER LOUD REFRIGERATION
MOTERS DISTURBING US INSIDE OUR HOUSE AND RATTLING OU WINDOWS,
PICTURES AND CHINA, I AGAIN DISCUSSED THE PROBLEM WITH MR.
SIEGEL. HE MADE A PROMISE THIS WOULD NOT HAPPEN AGAIN.
AT 7.30 PM DECEMBER 1, A LARGE BIG RIG TRUCK PULLED INTO THE
PARKING LOT AND PARKED THE CAB ADJACENT TO OUR HOUSE, ENGINE
RUNNING AND UNLOADING THE SUPPLYS, RATTLING OUR INSIDE FIXTURES
AND DISTURBING THE PEACE OF OUR HOME.
ON THE MORNING OF DECEMBER 5, AT 4:30 AM, THE EMPORIUM'S
CLEANING SERVICE COMMENCED UNLOADING EQUIPMENT, BUCKETS ETC
ADJACENT TO OUR HOUSE, AWAKENING US FOR THR DAY.
BOTH WE AND OUR NEIGHBORS ARE CONCERNED ABOUT THE
UNREASONABLE DISTURBANCES CAUSED BY DELIVERIES AND CLEANING
PEOPLE DURING THE EARLY MORNING HOURS PRIOR TO 7 AM AND AFTER 6
PM. WE CANNOT BELIEVE THE CITY WOULD ISSUE A USE VARIANCE TO A
STORE OPERATOR THAT WOULD ALLOW THEM TO OPERATE IN THIS
MANNER.
WE ARE CONVENCED MR. SIEGEL HAS NO INTENTION OF COOPERATING
WITH US BECAUSE HE HAS FAILED TO KEEP HIS MANY -PROMISES.
THE PRIME PURPOSE OF THIS LETTER IS TO SEEK ASSISTANCE AND ADVICE
FROM THE CITY TO SOLVE A SITUATION WE BELIEVE CAN BE RESOLVED
BY THE CITY, BY PUTTING MR SIEGEL ON NOTICE OF WHAT I UNDERSTAND,
IS VIOLATING IRS USE VARIOUS CONDITIONS.

It is my understanding that the Health Emporium located next door to my business was
originally approved for amaximum seating of 20 people yet they are currently seating
anywhere from 40 to 50 people. This is very much a concern to me and to the operation of
my business. There are four business's within our building complex (Fast Eddies Barber
Shop; The Health Emporium; Corona Del Mar Florist; and The Toy Boat Store) and we all

We believe that the Health Emporium is operating in violation oftheir original approval by
the City ofNewport Beach and it is making it very difficult for the othf

Subject: Specialty Food Service Permit No. 24
Dear Messrs. Pavia and Siegel:
On December 15, 1995, at the time we received the acoustical engineering report, we had
a conversation with Mr. Pavia, while in the parking lot, relative to future noise complaints.
At the time of that discussion we cautioned Mr. Pavia relative to noise generated by early
morning deliveries and cleaning services that are disturbing to the residential community.
In spite of this warning we have received another complaint relative to deliveries that are
occurring as early as 5:30 a.m.
If these early morning noise disturbances are not eliminated immediately your specialty
food service permit will be conditioned by the Planning Department such that you will not
be allowed any deliveries prior to 7:00 a.m. May we remind you, your Specialty Food
Service Permit was issued with the following condition:
Condition No. 14 That the Planning Department may add to or modify conditions
of approval to this specialty food service permit, or recommend to the Planning
Commission or City Council the revocation of this permit upon a determination
that the operation which is the subject of this approval causes injury, or is
detrimental to the health, safety, peace, morals, comfort, or general welfare of the
community."
It is also hoped that once you have installed the rigid insulation around the compressor
and air conditioning units, as recommended by your acoustical consultant, the various
noises that are still emanating to the residential uses will be reduced to a point that is
acceptable. This insulation was is to be completed, as you will recall, by January 15,
1996. \
The City would like to thank you for your consideration and help in resolving this matter
in a timely and amicable fashion.
