Schnndler and completed in 1926. His description of the original is: "The house is elevated above the beach on columns, the projection of five visible reinforced concrete frames forming an organic skeleton. The building is suspended by means of iron rods on five equal concrete frames." To gain privacy on•.the beach -front lot the ground level was left open for a play area,and the enclosed living space is at the second and third level. The 2-story living room has a glass wall to the ocean view, with a dining area at the north end of living space. Back of this is kitchen and maid' room and bath. on a balcony above the living room are four in -line bedrooms facing west; these are supported on the five concrete frames which are 2-stories high. The frames are locked together between ground and second level by two concrete stairs which rise at different angles,for floor plan and .aesthetic considerations. When the sleeping porch was enclosed the French doors lead- ing from all bedrooms to the porch were removed and adapted as windows to close in the porch. Although the extension of the bedrooms to the porch rail adds a more traditional look to the house it reduces some of the excitement of the com- position, i.e., a succession of frames surmounted by a broad horizontal band, with the presence of the bedrooms suppressed by their greater distance from the rail. How- ever, the contrast of white plaster and redwood window frames allows the top level to recede visually. On the roof is an area for sunbathing and.for viewing the ocean. Interior walls are of plaster; the floors and living room ceiling are wood. All windows are framed in wood, and in- corporated into the windows are geometric patterns, much in the Wrightian manner. The frames have begun to deter- iorate because of long exposure to ocean air. Schindler, now recognized in the U.S. and Europe as one of the great creative forces in the early Modern Movement in architecture. Various features of the housdhave been copied by the present generation of arch- itects, especially the clear expression of skeleton and the unsurfaced treatment of the concrete, the latter left as it comes from the forms. An early disciple of Frank Lloyd Wright, and employed in his office for six years, Schindler shows a debt to Wright in the geometrical patterns in the wood trim and ornament. The aesthetic force of the house might be summed up as follows: For the first time skeleton was expressed as distinct from enclosure. A pattern of solids and voids was created by the use of broad horizontal advancing planes poised in front of areas which receded due to the inherent dark values of glass. A composition which as successfully as any other of the period brought into balance numerous disparate elements. LOVELL, 1242 W. OCEAN FRONT In a letter dated February 4, 1974, addressed to the City Council, Mr. Gary B. Lovell requested'that an historical zone property contract be established with the City for his residence located at 1242 W. Ocean Front. P Mr. Lovell originally contacted the Orange County Board of Super- visors who referred him to the City of Newport Beach. In a letter dated September17, 1973, to the Orange County Board of Supervisors, Mr. Lovell described his home, built in 1926. He stated that the plans were recorded in 1968 by the U. S. National Parks Service in the Historic America Buildings Survey in cooperation with various local university groups. The preamble document recording the plans describes the structure's significance as follows: "The Lovell Beach House, R. M. Schindler's most important building, dating from 1926, is a precursor of post-war profilist design of unsurfaced concrete. The house is lifted atkgve its beach site and cradled in five concrete frames i#r the shape of figure 8's which were poured in place. .The enclosed areas were shop -fabricated and hoisted into position. The play of forms in the advancing and receding planes are close to the De Stijl movement begun in Holland in 1917." The letter also stated that the nearly 50 year old structure is currently in need of repair and, because of the obvious, expenses involved, the owners are asking for various tax and other incentives to maintain such an historic property. California's Public 'Resources Code, Section 5031, and Government Code, Article 12, Section 50280, define historical property and establish procedures to formulate historical zone contracts with applicable property owners. In particular, California's Public Resources Code, Section 5031, defines "qualified historical property" as privately owned property which is not exempt from property taxation, is visually accessible to the public, and also: • 1 • Page Two a. all landmark registrations that conform to the existing criteria determined by the California Historical Landmarks Advisory Committee, and b. any other registered California historical landmarks which satisfy any of the following requirements: 1) The property is the first, last, only or most significant historical property of its type in the region; 2) The property is associated with an individual or group having a profound influbnce"•on the history of California, or d 3) The property is a prototype of, or an outstanding example of, a period, style, architectural movement, or construction, or if it is one of the more notable works, or the best surviving work, in a region of a pioneer architect, designer or master builder. Government Code A_rticle_12,.Historical Property Contracts, commencing wi"t"li'Section 50280 through 5U2W,' establishes procedures for implementation. For example, Section 50280 states that the legislative body -of a city and/or county may by ordinance create an historic zone encompassing the property as qualified -by Section 5031, when application has been made by a property owner. Once an historical zone has been established by ordinance, the legislative body of..a city and/or county may then contract with the owner of a qualified histori);cal property to restrict the use of such property to retain its characteristics as property of historic significance. The contracts, if established, must contain the following provisions-: a. minimum period of 20 years; b, where applicable, the contract shall also provide for: 1) preservation and rehabilitation of property to conform to the rules and regulations of the State Department of Parks and Recreation; 2) reasonable access to the interior and exterior of the premises to students of the arts and local, state and federal officials conducting recording and survey programs; 3) reasonable public access, including visual observation of the exterior. If the interior of the premises relates to the property's eligibility, the owner shall also agree to limited basic tours; 4) periodic examination by the Assessor, and officials of the Department of Parks and Recreation and State Board'of Equalization for verifi- cation of compliance with the contract; 5) binding agreement with all successors_in interest of the, owner. r C� L) Page Three The additional sections of Article 12 establishing Historical Property Contracts summarily describe renewal procedures, cancellation grounds, and other administrative functions. Based on the preliminary information that Mr. Lovell has for- warded to the City, it appears that his residence could possibly qualify as an historical property under the abdve code sections. The City's Advanced Planning Administrator confirmed that estab- lishing an historical zone on the Lovell House would be in conformity with the City's General Plan. However, at the present time the City does not have an historic district with the zoning code. An historic district would have to be created within the zoning code which would require public hear- ings before both the Planning:Commission and the City Council. Subsequent to the establishment of an historic district, the subject property would.have to be rezoned into the newly -created district. This would also require public hearings before the Planning Commission and the City Council. The -creation of an historical --zone places certain enforceable restrictions on the property which are subsequently reflected in the assessed valuation. The City staff contacted Mr. Vallerga, County Tax Assessor, regarding -the amount of property tax rel-ief-available with the creation of the subject historic zone.- He stated that -there is no formula by which County Assessors are required to base their subsequent assessed evaluations. They do, however, take into consideration the specific terms of the contract and make an independent judgment on evaluation for each zone. There are also certain provisions-6y which.improvements made by an owner are not necessarily subject to a standard assessment index. The staff would suggest that a copy of Mr. Lovell's correspondence, along with the Government Codes, be forwarded to the Newport Historical Society for review and report back. The City Librarian has confirmed the Society's interest in this subject. RECOMMENDATION: If desired, the staff will follow through with the subsequent steps: a. submit the request to the Newport Historical Society to verify qualifications; b. submit request to the Planning Commission for, review and recom- mendations; and c. report back to Council prior to drafting an Historic District within the zoning code, and rezoning the subject property. During this and other projects of the Historic American Building Survey in Los Angeles it was customary to prepare National Register nomination forms for the properties surveyed and submit them to the State for their•cons ideration. lam disappointed Co learn from John Frisbee's letter that the nomination of the Lovell Beach House has not gone forward, for it is one of..the most important buildings in the United States illustrating the development of contemporary architecture. The house was built for my parents by architect R. M. Schindler in 1926. The plans were recorded by the United States National Park Service in their Historic American Buildings Survey, in cooperation with various local university groups, in 1968. The preamble to the plans, describing the structure's significance, states as follows: "The Lovell Beach House, R. M. Schindler's most important building, dating from 1926, is a precursor of post-war profilist design of unsurfaced concrete. The house is lifted above its beach site and cradled in five concrete frames in the shape of figure 8's which were poured in place. The enclosed areas were shop -fabricated and hoisted into position. The play of forms in the advancing and receding planes are close to the De Stijl movement begun in Holland in 1917. " The house is depicted on the cover, and described within a 1972 book by Professor David Gebhard, entitled, "Schindler" as %e ll as in a number of encyclopedias and other volumes on architecture by Esther McCoy and other writers. Professor Gebhard prepared a scale model of the house, accurate in all dimensions, which, along with pictures of the house at various stages of construction; has boon dHp1.iyo(J at the Los Angolos County Mt Munuum. The house has been visited by thousands of architects and architectural 11 Clerk, Orange County Board of Supervisors Page 2, September 17, 1973 students from all parts of the world, with often as many as 15-25 appearing each week. It has appeared in journals throughout the world, and is the subject of a televised documentary by the BBC. Currently, with nearly 50 years of wear and tear from the devastating beach elements, much of the plumbing and wiring is in great disrepair, and the interior is in great need of remodeling. Because of the obvious economic problems of carrying out such work, on a 50-year old structure, we are currently seeking the various tax and other incentives to maintaining such an historic property. For your assistance, I am enclosing several photographs of the house taken at various stages throughout its history, and a copy of the letter concerning the house from Mr. James C. Massey, Director of Historic Properties for the National Trust for Historic Preservation in Washington, D.C. Please let us know if any further information is necessary at this time.
