SUBJECT: Temporga Use of Land
Request to allow the temporary installation of a 4,000 sq.ft. canopy to
handle overflow business and special events during the holiday season
at the Hyatt Newporter, on property located in the RSC District.
Municipal Code Re uirements for Temporga Use
Section 20.33.025 of the Newport Beach Municipal Code establishes a procedure whereby
the Planning Director or the Planning Commission may approve reasonable requests for
interim or temporary uses of land or buildings when such uses are consistent with the City's
General Plan and the health, safety, peace, comfort and general welfare of persons residing
or working in the neighborhood and do not violate any other ordinances and regulations of
the City.
Section 20.33.035 also establishes that the Planning Director may authorize the temporary
use of structures and land in any commercial district for a period of time not to exceed 90
days. Prior to approving a temporary use, the Planning Director is required to inform the
Planning Commission of the intent to permit the temporary use and take whatever steps or
precautions are necessary to assure that the use will be consistent' with the purpose and
intent of the Municipal Code and the land or building will be restored at such time as the
use is terminated.
The Planning Commission may authorize the temporary use of structures and land in any
commercial district for periods of time in excess of 90 days subject to the securing of a use
permit in each case. In approving the use permit the Planning Commission may impose
whatever conditions it deems necessary to assure that the purpose and intent of the Code
is carried out and shall establish a specific point in time when the permit is to be terminated
and the site restored.
The Planning Director and the Planning Commission may authorize extensions of time
subject to the procedures specified above.
Environmental Significance
This project has been reviewed, and it has been determined that it is categorically exempt
from the requirements of the California Environmental Quality Act under Class 11
(Accessory Structures).

The Land Use Element of the General Plan and the Local Coastal Program Land Use Plan
designate the site for "Retail and Service Commercial" uses. Hotels and hotel support
facilities are allowed within this category, subject to the approval of a use permit in each
case.
The property in question is a 25.7 acre site on the northwesterly corner of Jamboree Road
and Back Bay Drive. The existing facilities of the Hyatt Newporter include 410 guest rooms
and 26,453 square feet of banquet and meeting facilities approved by previous Use Permit
No. 3161. Portions of said approval have not been exercised or constructed by the
applicant). To the north and east of the site is the John Wayne Tennis Club and
undeveloped land; to the east, across Jamboree Road, is the Sea Island residential
community; to the west, across Back Bay Drive, is the Newport Dunes Aquatic Park; and
to the south, across Back Bay Drive, is undeveloped land.
Back2round
The Newporter Inn was approved by the County of Orange, by Use Variance No. 4897, on
April 10, 1962. The original hotel provided 103 rooms plus restaurants and banquet
facilities. The area was annexed to the City of Newport Beach on June 20, 1962.
The Planning Commission approved Use Permit No. 886 on September 20, 1962, which
allowed the addition of 103 rooms to the existing hotel (French Court Building).
On June 6, 1963, The Planning Commission approved Use Permit No. 958, which was a
request to permit the construction of a convention building (Plaza Ballroom).
At its meeting of January 7,1965, the Planning Commission approved Use Permit No.1099,
which allowed a private heliport for one year.
On June 20, 1968, the Planning Commission approved Use Permit No. 1355, which was a
request to construct 118 additional hotel rooms (Terrace Building and Carousel Room).
At its meeting of April 17,1969, the Planning Commission approved an amendment to Use
Permit No. 1355, to allow a 5,572 square foot kitchen and dining room addition (Marine
Dining Room).
At its meeting of August 8,1985, the Planning Commission approved use Permit No. 3161
which permitted the construction of additions and improvements to the hotel which
included: 104 additional guest rooms, a 1,200 square foot outdoor dining area addition; a
4,100 square foot addition to an existing ballroom, a cupola addition to an existing elevator
penthouse, and general remodeling of the hotel lobby, restaurants and meeting rooms. Said
action also included the approval of a Traffic Study.

On January 21, 1988, the Planning Commission approved Use Permit No. 3161(Amended)
and related Traffic Study and acceptance of an environmental document. The amendment
included a request to construct a new banquet/meeting room on a portion of the site which
was being used for off-street parking, the construction of a laundry facility and a 180t
square foot addition to the "net public area" of the existing Duke's Lounge. The proposal
also included a request to reduce the number of previously required parking spaces that
were approved in conjunction with a demonstrated parking formula, the construction of a
new access drive and circular drop-off adjacent to Back Bay Drive, and the approval of a
modification to the Zoning Code so as to allow the use of additional compact and tandem
parking spaces in conjunction with a valet parking service.
At its meeting of January4, 1990, the Planning Commissionapproved an amendment to Use
Permit No. 3161, which permitted the construction of additions and improvements to the
Hyatt Newporter and included the construction of a 1,722 sq.ft. addition to the housekeeping
facilities at the hotel.
Analysis
As indicated in the attached letter, the applicant proposes to install an enclosed canopy (40
feet by 100 feet) on a portion of the Hyatt Newporter site which is currently being used for
gated, valet parking. The subject canopy is 8 feet high along the outer perimeter and 16
feet high in the center. Events to be held in the canopy would include wedding receptions,
holiday theme parties and business functions. The applicant is requesting a time period of
107 days (September 15, 1994 through January 2, 1995) for the temporary canopy, and has
indicated that the reason for the extended time period which exceeds 90 days is to allow
time for adequate pre -sell of the event site for holiday theme parties. It is anticipated that
the months of September and October will primarily be used for pre -sale. Inasmuch as the
time period requested is exceeding the 90 day allowance for Planning Director approval by
only 17 days, the Planning Director has determined that such a request does not warrant an
amendment to Use Permit No. 3161 for the Hyatt Newporter, and requests that a condition
be included that will allow any extension of said time request to be reviewed for approval
by the Planning Director.
Parking Requirement
The subject site contains 746 off-street parking spaces. Use Permit No. 3161 (Amended),
which the Planning Commission approved on January 22, 1988, requires that 1.5 off-street
parking spaces for each guest unit be provided for the subject resort. The Hyatt Newporter
currently contains a total of 410 guest rooms, which based on the parking standard of 1.5
spaces per guest room, generates a demand for 615 parking spaces (410 x 1.5 = 615 parking
spaces). As noted on the attached site plan, the applicant proposes to install the subject
canopy in the gated parking area to the northeast of the main entrance to the resort. This
parking area contains 35 parking spaces, which when taken from the existing parking spaces,
leaves a total of 711 spaces, or a surplus of 96 parking spaces (711 - 615 = 96 surplus
parking spaces). Based on this surplus of available off-street parking spaces for the Hyatt
Newporter, staff has no objection to the proposed canopy location.

Conditions of Approval
It is the intention of the Planning Director to approve the proposed use subject to the
following conditions:
1. That the development shall be in substantial conformance with the attached plot plan
and floor plan.
2. That this approval shall be for an initial period of 107 days and may be extended by
the Planning Director.
3. That the application shall be subject to further review by the Building and Fire
Departments, that all required building and/or electrical, plumbing and mechanical
permits shall be obtained.
4. That the site shall be restored to an offstreet parldng lot at such time as the use is
terminated.
5. That the Planning Director may add to or modify these conditions of approval, or
recommend to the Planning Commission or the City Council on appeal, the
revocation of this permit upon a determination that the use which is the subject of
this permit causes injury, or is detrimental to the health, safety, peace, morals,
comfort or general welfare of the community.
