Dear Sir;
This lett,,r iry in answelu to your staff planning r riort rind
the action token by the Planning Coiamission in approving my
applic.tion for n_ use permit. The following conditions -ere set
.for approval of tart request.
1. "Thet this use permit be granted fpr a pne year period.
Any extensions subject to the approval of the Modifications Com-
mittee."
I agree to this condition.
2.."That one off-street parking space be provided for employees
in a location meeting the approval of the Director of Community
Development.'"
:I am enclosing a letter from the agent representing the owners
of the building directly across the street. In the letter he agrees
to the use of one off-street parking .pace ih. the let behind that
building located at '510 29th. St. Mr. Schworer asked in the letter
that where possible employees park away krom the congested area.
This is in line ;ith the wishes of most of the businesv people in
Canner,/ Village. As we are now running a shop directly across the
street from the new restaurant I would not expect adrlitional parking
will be required. ShouIa additional employees be required we have
-6he space indicated in the letter for their use.
3. "That one delivery space be provided in a location meeting
the approval of the Director of Community Development."
There is presently a green curb immediatly across the street
in front of 2815 Lafayette and a second green curb at the corner in
front of 2817 Lafayette. I am enclosing a street plan, drain on the
back of my submitte pL,n. for reference. On this plan I have mnrkt^a
in green the two green curb -real. I hope there are suitrble for your
requirments. This pl-nn also shows the loo-tion of tae off-rtreet
parking repaired to meet #2 above..

Analysis
As proposed, this facility, will be operated by two college students and their hours
of operation will depend upon the success enjoyed. The application states that all
food would be cooked off the premises and that sandwiches, salads, fruit, soft
drinks and soup will be packaged and boxed on the premises for carry out; primarily
intended to serve sailors using Transcon Sails and Schock's which are located on
either side of the facility. There would be some food preparation on the premises,
mainly sandwiches. The food supplies would be picked up by the operators from local
stores (such as Delaney's) and carried to the place of business. No food deliveries
are anticipated at this time.
The staff has checked with the Department of Public Works, the City Traffic Engineer,
h and the Director of Harbor E Tidelands. No objections have been received.
While parking is always a consideration in any new operation, it should be pointed ryr
out that there is no parking, required for any use permitted in the M-1 District.
Furthermore, it is felt that the operation, as proposed, will represent a service
to persons already in the area and will not attract additional traffic. However,
parking should be provided for the employees; and delivery space should be available
unless it can be clearly demonstrated that deliveries will not be required.
Recommendation
Staff recommends approval of Use Permit Application No. 1536 subject to the following
conditions-
1. That this Use Permit be granted for a one year period. Any extensions
subject to the approval of the Modifications Committee.
2. That one off-street parking space be provided for employees in a loca-
tion meeting the approval of the Director of Community Development.

Request to permit a "take-out" restaurant in a M-1 District.
LOCATION: Lot 9, Block 425, Lancaster's Addition, located at 2816 Lafayette
Avenue on the easterly side of Lafayette Avenue between 28th Street
and 29th Street.
ZONE: M-1
APPLICANT: J. N. Sherwood, Newport Beach
OWNER: A. Corgiat, Santa Fe Springs
Application
This application requests permission to operate a facility -for the preparation and
sale of box lunches for sailors and walk-in traffic. The business will primarily
serve sailors using the Transcon Sails and Schock's boats and existing commercial
and industrial facilities located adjacent to or near the proposed operation. In
accordance with Section 20.53.020 of the Newport Beach Municipal Code, take out
restaurants may be located in the M-1 District subject to the securing of a use
permit.
Subject Property and Surrounding Land Use
The room proposed to be used for the preparation and ale of the box lunches is a
part of the Transcon Sails building and has entrances from both Lafayette Avenue
and the boat rental area in the rear. The subject room is presently used as a
"lounge" for customers and employees of Transcon Sails. In the past, groups have
sent out for food and had lunch in this room either before or after a sailing
session. The room already contains certain food preparation facilities including
a refrigerator, sink, coffee maker, sandwich warmer, and cupboards. There is
also a counter with stools, some small round tables with chairs and upholstered
benches along two walls,
The adjacent area, within this building is used as the boat rental office and store-
room. There is a two bedroom apartment upstairs. The Rhine is to the rear, Schock's
boat storage and launching area is to the north, an upholstry shop is to the south,
and a general commercial building is to the west across Lafayette. There is
considerable manufacturing and ship repair in the immediate area as well as some
new specialty shops. There is no parking available op -site, but there is a small
number of on -street spaces;. Lafayette Avenue is improved Nith curbs, gutters
and sidewalks in front of the subject property.
