The travel trailer houses an office associated with the on -site boat building and repair business. The approval will allow retention until June 4, 1998. Said use is subject to the following conditions of approval: 1. That a building permit shall be obtained from the Building Department and the appropriate clean-up deposit shall be posted to insure maintenance and clean-up of the subject property after removal of the temporary trailer. 2. That the travel trailer shall not be utilized for overnight accommodation of any person on - site (residential uses are prohibited in this area). 3. That the travel shall be utilized only during regular business hours of the facility and/or between the hours of 7:00 a.m. and 6:00 p.m., daily. Any use of the trailer beyond those hours shall be first approved by an amendment to this approval. 4. That all employees shall park on -site. 5. That all patrons and vendors making deliveries shall be directed to park within the subject property and not along the public right-of-way on Newport Boulevard. Unless otherwise approved by the Public Works Department 6. That this temporary use shall terminate upon evidence that the facility is operating in violation of any of the above conditions of approval or upon receipt of unresolved complaints. 7. That the placement of the trailer shall be allowed for a period not to exceed 90 days from the date of approval. The trailer shall be removed by June 4, 1998 and the applicant shall schedule an appointment with the Code Enforcement Division for an inspection to determine compliance. 8. That this approval cannot be extended. Temporary uses in excess of 90 days shall be subject to the approval of a use permit approved by the Planning Commission. Attachments: Appendix Letter from Applicant dated April 10, 1997 Letter from the Applicant dated February 10, 1998 Plot Plan (Aerial Photo) APPENDIX Background and Code Violations Review of City aerial photographs indicates that the trailer was not present in 1995. Several months ago, Westport Marine placed the travel trailer in the parking lot of the facility. The Code Enforcement Supervisor visited the property in response to a complaint of a person sleeping in the trailer (the Municipal Code prohibits residential uses other than on a second floor of a building). The applicant was notified that the use of the trailer for overnight accommodations is prohibited. The applicant provided a letter dated April 10, 1997 (copy attached) in response to the Code Enforcement Supervisor's query. The applicant was informed that the placement of the trailer for temporary use for a period of 90 days is subject to approval of the Planning Director; and that periods in excess of 90 days is subject to the approval of the Planning Commission (Municipal Code Section 20.60.015, B and C, respectively), prior to placement. The applicant subsequently submitted this application and attached letter, dated February 10, 1998, describing the request for a temporary use for 90 days. Analysis According to the applicant, the trailer was placed for office use associated with the boat building and repair facility and will not to be utilized for overnight occupancy. The applicant wishes to retain the trailer for 90 days, after which time it will be removed. Staff has therefore conditioned the approval to prohibit the overnight use of the trailer and have further limited the hours of use of the trailer to coincide with the hours of operation of the facility stated in the letter of April 10, 1997. Recommendation Staff has no objection to the temporary use of the trailer for the following reasons: • The trailer will be utilized as an office use only with no overnight accommodation or use. • The hours of operation of the use of the trailer have been restricted to accommodate use as an office only. • Staff has limited the duration of placement of the trailer to 90 days from the date of this approval. Spray Painting: Except for air brushing, brush applied painting and, aerosol canned paint, all other paint is applied in.spray booths at Austin Plastics in Huntington Beach, Califomia,(714)-847-2223. Austin Plastics is owned and operated by Jeff and Jon Silver. The touch-up paint work is done accordingly to OSHA regulations and with approved products. A Major job done on the vessels that may have special APCD requirements is completed in a shipyard in a controlled environment. Please feel free to inspect the premises. I will be available at your convince to open the containers, office, trailer, and, paint lockers. The gate is open from 8:00am to 5:00pm, Monday through Saturday. While talking to Jay about this, Jim Sinasek overheard the conversation and added that he and Robin have been trying to set up a meeting with Mr. Minney regarding the trailer. I am making a copy of Mr. Minney's June 4, 1998, letter for Jim. (I put the original June 4 letter in the Temporary Use Permit file.)
