General Plan Amendment Number 17 Date of City Council Adoption Dec. 9, 1974 Amendment Amend the Recreation and Open Space Element to remove the specific references to public parking lots by deleting Item 3 on Pages 39 and 40 and replacing Item 3 with the following sentence (presently the first sentence of Item 4): "The City will determine the desirable maximum capacity of the beaches and explore possible methods of limiting beach use to this capacity in order to assure that over- use does not destroy the recreational and environ- mental value of the beaches." Laura Lagios City Clerk City of Newport Beach 0 City Council Meeting December 9, 1974 Agenda Item No. D-4 through D-10 CITY OF NEWPORT BEACH December 3, 1974 TO: City Council FROM: Department of Community Development SUBJECT: General Plan Amendments -- Public Hearing At the November 25, 1974 meeting, the City Council set General Plan Amendments Nos. 3, 9, 11, 12, 14, 15, and 17 for public hearing at the December 9, 1974 City Council meeting. Staff suggests that the public hearing be conducted in a series of hearing sessions, with a public hearing session being opened and closed• for each individual amendment as it is considered. Attached are copies of the staff reports sent to the Planning Commission regarding General Plan Amendments Nos. 3, 9, 11, 12, 14, 15, and 17. Also attached are the relevant pages of the Planning Commission minutes, copies of all correspondence received regarding these amendments, and the Planning Commission Resolutions recommending adoption of General Plan Amendments Nos. 9, 11, 12, 14, 15, and 17. Environmental Significance All of these proposed General Plan Amendments were reviewed by the Environmental Affairs Committee on October 2, 1974. The Committee determined that there is no environmental significance (in terms of the California Environmental Quality Act). The A 0 T0: City Council - 2 Environmental Affairs Committee made this decision subject to the understanding that detailed environmental analysis will be undertaken at the project level. Planning Commission Recommendations As indicated in the attached minutes, the Planning Commission recommended against adoption of General Plan Amendment No. 3 (Bison Avenue) since a change in the classification of Bison Avenue would not reduce traffic and since the intersection configuration can be designed to reduce traffic impact on the Eastbluff neighborhood. (This amendment was, however, set for public hearing at the direction of the City Council.) . Recommended Action The public hearing session for General Plan Amendments Nos. 3, 9, 11, 12, 15 and 17 should be opened, closed and the City Council should adopt any of these General P1an,Amendments as: A TO: City Council - 4 desired. Staff would suggest that the public hearing for General Plan Amendment No. 14 (Harbor View Hills, Sector IV) be opened, with all interested persons being heard, and then continued to the December 23, 1974 City Council meeting (and, if necessary, again continued) so that the decision on the General Plan Amendment can be made concurrent with, and consistent with, the City Council decision on the amend- ment to the Harbor View Hills P-C and the Tentative Map for Sector IV. (If the City Council desires to modify any of the amendments recommended by the Planning Commission, the suggested change must be referred back to the Planning Commission for the Commission's review and comment prior to final adoption, per Council Policy Q-1 and State Law.) Attached are copies of the Planning Commission's resolutions and the relevant Planning Commission minutes. As indicated in the minutes, the Planning Commission recommended against adoption of General Plan Amendments Nos. 3, 10, 13, and 16 at this time. In recommending against adoption of General Plan Amendment No. 3 (Bison Avenue), the Planning Commission directed staff to continue to work with the Eastbluff Homeowners' Association as plans for the intersection of Bison Avenue and Jamboree Road are developed. It was the consensus of the Planning Commission that any potential problems of traffic impact on the Eastbluff neighborhood should be handled in the design of the intersection and that a change in the classification of Bison Avenue (from a Primary to a Secondary) TO: City Council - 2 would not reduce traffic. (Attached is the memo from the Public Works Department to the Planning Commission). In recommending against adoption of General Plan Amendment No. 10 (Avon Street "bluff" property), the Planning Commission decided to uphold its previous recommendation that the property be designated "Low Density Residential" and zoned R-1 (as it is currently zoned). The property owner's request for General Plan Amendment No. 13 (for a commercial center at Irvine Avenue and University Drive) was rescinded, and the Planning Commission agreed with th•e property owner (The Irvine Company) that an overall plan should be prepared for the developmept of the vacant property between Irvine Avenue and the -Upper Bay. In recommending against adoption of General Plan Amendment No. 16 (re: designating the vacant site at the s-outhwest corner of Marguerite Avenue and Harbor View Drive as open space) the Planning Commission indicated that there was insufficient information as to the need for this site for park purposes, and recommended that this General Plan Amendment be referred to the Parks, Beaches and Recreation Commission for recommendation and that the proposed amendment be reconsidered at the February, 1975 General Plan Amendment Session. Advance Planning Administrator Cowell replied that the subject property is currently in the unclassified district and that the action this evening, if adopted by the Planning Commission, would not change the zoning designation but would change the designation on the Land Use Plan. He further advised that after changing the designation on the Land Use Plan, alternative zoning possibilities could be considered for the site and that it is likely that a P-C zoning would be recommended, which would require an overall development plan to be approved by the City. In response to the Commission's question as to whether there would be any developmental problems with this area being in the freeway alignment, Community Development Director Hogan replied that there are some severe developmental problems and that the staff does not believe this designation alters those problems in any way. He further advised that under current zoning they would not have to submit a development plan to the Commission for the requested use; however, they are requesting a height exception - and this will require Commission approval of the plans. Public hearing was opened in connection with this matter and William A. Dudas, 611 Lido Park Drive, resident of Vista del Lido, stated that most of the people who live in the building, who own their own apartments, are against this type of building. He stated that they feel this would increase traffic and even with off-street parking, after hours it is possible that the owners might lease out the parking. He then presented a petition signed by 36 persons who are opposed to the proposed office building. Bob Hallberg, 700 Lido Park Drive #1, Manager of Lido Village Trailer Park, appeared before the Planning Commission and stated that the residents of the trailer park are not present at this meeting because they were not notified of the hearing and that the residents of 621 Via Lido were also not notified. He then presented a petition signed by 26 persons who are opposed to the proposed office building. Mr. Hallberg advised that he personally is neutral on this project. In response to the Commission's question, Advance Planning Administrator Cowell advised that the state requirement for notification of a General Plan amendment is the posting of an advertisement in a local newspaper at least 10 days prior to the public hearing. Russell Nelson, 29 Cabrillo - Lido Park, appeared before the Planning Commission and stated that he is in favor of a small office building in place of the existing hotel or in place of a multi -story -apartment building. H'e advised that the neighbors to whom he has spoken are also in favor of the office building and felt that with an office building, the weekends would be quiet. y, Mrs. Charles Painter, 611 Lido Park Drive, Apt. 6-D appeared before the Planning Commission and stated that she has no objection + to an office building such as planned being built. She added that because most off ices conduct business Monday through Friday, weekend traffic would be alleviated. Planning Commission advised Mrs. Painter that the traffic report suggested that the owner might lease out the parking to help the weekend parking problem. Barry Williams, one of the owners of the Lido Shores Hotel, appeared before the Planning Commission and advised that the hotel is 18 years old and that there is nothing there of any value, structurally or aesthetically, to cause the owners to renovate the structure. He then stated that the owners have chosen to suggest an office building because it seems to fit more compatibly with what is in the area. He then advised the Commission of other office buildings in the area, i.e., the office building at the end of the strip on the Curci- Turner property, which Mr. Williams stated doesn't seem to be a problem, and the condominium office building on Lafayette which is approved but not yet built. In response to the Commission's question relative to the proposed night lease, Mr. William explained that this came up because he is presently part-owner and occupant of a building on MacArthur Boulevard adjacent to Blackbeard's. He advised that since his parking lot is empty when their heavy parking problem comes up, they were asked to lease their parking. Mr. Williams advised that the owners did so since this adds additional.income. With �. respect to the location of the proposed office building, Mr. Williams stated that the suggestion he made was an attempt to relieve an existing problem. He advised that when he had a meeting at Vista del Lido, the people expressed that they were opposed to his doing this because they felt it would make it possible for more commercial uses to be accommodated; therefore, he is prepared to lock it up at 6:00 p.m., if desired. Mr. Williams -then discussed the magnitude of the height problem, reviewed the model of the proposed office building with the Commission and discussed the provision of restroom facilities for the boat slips. Jim Riddle, 700 Lido Park Drive, appeared• before the Planning Commission and stated that office buildings create a very high traffic area. He added that in addition to the employees of the office building, callers to the office would provide a continuous turnover of traffic. He discussed parking requirements for boat slips and stated that he feels this area should be maintained residential. He does not feel that mixing of residential and commercial is wise. Both letters spoke in opposition to the proposed 2,000 additional recreational parking spaces as called for in the Recreation and Open Space Element of the General Plan and requested this proposal be deleted from the General Plan. Margot Skilling, resident of West Newport and member of the West Newport Beach Improvement Association as liaison to the Homeowner's Associations, appeared before the Planning Commission. She advised that she recently discovered that the people in the area were not aware that this is in the General Plan. She commented that she had spoken to the Balboa Coves Community Association and that they have indicated they are totally opposed to having. the parking lot in this area. She stated that she had spoken to John Durio, President of the Lido Sands Community Association, who also was not aware this was in the General Plan. Mrs. Skilling indicated that she did not understand how public hearings on the General Plan could be held, the Elements composed and after they are written, the communication stopped. She then requested that Pages 39 and 40 be stricken starting with Item 3 on Page 39 with no substitutions. Her reason being that the parking lot in question is on the north side of the highway and there is no way that anyone can cross there. She advised that it's relatively blind as a person comes down from the Arches and the on -coming traffic ca.n't be seen. She advised that there is an S-curve as one goes past the Surf & Sirloin, and that traffic can't be seen from that direction either. She felt that this seems to be an unlikely place to put a beach parking lot. She then discussed the tram system and advised that the tram would also have to cross both lanes of the Coast Highway. She advised that per her conversation with Lieutenant Blue of the Police Department, she was informed that two people have been killed on this highway in exactly that area in the past twelve months. Mrs. Skilling believed that ff beach parking was provided and people had to wait for a shuttle bus or tram, they would walk since it is not that far a distance. She then discussed the danger involved in crossing the Coast Highway. She advised that other than having to cross the highway, there is also vehicular accessi- bility which she felt is rather bad. Mrs. Skilling-brought notice to the portion of the element which reads as follows: "4. The City will determine the desirable maximum capacity of the beaches and explore possible methods of limiting beach use to this capacity in order to assure that over -use does not destroy the recreational and 't environmental value of the beaches. Implementation of Item 3 shall be held in abeyance until this Item 4 determination is accomplished." She stated that soon thereafter, this had been implemented. She added that it will go into commercial usage but they do it on the rationale that it is already in our General Plan. Mrs. Skilling did not feel that this belongs in the General Plan because it is a specific. She advised of the possibility of the Parks, Beaches, and Recreation Commission putting in a tennis court there. She felt that as long as the General Plan specifically states that, west of the Arches, north of the Coast Highway, below the Bluffs, this shall hold 1,750 car parkings, the City is being binded. She then reviewed the beach usage and advised that the City has approximately 30,000 feet of waterfront. She stated that there are State standards that talk about beach usage per acres of sand, and standards that require ten foot square or 100 square feet per person. She used as an example that if a 30-foot lot is considered and 30 people are on it those people are rather crowded. She stated that if the City has 30,000 feet, the City's capacity is just about 30,000 people. She did not feel that the Department of Beaches in Sacramento can establish an acre formula or a square footage formula because just so many people can fit on the beach. She commented that she would not like to see private beaches but there's got to be something in between -- good reasonable usage that protects Newport Beach's residents. She advised that in her opinion the Planning Commission of Newport Beach should reflect Newport Beach; and that it behooves the City to try to do the best for the residents. Commissioner Heather advised that this is state right-of-way property, and recalled that as the Commission was di'scussing the General Plan, the Commission wanted to rather preclude commercial development there and the language is written so that the City had the option should it be acquired by the State. Advance Planning Administrator ,Cowell advised + that one of the considerations that was discussed was the potential problem of the type of development that could occur there, if property were acquired for private development. Community Development Director Hogan then advised of the reasons for the original designa- tion. He stated that for a long period of time it was considered that there needs to be some additional parking to substitute for, or add to, the parking that is now available in the very crowded areas of the Peninsula and West Newport. He further stated that the beach has been considered for a long time as a regional - recreational resource and the City has accepted in many cases the obligation of helping to provide adequate facilities for the use of that regional recreational resource. He then advised that the major thing is to help the City relieve its own traffic problem that exists on the Peninsula and in West Newport by providing parking elsewhere and hopefully to encourage the people who are presently travelling up and down the Peninsula hunting for non-existent parking spaces, to find parking spaces.and to institute a desirable recreational tram service or transportation service of some kind which would move people from this parking lot or series of parking lots off the beach and onto places on the beach without adding to the traffic congestion. He then agreed with the presentation that was made that there is and should be a reasonable limit to the number of people that can use the beach. He felt it would be a mistake to provide parking in a locationof this kind that would just make additional traffic if we don't somehow restrict the traffic that goes up and down the Peninsula and goes in and out of West Newport. He advised that Newport Beach has a ba-d reputation for not being cooperative in.the way of providing beach service to the public at large. He stated that what he thinks this really means is, in reality we fill our town on this yearly siege with people and we are literally providing 40- or 50,000 beach - goers a living place in a parking space. He stated that if you look at the number of feet or square feet that we have for the beach, and take the lifeguard's beach counts and compare those and look at the standards the state has set up for Huntington Beach which is immediately contiguous to us, you will find that we are over on the amount of actual public service we're providing by about a factor, two or three. He felt that perhaps we may have lost some sight of the things we actually accomplish and in•the original General Plan it was really meant, apparently not strdng enough worded, that the parking aspect there be secondary to the establishment of these very beach capacity numbers. He added that it's evident that we are precariously close to having a beach parking lot; if we don't fill it up with people who are going to use Lido Center, come next summer that parking lot is going to be available and solicited for use by people coming in and then we have the contending safety problems facing us. He stated that it looks to him to be close to dangerous planning and hoped that the Planning Commission find it suitable to go with the recommendation of the citizen groups and get on with the beach analysis. The question of changing from a private community to an open community at a later date should the street system prove to be a burden on the community association was discussed and it was felt this could be done provided the streets were constructed to City standards and that title to the street system was such that dedication could be ' made. Ga Cook, Residential Project Manager with The Irvi Company appeared before the Commission and advise of their intent to dedicate the streets to the com ity association(s). He also commented on the Ci 's General Plan which indicates accept- ance of the rivate community concept within the City. Other ctors to consider are the desire of the consumer fo rivacy, and the reduction of Police service du to a decrease in crime and vandalism. He also ointed out that public view sites were being prov ed on the periphery of the project. Dave Neish, Manager, Planni Administration, The Irvine Company, appeared befo the Commission and commented on future plans of Th Irvine Company with respect to development of pr ate communities within the City. Planning Commission discussed view site in general and the grade of the proposed roadways th ughout the project. City Engineer Nolan advised at some of the grades are quite steep and do exceed e normal grades used in flat or mildly rolling t - rain. However, the roadway grades are within th standard practice used in hillside developments with this type bf terrain and grades are the same whether public or private streets are constructed. 7. General Plan Amendment Community Development Director Hogan reviewed the changes with the Commission and advised that staff had no objections to the relocation of the paseo as it would provide a goo'd connection between paseos on the north and south and the money saved in the relocation could very well be spent in other park development and maintenance. Mr. Stewart answered ques- tions relative to the possible alternative of reducing the width and type of paseo along the San Joaquin reservoir in order to reduce mainten- ance costs. Planning Commission recessed at 9:25 P.M. and reconvened at 9:40 P.M. 8. Spyglass Hill Road (Reduction of slope and can on fill and the reduction of impact from noise and lights.) City Engineer Nolan reviewed the profile of Spy- glass Hill Road and commented on slope reduction, street alignment, and variable grades. He recommended that no change be made in the design and commented on the problems involved should the roadway be relocated. Mr. Nolan also reviewed grading plans and cross -sections indicating the amount of fill needed at various points in the construction of Spyglass Hill Road as recommended by staff, as well as the techniques used in order to give a natural appearance to the final product. Planning Commission discussed alternative realign- ments of the roadway and the problems involved because of the terrain. Impact of noise and lights was analyzed and dis- cussed by City Engineer Nolan and it was pointed out that a distance of 1000 feet existed between the roadway and the houses in the area of concern, therefore no problems should be encountered in this regard. However, plans for berming and land- scaping have been provided for selected locations and the recommended changes are included in the staff report. Page 6. DIS(,U`.SION: - In the June 1974 hearings on General Plan amendments the Planning Commission considered possible' changes to the ".primary highway" status of Bison Avenue between MacArthur Boulevard and Jamboree Road. No action was taken on the amendment at that time, however the staff was directed to'meet with the Eastbluff Homeowners' Association to discuss the resident's concerns regarding Bison Avenue traffic. On July 18, 1974 the City Traffic Engineer met with the board of the Eastbluff Homeowners' Association. The board indicated that their primary concern involved the traffic circulation at the intersection of Bison Avenue with Jamboree Road, and the potential negative impact on the Eastbluff neigh- borhood. The use of special intersection channelization to alleviate this concern was discussed, and it was concluded that the Association had no basic objection to Bison Avenue serving as a primary or secondary road between MacArthur Boulevard and Jamboree Road. The -Association did indicate that they would appreciate being advised and involved in all future planning for the intersection, and the staff will of course comply with this request. A copy of a letter dated July 21, 1974 from the Association to the City Manager is attached for reference. BACKGROUND: A copy of a memo dated June 13, 1974 from the Public Works Department discussing the issues involved is attached for reference. A change in classifi- cation from primary highway (if lanes divided) to secondary highway (4 lanes not divided) is not recommended primarily because the width of a secondary highway does not enable provision of the degree of channelization that can be obtained on a primary highway_ The level of traffic service would thus be decreased; and the effects would be felt in increased congestion in the intersections, and an increased accident rate. The previous memo also includes a brief discussion of realigning Bison Avenue. It is concluded that the advanced state of planning and develop- ment in the area would make such a realignment impractical. It should be pointed out also that the classification of Bison Avenue has already been reduced from major highway (6 lanes divided) to primary. At present, the northerly half of Bison Avenue is improved from Jamboree Road easterly to Camelback Street with 2 travel lanes, curb on the northerly side, and curb on the southerly side. The latter curb would serve as the northerly median curb in the future if the street were to be widened to its full cross section. A hearing has been set to consider a further change in classifica- tion from a primary road to a secondary road, and/or a relocation of the inter- section of Bison Avenue and Jamboree Road, and/or other realignment of the street system in the area. DISCUSSION: The desire for a change in either the classification or the alignment of Bison Avenue is primarily based on the concern of residents in the Eastbluff area that a portion, of the traffic on Bison easterly of Jamboree may either deliberately or inadvertently cross Jamboree and traverse the residential area. However, a review of land uses and street patterns in the area indicates that it is unlikely that a significant number of cars would enter Eastbluff from Bison easterly of Jamboree unless the drivers have a destination in Eastbluff.' Changing the classification of Bison Avenue from primary to secondary (4 lanes not divided) would reduce the traffic handling capacity because the lesser width between exterior curbs (64 feet rather than BO feet) eliminates the ability to provide left turn pockets at intersections together with shoulders available for right turns at the intersections. It should be noted that the number of through lanes remains 4 under either classification, and there probably would riot be any significant reduction in the number of vehicles crossing Jamboree Road into Eastbluff. The classification of Bison was based on traffic volumes projected from the land uses planned in the area. Reduction in classification below that required to serve projected traffic volumes. could be expected to result in the types of problems normally associated with traffic congestion. These in- clude delay 'to motorists, higher accident rate, increased hazards to bicyclists and ped::strians, greater smog generation, and a higher noise level. Apartments A group of about 25 Balboa Peninsula residents is up in arms over a proposed flue unit apartment complex In their neighborhood and they're asking the Newport Beach City Council for help. "We're worried about density and of course there's never, "enough parking in the area," Mrs. Shirley Moore, chairman of Citizens to Protect Peninsula Point Environment, explained. Her group is asking the city council to turn down a proposal to re -subdivide the property at 1319 E. Balboa Blvd. It has been approved by the planning commission" "We don't want a large building there that doesn't fit in with the rest of the neighborhood," Mrs. Moore said, However the architect, Brion S. Jeannette, disagrees, pointing out that the building is designed with landscaping and a varied exterior. "This isn't a shoebox design," Jeannette said. "It lets in light and air and I think it's quite in keeping with the neighborhood." According to Community Development Director Richard V. Hogan, the proposed complex meets all city standards and the R•3 zoning is in keeping with the city's general plan. It the city council goes along with the planning commission at its meeting tonight, Hogan said the prOject's owners could go ahead and build since they i don't need a use permit. d, Unless, Hogan said, the council agrees to consider revamping the general plan, as Mrs. Moore's - group has also requested. DAILY PILOT 8/27/74 Council Approves, Resubdivision " With Conditions Newport Beach city c o u n ell m e n approved a controversial resubdivision of a lot on the Balboa Peninsula Monday but said the owners must get council approval before building. Councilmen also said they will requite an environmental impact report on any development there. Eight neighbors opposing t h e resubdivislon at 1319 E, Balboa Blvd. spoke at Monday's hearing, .protesting the owners' intention to build a five4mdt apartment complex on the lot. The dispute arose because the jot, is zoned partly for m u l t i- f a m i l y residences and partly for duplexes, although neighboring lots are zoned- for,' singlo family residences and duplexes only. Neighbors said they believe a five -unit building is too large and will affect .the nature of the neighborhood. They also said they are Vorried about parking problems. Hazewinkel, Chairman Reference: Lido Shores Motel Site 617 Lido Park Drive Dear Commissioners: The purpose of this letter is to request an amendment to the General Plan per Policy Q-1, Section 2, Article D, during the October session to permit the construction of a two-story, with adequate covered parking, office building on the above referenced site. The zoning of the parcel is Commercial and permits office use. However, the General Plan calls for the parcel to be Multi -Family, consequently the General Plan needs to be amended. The project,has been reviewed preliminarily with Mr. Robert Steel, the President of the Apartment Owners Association at 611 Lido Park Drive, and with Mr. Dan Olmstead of 621 Lido Park Drive Condominiums, represent- ing properties to the immediate North and South with a generally favorable response. That is, there has been no objection to office use versus more condominiums. In addition., we have spoken with Mr. Donovan of the Cannery, Mr. Fran Delaney and Mr. John Curci regarding their thoughts for our proposed use and •again received a favorable reaction. From these conversations with people in the area together with our own thoughts based on living in the area, this immediate district is considered to be unique in character because of the existing intermingling of uses. The uses range from expensive multi -family to low-priced light industrial. Some of the more specific considerations regarding office use on this site are listed below. The proposed building would be approximately 17,000 square feet of office space and the estimate for traffic use would be 155 trips per day, whereas a multi -family use would have perhaps 80 trips per day. An off -setting factor is that the office building use would be confined to Monday through Friday and would be at times of low traffic flow (weekday morning and afternoon). In ad- ditibn, the parking could be made available to help re- lieve current congension during the evening hours and on weekends, as we presently do on MacArthur Boulevard in our building next to Harry's and Blackbeards res- taurants. The size of the building would be less in footage than a multi -family use because the parking restricts the amount of footage to a maximum footage which is less than that which would be permitted for a multi -family development. Public access around the building to the Bay would be 'provided which is not presently available nor would it likely be provided under other than a restricted business use. The cost/revenue effects of office use are more favor- able to the City from the standpoint that there are less city services in total required by office than are re- quired by multi -family developments. In the event specific studies by outside consultants covering any aspects of the development would be bene- ficial, we will pursue said studies, however, we wish to have any work -of this type done by persons or firms recognized as being qualified by the City and consequent- ly we will discuss the specifics of any studies with whomever the City advises would be the proper party. Our offices are presently in the MacArthur Plaza building which we built a couple of years ago at 4299 MacArthur Boulevard. Reasons for Request to Amend Residential Growth Element 1. The Peninsula Point area, known as Statistical Sub -division D-4, between "D" Street and the Harbor Entrance Channel as delineated in Districting Map No. 12, is zoned almost entirely for single-family residences. In this respect it is unique to'the entire Peninsula. Its owners and residents are united in theirr desire to preserve the individual and unique character of their community. 2. The Planning Commission has historically mandated lower zoning in the immediate area of the described parcel. In 1956 and again in 1967, in order to reduce density and to require development more compatible with the surrounding R--1 structures, long-standing R-3 zoning has been modified. k .. 1. - 2 - 3. This is the only remaining extended beachfront parcel in the entire Statistical Sub -Division which is zoned other than R-1. This zoning, if permitted to remain, would allow the developers to construct a multi -unit apartment complex along more than 200 feet, most of which would be exposed to the open beachfront and to adjacent R-1 dwellings. The developers could also construct some of these apartment units three - stories in height. There are no such beachfront apartment complexes, nor are there any three-story structures anywhere in the D-4 Sub -Division. 4. The City Council's Policy on Implementation of the California Environmental Quality Act calls for close examination of any project which creates a change in the character of an area by a difference in use, intensity, size or configuration. R-3 development of thi'. parcel must be avoided' because of its permanently injurious impact on the neighborhood environment, and upon the health, safety, peace, comfort and general welfare of persons residing in the area. Proposed Amendment to General Plan It is proposed that the Balboa Boulevard one-half of the parcel be zoned R-2 to avoid three-story construction where none presently exists in the area. It is further proposed that the extended beachfront one-half of the parcel be zoned R-1 to be consistent with all other oceanfront zoning in the area. The zoning of the parcel is Commercial and permits office use. However, the General Plan calls for the parcel to be Multi -Family, consequently the General Plan needs to be amended. The project has been reviewed preliminarily with Mr. Robert Steel, the President of the Apartment Owners Association at 611 Lido Park Drive, and with Mr. Dan Olmstead of 621 Lido Park Drive Condominiums, represent- ing properties to the immediate North and South with a generally favorable response. That is, there has been no objection to office use versus more condominiums. In addition, we have spoken with Mr. Donovan of the Cannery, Mr. Fran Delaney and Mr. John Curci regarding their thoughts for our proposed use and again received a favorable reaction. From these conversations with people in the area together with our own thoughts based on living in the area, this immediate district is considercd'to be unique in character because of the existing intermingling of uses. The uses range from expensive multi -family to low-priced light industrial. Incidentally, there is no reason to anticipate additional condominiums would be any more successful thantthose presently com- pleted. Some of the more specific considerations regarding office use on this site are listed below. The proposed building would be approximately 17,000 square feet of office space and the estimate for traffic use would be 155 trips per day, whereas a multi -family use would have perhaps 80.trips per day. An off -setting "factor is that the office building use would be confined to Monday through Friday and would be at times of low traffic flow (weekday morning and afternoon). In ad- dition, the parking could be made available to help re- lieve current congension during the evening hours and on weekends, as we presently do on MacArthur Boulevard in our building next to Harry's and Blackbeards res- taurants. The size of the building would be less in footage than a multi -family use because the parking restricts the amount of footage to a maximum footage which is less than that which would be permitted for a multi -family development. Public access around the building to the Bay would be ptxovided which is not presently available nor would it Llilcely be provided under other than a,restricted ( business use. The cost/revenue effects of office use are more favor- able to the,City from the standpoint that there are less" city services in total required by office than are re- quired by multi -family developments. In the event specific studies by outside consultants covering any aspects of the development would be bene- ficial, we will pursue said studies, however, we wish to have any work of this type done by persons or firms recognized as being qualified by the City and consequent- ly we will discuss the specifics of any studies with whomever the City advises would be the proper party. • 0 City of Newport Beach Planning Commission August 14, 1974 Page Three Our desire as Newport Beach and Corona del Mar residents is to provide a unique office environment for our own use as well as accommodating other local residents who have expressed a desire to share the building with us. The ownership of the proposed building shall be com posed of New England Mutual Life Insurance Company, Robert D. Voit and Barry K. Williams. Our offices are presently in the MacArthur Plaza building which we built a couple of years ago at 4299 MacArthur Boulevard. Our business is the development and continued ownership of office, industrial and commercial real estate. We do not make a practice of developing good projects and per- mitting them to be passed on to other buyers and users. Attached are a number of exhibits which will accurately detail the spgcific project which we Would like to build. This has created an unusually detrimental impact of spot -zoning with respect to one land parcel in Statistical Sub -division D-41 described as: Portion of Lots 8 and 91 Block 22, East Side Addition to Balboa Tract, and Section 35, T6S, R10W and Section 2, T7S, R10W, S.B.M., located at 1319 East Balboa Boulevard, on the south side of East Balboa Boulevard between "E" and "F" Streets on the Balboa Peninsula. Reasons for Request to Amend Residential Growth Element 1. The Peninsula Point area, known as Statistical Sub -division D-4, between "D" Street and the Harbor Entrance Channel as delineated in Districting Map No. 12, is zoned almost entirely for single-family residences. In this respect it is unique to the entire Peninsula. Its owners and residents are united in their desire to preserve the individual and unique character of their community. 2. The Planning Commission has historically mandated lower zoning in the immediate area of the described parcel. In 1956 and again in 1967, in order to reduce density and to require development more compatible with the surrounding R-1 structures, long-standing R-3 zoning has been modified. -2- 3. This is the only remaining extended beachfront parcel in the entire Statistical Sub -Division which is zoned other than R-1. This zoning, if permitted to remain, would allow the developers to construct a multi -unit apartment complex along more than 200 feet, most of which would be exposed to the open beachfront and to adjacent R-1 dwellings. The developers could also construct some of these apartment units three - stories in height. There are no such beachfront apartment complexes, nor are there any three-story structures anywhere in the D-4 Sub -Division. 4. The City Council's Policy on Implementation of the California Environmental Quality Act calls for close examination of any project which creates a change in the character of an area by a difference in use, intensity, size or configuration. R-3 development of this parcel must be avoided because of its permanently injurious impact on the neighborhood environment, and upon the health, safety, peace, comfort and general welfare of persons residing in the area. Prbposed Amendment to General Plan It is proposed that the Balboa Boulevard one-half of the parcel be zoned R-2 to avoid three-story construction where none presently exists in the area. it is further proposed that the extended beachfront one-half of the parcel be zoned R-1 to be consistent with all other oceanfront zoning in the area. This action would permit•profitable development of the entire parcel without causing irreparable injury to other persons and property in the neighborhood. There is currently under construction a ten foot concrete sidewalk, a small landscaped space and a concrete block wall paral'iil to that area. Either the tentative tract was approved without conforming to the open space plan, or our City's standards are so low they need upgrading. Bayside Drive has a much wider greenbelt corridor, but it is not indicated on the Land Use Plan. There is also a graphic conflict between elements. The open Space Element indicates a neighborhood park along Marguerite Avenue between Harbor View and 5th Avenue, whereas the Land Use Plan indicates half of this area devoted to low -density residential housing. It would appear prudent to admend the Land Use Plan deleting the non-existent greenbelt and adding the park area to the plan. This park area is one of the significant open spaces within the City. It offers a rare window of the Bay as you drive down Marguerite toward the ocean.
