Mayor Cox stated that he would like to
add a comment relative to the Downcoast
area. He stated that as the
representative of Councilmanic District
7, Spyglass Hill/Harbor View area, the
residents had concerns of what is going
to happen to the area between the land
designated in green on the exhibit, and
the San Joaquin Hills Transportation
Corridor, as some of the boundaries are
in the City of Irvine, and in Irvine's
Sphere of Influence. He stated he felt
the City Council should go on record
before LAFCO that the City has an
interest in readjusting the boundary
line so that it follows the new
MacArthur Boulevard and San Joaquin
Hills Transportation Corridor alignments
in order to better serve the adjacent
residents.
Mayor Cox stated it was his intention
that reference to his comments be
included when this item is considered by
LAFCO.
The motion was voted on and carried.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF OR
COUNTY TO AMEND THE SPHERE OF INFLUENCE OF THE CITY OF
NEWPORT BEACH TO INCLUDE AN EXTENSION OF THE NEWPORT
DOWNCOAST.
WHEREAS, the Local Agency Formation Commission designates certain unincor-
porated areas of Orange County as the Sphere of Influence of the City of Newport
Beach, and
WHEREAS, the purpose of a Sphere of Influence is to plan for the ultimate
physical boundaries and service area of local government agencies, and
WHEREAS, the Sphere of Influence of Newport Beach includes the area
known as the "Newport Downcoast" which inevitably will be annexed to Newport Beach,
and
WHEREAS, the extension of the "Newport Downcoast" as shown on Exhibit "A"
is physically related to and is most easily serviced by Newport Beach, and
WHEREAS, all areas currently within the Sphere of Influence of the City
of Newport Beach are consistent with the purpose of a Sphere of Influence, and
WHEREAS, the Local Agency Formation Commission will review the Sphere of
Influence of the City of Newport Beach on December 2, 1987.
NOW, THEREFORE, BE IT RESOLVED'that the City Council of the City of
Newport Beach requests the Local Agency Formation Commission of Orange County to
amend the Sphere of Influence of the City of Newport Beach to include that area
known as the Newport Downcoast Extension shown on Exhibit "A" attached hereto,

SUBJECT: SPHERE OF INFLUENCE REVIEW
ACTION: If desired, approve Resolution No.
requesting LAFCO to include an extensioh
of the Newport Downcoast in the City's
Sol and to amend no other portion of the
Sol; and
Authorize Mayor to sign'and transmit a
report to LAFCO setting forth justification
for the request.
ACKGROUND: The Local Agency Formation Commission (LAFCO) designates
areas for further annexation known as a Sphere of Influence (Sol).
The City's Sol currently includes the BEECO property in West Newport,
Santa Ana Heights, and the Downcoast. LAFCO periodically reviews the
City's Sol, last doing so in 1983 and intending to do so again on
December 2, 1987.
Any extension to the Sol will require that LAFCO at its December 21
1987 meeting, schedule a public hearing for a later date to consider
the request. During the interim time, additional information will be
gathered including the attitude of property owners and specific requests
of LAFCO Commissioners and staff.
RECOMMENDATION: In anticipation of that review, the City Council Ad Hoc
Annexation Committee reviewed the City's existing SOS and possible
additions. The Committee recommends that the three existing areas remain
in the Sol and that the Sol in the Downcoast Area be extended to Laguna
Beach.
The attached resolution and report are consistent with this recom-
mendation and are self-explanatory. If the Council desires to modify
othis recommendation, it is suggested that LAFCO be requested to postpone
the review scheduled for December 2, 1987 to allow City staff sufficient
time to draft the necessary resolution and report.

SUBJECT: SPHERE OF INFLUENCE
Dear Chairman and Members of the Commission:
OFFICE OF THE MAYOR
•The City Council of the City of Newport Beach as indicated on the attached
resolution requests your Commission to reaffirm the City's existing Sphere
of Influence (SOI) and to extend the SOI in the Downcoast Area. The City's
existing SOI encompasses three separate areas each of which in addition to
the proposed extension is identified on the accompanying map and discussed
separately below.
BEECO PROPERTY - WEST NEWPORT
First included in the Sol on July 27, 1983, this area is completely surrounded
by the City and therefore, in accordance with state law, can be annexed only
to Newport Beach. When first included in the SOI, the owner and the major
tenant indicated their support for that action. Despite a change in owner-
ship, there is no evidence to indicate a change in that attitude.
The BEECO property is currently utilized for oil production. The City has
adopted a General Plan for the area calling for predominently medium density
residential with some industrial and commercial uses. The landowner is
currently in the beginning stages of processing a County General Plan Amend-
ment for the area to provide for predominently residential use with wetlands
• restoration, neighborhood commercial, and visitors' serving uses.
Newport Beach is a full service City willing and capable of providing all
municipal services to the property at any time. However, annexation is
not expected until the ultimate land use is decided.

SANTA ANA HEIGHTS
First included in the City's SOI in 1973, this area is almost completely
surrounded by the boundaries of the City and would qualify as an "island"
annexation under state law.
Two annexations have incurred in this area since the last review of the
SOI. Bayview Annexation No. 90 was completed in 1985, and Upper Bay
Annexation No. 91 was completed in 1986. An Annexation Agreement between
the City and the County related to the Bayview Annexation provides for the
County's support of the annexation of the remainder of Santa Ana Heights.
In anticipation of annexing the remainder of the area, the City conducted
a number of activities. The Settlement Agreement for the John Wayne Airport
litigation addresses the planning and development of the area. Both a General
Plan and a Specific Area Plan which mirror those of the County have been
adopted by the City. The City and the County are currently acting as co -
project sponsors for the purposes of an EIR on the alignment of certain
• roadway connections. The City and County have cooperated in forming a
Community Redevelopment Agency encompassing this area and adjoining City
and County areas. Also, the City and County have entered a separate coopera-
tive agreement providing for the orderly annexation of this area within the
structure of the Redevelopment Agency. The City has completed a plan of
services and a cost/revenue study for the annexation and intends to con-
sider annexation of the entire Santa Ana Heights Area upon completion of
the roadway alignment study anticipated in 1988.
NEWPORT DOWNCOAST
Sometimes referred to by the misnomer of "Irvine Coast," this area was first
included in Newport Beach's SOI in 1976 and was reaffirmed as such in 1980
and 1983. During these years the City has conducted numerous activities in
anticipation of annexing the Downcoast.
A General Plan consistent with the County's has been adopted, and a General
Plan Amendment has been initiated to reflect a recently approved County
Amendment.
Master Plans for water and sewer service to the area have been prepared.
• The area is most economically and efficiently served by the natural gravi-
tational alignment with existing City facilities. Water and sewer facili-
ties within the City have been oversized and stubbed to provide for future
service to the Downcoast. The City has entered two separate agreements,

one with the Irvine Ranch Water District and another with the Irvine Company,
IRWD and County Sanitation District No. 5, providing for conveyance of water
and sewer facilities upon annexation. City engineers are presently coordinat-
ing water and sewer inter -connections and mutual service agreements for the
proposed development of the area.
Roadway improvements and alignments have been anticipated and approved by the
City. Several roads have been oversized and stubbed to provide access to the
area. The City is actively involved and is cooperating fully in the planning
and funding of roadways in and near the Downcoast.
Police, fire, and other municipal services are adequate or can be easily expanded
to service the Downcoast. The City currently provides first -call fire and para-
medic service to the Downcoast through a mutual aid agreement with the County.
Police patrols and services can be conveniently extended on planned roadways
from existing adjacent Newport Beach peighborhood. Lifeguard and marine services
now provided by the City can also be extended to the Downcoast. Newport Beach
is accustomed to providing services on a seasonal basis and to addressing the
special problems resulting from the interface of residential and tourist areas
as will be experienced in the Downcoast Area.
Furthermore, the Downcoast Area will be socially and economically linked to
Newport Beach. The Downcoast is within the Newport -Mesa School District and,
resident children will attend Newport Beach Schools. Shopping centers, banks,
trade services, parks, clubs, entertainment, and similar amenities most con-
venient to the Downcoast are located in Newport Beach.
Development of the Downcoast is proceeding at a rapid pace with expectations
for groundbreaking within one year and for substantial development within five
years. Annexation is anticipated within that five-year period.
DOWNCOAST EXTENSION
Considering the inevitability of the City's annexation of its present SOI in
the Downcoast Area, the remainder of the Downcoast (now a County "island" and
not now in any other city's SOI) logically belongs in the SOI of Newport Beach.
Physically related to the existing Newport Beach SOI, the proposed extension
which follows the logical boundary of the San Joaquin Hills Transportation
Corridor will be most easily accessed through Newport Beach. Also the
nearest essential services will be located in Newport Beach.
As indicated on the accompanying map, the proposed extension includes the
remainder of the Crystal Cove State Park and the area to be dedicated as
a wilderness park. Excluded from the proposed extension are all areas
within the SOI of Laguna Beach and the developed area of Emerald Bay.

isThe state park is currently owned and operated by the state and the dedication
area will be deeded to the County in increments as development in the remainder
of the Downcoast proceeds. The County would be free to transfer ownership to
state or federal park agencies. All the land in the proposed extension will
serve regional needs.
Regional facilities within the boundaries of a city are well precedented and
well justified. Corona del Mar State Beach, the Dunes, the Upper Bay Ecological
Preserve, Newport Harbor, and 6.1 miles of ocean beach are currently within the
boundaries of Newport Beach. Also, much of the popular beach area of Crystal
Cove State Park is already within the SOI of Newport Beach.
The advantages to both the City and the regional facilities are many. The
best stewardship of any park or recreational facilities always comes from
those who live near it and use it the most which in this case will be residents
of Newport Beach. The City can offer many services to the parks including
primary and back-up police and fire services, traffic and parking coordination,
marine and lifeguard services, joint interpretative and recreational programs,
building and development services, maintenance and refuse collection services,
•and other advantages which likely derive from a nearby, readily available,
and concerned administrative organization. Being located within the boundaries
of the City, therefore, holds many advantages to a regional park.
On the other hand, Newport Beach will receive not only benefits but also the
impacts and burdens of the park. More tourists, more traffic, and more crowds
will be experienced by Newport Beach whether or not the parks are within the
City. Justifiably, the City deserves both the increased status and the limited
amount of control which derives from having regional parks within the City's
boundary. Because Newport Beach will inevitably receive the burdens, it is
fair that the City also reaps some benefits.
Including the Downcoast extension in the SOI of Newport Beach at this time
will facilitate cooperative planning for the extension of adequate and essential
services to the area as it develops within the next five to ten years. Such
planning and eventual annexation will assure the City of its just benefits and
will assure the parks of efficient and economical services.
•For the above stated reasons, the City Council of Newport Beach requests your
favorable consideration of the proposed actions regarding our Sphere of Influence.
