The public hearing was opened in connection with this item, and
Mr. Tom Redwitz appeared before the Planning Commission on
behalf of the applicant, and he concurred with the findings and
conditions in Exhibit "A".
Ms. Deborah Allen, 1021 White Sails Way, appeared before the
Planning Commission on behalf of the Harbor View Hills
Association, and she indicated that the Association has no
objections with the proposed signs, and the one specifically located
at the corner of East Coast Highway and MacArthur Boulevard.
On behalf of herself she expressed her appreciation for the
sensitive and helpful ways that The Irvine Company has tried to
make Fashion Island and Newport Center more viable.
There being no others desiring to appear and be heard, the public
hearing was closed at this time.

Commissioner Ridgeway concurred with the comments expressed
by Ms. Allen. He emphasized that he would like to see the
existing pylon signs on Newport Center Drive at East Coast
Highway provide a list of the major tenants located in Newport
Center and Fashion Island.

Commissioner Merrill concurred that directional signs on East
Coast Highway would indicate to the public the establishments
that are located in Newport Center, and the signs would
demonstrate that the facilities meet the needs of the residents so
they would not have to leave the City for services.
Discussion ensued wherein Mr. Hewicker explained that inasmuch
the subject pylon signs are located in the public right-of-way,
additional signage would require the approval of the City Council.

Motion was voted on, MOTION CARRIED.
FINDINGS:
1. That the proposed altered signs and the proposed new
monument signs will be compatible with surrounding land
uses.
2. That the proposed changes to the signs and the proposed
new monument signs will not have any significant
environmental impact.
3. That the permanent identification signs within the O-S
District are consistent with the intent of said District,
inasmuch as adequate landscaping is installed in the areas
surrounding the signs.
4. That the modification to the Zoning Code to allow the
proposed sign in the APF-H District in excess of 100 square
feet is consistent with the legislative intent of the Zoning
Code inasmuch as the area of sign copy proposed is
consistent with the signs previously approved by Use Permit
No. 3131 (Amended).
5. That the granting of this exception permit will not be
contrary to the purpose of Chapter 20.06 of the Municipal
Code, or the Big Canyon Planned Community Development
Standards, and will not be materially detrimental to the

health, safety, comfort or general welfare of persons
residing in the neighborhood, or detrimental or injurious to

6. The approval of Use Permit No. 3131 (Amended) will not,
under the circumstances of this case, be detrimental to the
health, safety, peace, morals, comfort and general welfare
of persons residing and working in the neighborhood, or be
detrimental or injurious to property or improvements in the
neighborhood or the general welfare of the City.
CONDITIONS:
1. That proposed monument signs and alterations to the
existing cube signs and monument signs shall be in
substantial conformance with the approved plot plans and
elevations, except as noted below.
2. That letters and/or images may be imposed on two faces of
each cube sign (Types A & 13) only and limited to one side
of the monument signs (Type C).
3. That the signs shall identify only Newport Center/Fashion
Island, and the names of major tenants occupying space in
Fashion Island.
4. That the illumination of the signs shall be designed and
maintained in such a manner as to minimize light spillage
and glare to the adjoining streets and properties.
5. That the proposed signs placed at the intersection of any
street rights -of -way or private drive shall conform to the
City's Sight Distance Standard 110-L for sight distance.
Slopes, landscape, walls and other obstructions shall be
considered in the sight distance requirements. Landscaping
within the sight line shall not exceed twenty-four inches in
height.

Application
This is a request to amend a previously approved use permit and a modification to the
Zoning Code that permitted the installation of various ground identification signs at major
entrances to Newport Center. The proposed amendment involves a request to modify
Condition of Approval No. 3 of Use Permit No. 3131 (Amended) so as to add the names
of major tenants occupying space in Fashion Island to the existing signs where the existing
condition of approval restricts such identification.
The proposal also includes a modification to the Zoning Code so as to allow a new Fashion
Island/Newport Center identification sign, including names of major tenants in Fashion
Island, on the southeasterly corner of Jamboree Road and San Joaquin Hills Road in the
APF-H District where the sign area will exceed the permitted 100 sq.ft. Section 20.06.100
provides that a modification may be granted to allow deviations to the heigb4 number and
area of permitted signs.
An exception to the Sign Code is also requested so as to allow a similar off -site Fashion
Island/Newport Center identification sign at an off -site location, on the northeasterly comer
of Jamboree Road and San Joaquin Hills Road in the commercial area of the Big Canyon
Planned Community. Six of the subject signs are located in the O-S (Open Space) District.
Section 20.52.050(d) of the Zoning Code provides that structures and uses which are not
permitted uses, but are consistent with the intent of the O-S District, may be permitted,
subject to the securing of a use permit in each case. Use permit procedures are set forth
in Chapter 20.80 of the Zoning Code. Exception permit procedures are set forth in Section
20.06.090 of the Zoning Code.
Environmental Shmificance
The proposed signs have been reviewed and it has been determined that they are
categorically exempt under Class i1 (Accessory Structures) from the requirements of the
California Environmental Quality Act.
Conformance with the General Plan
The Land Use Element of the General Plan designates the location of Signs No. 2, A 1, B-1,
B-3, B-40 C 2 and C-3 for "Administrative, Professional and Financial Commercial" uses.
Signs No. 3, A2 and C-1 are•within areas designated for "Government, Educational and
Institutional Facilities". Signs No. 1 and B-2 are located on parcels designated for
"Recreational and Environmental Open Space". The General Plan does not address the use
of temporary or permanent signs. Therefore, no conflict appears to exist.

Subject Properly and Surrounding Land Uses , .
All of the proposed signs, with the exception of the one sign located in Area 15 of the Big
Canyon Planned Community, are located within Newport Center, which is generally bounded
by San Joaquin Hills Road, MacArthur Boulevard, East Coast Highway, and Jamboree
Road. Newport Center contains a variety of land uses, including offices, retail stores,
restaurants, hotels and residences. The areas to the north, east and south of Newport
Center are developed with residential uses. To the west is the Hyatt Newporter Resort
Hotel and a vacant piece of land designated on the General Plan for "Low -Density
Residential" use.
Background
At its meeting of January 24,1985, the Planning Commission approved Use Permit No. 3131
that permitted the installation of various ground identification signs at the major entrances
to Newport Center, with the findings and subject to the conditions of approval as provided
in the attached excerpt of the Planning Commission minutes dated January 24, 1985.
At its meeting of October 5,1989,.the Planning Commission approved Use Permit No. 3131
(Amended), a request to allow the addition of raised letter signs to the existing cube and
pylon signs which identify Fashion Island and the activities within the center. The words
"Newport Center/Fashion Island", The Irvine Company's logo and identification of activities
associated with the center were approved to appear on only two sides of each cube sign and
the square footage was limited to a maximum of 125 sq.ft. The identification of buildings
or tenants occupying space within Newport Center/Fashion Island was also prohibited
[Conditions No. 2, No.3 and No. 4 of Use Permit No. 3131 (Amended)]. The existing signs
were also approved to allow two neon strips around the top of each of the cube signs.
Excepting the neon strips, all cube signs are externally illuminated. An excerpt of the
minutes of that meeting are attached for the Commission's information.
Analysis
Two new ground signs are proposed to be constructed and nine ground signs are proposed'
to be altered in Newport Center. A third new sign, an off -site ground sign, is also proposed
to be constructed on property located in Area 15 of the Big Canyon Planned Community
District at the northeasterly corner of Jamboree Road and San Joaquin Hills Road. Two
of 'the ground signs, are 8 foot cubes(Type A), four signs are 11.5, foot cubes (Type B) and
the remaining six are 11.5 foot high by 11.5 foot long by 2 feet deep monument signs (Type
C). The applicant proposes to add additional raised letters to each cube -sign and to the
single faced monument signs which will identify major tenants which occupy space in
Fashion Island. Two neon strips will be installed on all of the new signs, to be consistent
with the existing signs that were approved by the Planning Commission. The characteristics
of each type of ground sign are described below:

As shown in the table above, the proposed square footage of proposed signage on each of
the sign is well below the permitted 125 sq.ft. approved by Use Permit No. 3131 (Amended).
The various discretionary approvals of the previous Use Permit No. 3131, Use Permit'No.
3131 (Amended) and the proposed changes are discussed in the following paragraphs:
The applicant is proposing to add additional copy to the four existing 11.5 foot "Type B"
cube signs and two "Type C' monument signs on six parcels within the O-S Districi
identifying major tenants in Newport Center/Fashion Island (Signs No. B-1, B-29 B-39 B-4
and Signs No. C-2 and C-3 on the attached location map.) These parcels are located at the
southwesterly and southeasterly corners of San Joaquin Hills Road and Santa Rosa Drive;
at the southwesterly and southeasterly corners of San Joaquin Hills Road and Santa Cruz
Drive; and at the northwesterly and southwesterly corners of MacArthur Boulevard and San
Miguel Drive. Due to the size and location of these parcels, and the existing landscape
treatment, staff is of the opinion that the proposed additional copy to the signs is consistent
with the intent of the open space designation.
It should be noted that the previously approved Use Permit No. 3131 permitted the
construction of two "Type B" cube signs at the northwesterly and southwesterly corners of
MacArthur Boulevard and San Miguel Drive (Signs No. C-2 and C-3 on the attached
location map). However, the applicant desired to construct the smaller 'Type C" single -
faced monument signs rather than the cube sign. Staff considered the smaller signs to be
in substantial conformance with the approved plan, and permitted the substitution.

Ground Sign in the Newport Village Planned Community
Use Permit No. 3131 also permitted the construction of a 58 foot high, 348 sq.ft. pylon sign
to be constructed at the'southwesterly corner of San Joaquin Hills Road and MacArthur
Boulevard (Sign No. C-1 on the attached location map). However, the applicant desired to
construct the smaller "Type C' single -faced monument sign rather than the pylon sign. Staff
considered the smaller sign to be in substantial conformance with the approved plan, and
permitted the substitution. The existing 132 sq.ft., 11.5 foot high "Type C' monument sign
is also proposed to have its copy altered to add the names of major tenants occupying space
in Fashion Island.
Ground Sigma in the A-P and APF-H Districts
The applicant is proposing to erect a new 132 sq.ft., 11.5 foot high'Type C' monument sign
(Sign No: 2 on the attached location map) within the APF-H District 'located at the
southeasterly corner of Jamboree Road and San Joaquin Hills Road. A modification to the
Sign Code is required, since the APF District permits a sign area of 100 sq.ft. on a site.
Staff has no objections to the applicant's request, inasmuch as this monument sign is similar
to the "Type C" signs which currently exist at the intersection of MacArthur Boulevard and
San Miguel Drive, and at MacArthur Boulevard and San Joaquin Hills Road.
An 8 foot high 'Type A" cube sign, which is proposed to have its copy altered, is located on
the Newport Harbor Area Chamber of Commerce site at the southeasterly corner of Santa
Barbara Drive and Jamboree Road. (Sign No. A-1 on the attached vicinity map.) This
property is within the A-P District, where Section 20.06.050B of the Zoning Code allows a
maximum of one ground sign and a total of three signs per building site, the combined area
of which may not exceed 100 sq.ft. A modification to the Zoning Code was required
inasmuch as there were four signs on the subject property. A building permit was issued for
the installation of these signs in May of 1977. There is a ground sign adjacent to Jamboree
Road which identifies the Chamber of Commerce and other tenants occupying space in the
building. A similar ground sign is located adjacent to Santa Barbara Drive. Neither of
these ground signs is readily visible from the intersection of Jamboree Road and Santa
Barbara Drive. There are also two wall signs attached to the building which identify the
Newport Harbor Area Chamber of Commerce. One of these signs faces the intersection
of Jamboree Road and Santa Barbara Drive; the other is located on the building elevation
facing Jamboree Road. The identification sign for Newport Center is located in a
landscaped area in front of the Chamber of Commerce building. The sign is set back
approximately 30 feet from Santa Barbara Drive and 22 feet from Jamboree Road. Because
the existing ground and wall signs are located in such a manner that only two signs are
visible from any elevation, the Planning Commission made the determination that the
previously approved ground sign is consistent with the intent of the sign regulations for the
A-P District.

The applicant wishes to modify the 'Type X cube sign within the C-O-H District at the
northeasterly corner of Santa Barbara Drive and Jamboree Road (Sign No. A 2 on the
attached vicinity map). The sign is located on a parcel of land .that is presently used for
landscaping purposes. The Zoning Code permits one ground sign per site in the C-O-H
District, provided the lot maintains a minimum of 50 feet of frontage along the adjoining
street. The sign may not exceed a height of 25 feet or contain more. than 200 square feet
of sign area per face. The subject parcel maintains more than 50 feet of frontage along
Santa Barbara Drive and Jamboree Road, and the proposed sign conforms to all criteria for
ground signs in the C-O-H District. Therefore, this sign requires no discretionary approval
for the proposed change of copy.
The applicant also wishes to construct a new 'Type C" monument sign (Sign No. 3 on the
attached sign location map) within Area 5 of the Newport Village Planned Community
District at the northwesterly corner of MacArthur Boulevard and East Coast Highway. The
sign is located on a parcel of land that is presently vacant. The Newport Village Planned
Community Development Regulations permits signs in accordance with the Zoning Code,
which permits one ground sign per site, provided the lot maintains a minimum of 50 feet
of frontage along the adjoining street. The sign may not exceed a height of 25 feet or
contain more than 200 square feet of sign area per face. The subject parcel maintains more
than 50 feet of frontage along East Coast Highway and MacArthur Boulevard, and the
proposed sign conforms to all criteria for ground signs as required by Section 20.06.070 of
the Newport Beach Municipal Code. Therefore, this sign also requires no discretionary
approval for its construction or proposed copy.
The applicant wishes to construct a new 11.5 foot high "Type C" monument sign (Sign No.
1 on the attached sign location map) within Area 15 of the Big Canyon Planned Community
District at the northeasterly corner of Jamboree Road and San Joaquin Hills Road. The
sign is located on a parcel of land that is presently vacant. The Big Canyon Planned
Community Development Regulations permits signs in accordance with the Zoning Code,
which permits one ground sign per site, provided the lot maintains a minimum of 50 feet
of frontage along the adjoining street. The sign may not exceed a height of 25 feet or
contain more than 200 square feet of sign area per face. The subject parcel maintains more
than 50 feet of frontage along Jamboree Road and San Joaquin Hills Road, and the
proposed sign conforms to all criteria for ground signs as required by Section 20.06.070 of
the Newport Beach Municipal Code, except that it identifies an off -site use. Staff has no.
objections to the proposed location of the sign.

Applicant's Statement of Support
In accordance with Section 20.06.090B of the Newport Beach Municipal Code, in order to
grant an exception permit for an off -site sign, the Planning Commission must find that the
granting of •such permit is necessary to protect a substantial property right, will -not be
contrary' -to the purpose of Chapter 20.06, and will not be materially detrimental to, the
health, safety, comfort or general welfare of persons residing in the neighborhood, or
detrimental or injurious to property or improvements in the neighborhood, or to the general
welfare of the City.
In response to the above requirements, the applicant has submitted the following statements
in support of his application, a copy of the :
1.
"Fashion Island has begun to draw customers from a larger region. These customers
are less familiar with the surrounding road system. Therefore, identification on
major roads becomes critical. Monument signage is permitted, the exception is for
the off -site location."
2. What exceptional or extraordinary circumstances are involved? "Fashion Island
needs exposure to major streets because of its unique location."
3.

4. Why will the proposal not be detrimental to the neighborhood? "Fashion Island
customers need easy directional identifier."
Staff has no objections with the off -site sign in this particular case.
Proposed Revision to the Condition of Approval
The applicant proposes to modify Condition No. 3 of Use Permit No. 3131(Amended) so
as to allow the addition of the identification of major tenants and department stores present
in Fashion Island. Staff has no objections to the proposed signage, because of the unique
quality of the regional shopping center.
,Specific Findings and Recommendations
Section 20.80.060 of the Newport Beach Municipal Code provides that in order to grant any

CONDITIONS:
I. That proposed monument signs and alterations to the existing cube signs and

A & B) only and limited to one side of the monument signs (Type Q.
3. That the signs shall identify only Newport Center/Fashion Island, and the names of
major tenants occupying space in Fashion Island.

4. That the illumination of the signs shall be designed and maintained in such a manner
as to minimize light spillage and glare to'the adjoining streets and properties.
5. That the proposed signs placed at the intersection of any street rights -of -way or

distance. Slopes, landscape, walls and other obstructions shall be considered in the
sight distance requirements. Landscaping within the sight line shall not exceed
twenty-four inches in height.
6. That all previously applicable conditions of approval of Use Permit No. 3131 and

associate it as a destination place for serious shopping. This association can be
obtained by using the department store names in marketing and center signage.

The public hearing opened in connection with this item,
and Mr. Ron Hendrickson representing The Irvine
Company, appeared before the Planning Commission. Mr.
Hendrickson described the proposed landscaping plan for
Newport Center and the ground identification signs
located at the entrances.
Mr. Hendrickson stated that the Homeowner's
Associations surrounding Newport Center have reacted
positively to the proposed plans, and he indicated that
the landscape plan will be completed in early April.
Mr. Webb stated that an encroachment permit has been
requested by The Irvine Company for two pylon signs in

East Coast Highway. Mr. Hewicker advised that he was
not aware of such a request. Mr. Hewicker commented
that staff has requested a Planned Community
Development Plan for the entire Newport Center property
during the past several years.
Motion x Commissioner Eichenhofer made a motion to approve Use
All Ayes Permit No. 3131, subject to the findings and conditions
in Exhibit "A". MOTION CARRIED.
FINDINGS:
1. That the proposed signs will be compatible with

3. That the construction of permanent identification
signs within the 0-S District will not be
inconsistent with the intent of said District,
inasmuch as adequate landscaping will be installed

inconsistent with the legislative intent of the
Zoning Code inasmuch as no more than three signs
will be visible from San Joaquin Hills Road or
Jamboree Road.
5. That the proposed modification to the Zoning Code
to allow two ground signs on the site within the
Newport Village Planned Community will be
consistent with the legislative intent of the
Zoning Code inasmuch as the two signs will be more
than 1,400 feet apart and will be located at
separate street intersections.
6. The proposed modification to the Zoning Code to
permit a 58 ft. high ground sign will not be
incompatible with surrounding land uses or
contrary to the legislative intent of the Zoning
Code since the sign will be located in the
vicinity of several multi -story structures and
will maintain substantial setbacks from the
adjoining public streets. Also, adequate

of the site. Further, the area of the sign copy,
including the logo not shown on the elevations,
will not exceed 81.25 sq.ft.

detrimental to the health, safety, peace, morals,
comfort and general welfare of persons residing
and working in the neighborhood, or be detrimental
or injurious to property or improvements in the

parallel lines containing the wording and image

5. That the final. location of all signs shall be
approved by the City Traffic Engineer.
6. A landscape and irrigation plan for all areas
adjacent to the proposed signs shall be prepared
by a licensed landscape architect. The plan shall
be subject to the review and approval of the
Parks, Beaches and Recreation Department, the
Public Works Department, and the Planning
Department. Prior to final approval of building
permits for the signs, a licensed landscape
architect shall certify to the Planning Department
that the landscaping has been installed in
accordance with the approved plan.

The public hearing was opened in connection with this item, and
Mr. Dave Dmohowski, representing the applicant, appeared
before the Planning Commission. Mr. Dmohowski concurred
with the findings and conditions in Exhibit W. He stated that
the signs will improve the identification for Fashion Island on the
arterial streets surrounding Newport Center. Mr. Dmohowski
stated that the proposal is consistent with the intent of the
regulations and is compatible with the adjacent uses in the
surrounding neighborhood.
In response to a question posed by Commissioner Pers6n, Mr.
Dmohowski replied that he had read the letter addressed to the
Planning Commission from the Canyon Mesa Community
Association, dated September 29, 1989, regarding their concerns
with respect to the neon lights on the lights.
Mr. Noel Davies, Consultant for the Irvine Retail Company,
appeared before the Planning Commission. Mr. Davies described
the neon lights that will be installed on the top of the cube
signs. He stated that the double -banded light is pastel to add a
low level of light that will project only a few feet, .
There being no others desiring to appear and be heard, the
public hearing was closed at this time.
