HEARING BY THE PLANNING COMMISSION.
Requested amendment to the Land Use and Residential Growth Elements
to reduce density on all undeveloped residential land to between
2-1/2 and 4 DU's/Acre. (Requested by Claudia Hirsch).
September 5, 1974 - Planning Commission did not set this matter for
public hearing.
September 30, 1974- City Council upheld the Planning Commission's
decision to not set this matter for public
hearing and directed that the requests be
returned to the originators without further
action.

William Gold, President of the Balboa Peninsula Point
,Association, and Harry Kamph speaking in behalf of
Shirley Moore, President of a Citizens to Protect the
Peninsula Environment, addressed the Council re-
questing a Planning Commission hearing regarding 1319
East Balboa Boulevard.

The audit report from the State Lands Division was
received and ordered filed,with the understanding'
that (a) the staff will meet with the State author-
ities to work out details if necessary for "bunching"
receipts and for preparing allocation system for
expenses on tidelands, (b) the staff will resubmit
the list of capital improvement projects to the State,
(c) the lease with all of the Balboa Bay Club improve-
ments, except slips, are on uplands and that the
lease does not provide for unilateral adjustment of
rents, and (d) the staff will await the receipt of a
formula from the Division of State Lands to compute
the value of an offshore mooring fee.
10. A letter from the Orange County Health Planning
Council stating that they have revised their By -Laws

reducing the Board of Directors from 74 to 27 members,
and have created an Assembly of Delegates to supple-
ment the membership on the Board of Directors; and
requesting that the City of Newport Beach formally
appoint a representative to the Orange County Health
Planning Council's Assembly of Delegates, was pre-
sented.
An additional letter from'the Orange County Health
Planning Council was received after the agenda was
printed requesting nominations for their Board of
Directors.
The above letters were postponed to October 15 for
clarification from staff.

Of these requested amendments, the Planning Commission decided
against initiating proposed amendments No. 6, 10, 11, an,d 12.
The Planning Commission's decisions were made pursuant to
Council Policy Q-1 which provides that: "If the Planning Commission,
after examination, is convinced that the proposed change is worthy
of consideration, it may initiate amendment.as set forth above.
If not, the Commission shall forward the request to the City
Council with its recommendation that consideration of amendment is
unwarranted." Council Policy Q-1 further states that the:
"City Council, after consideration of the request and of the
report from the Planning Commission, may either direct the
Commission to initiate public hearings on the proposed amendment,
or' may return the request to the originator without further action."
Recommended Action
Pursuant to Council Policy Q-1, the City Council should either:
1) Uphold the Planning Commission decision against setting
four of the requested General Plan amendments, as described
above, for public hearing, and direct that the requests
be returned to the originators without further action; or,
2) Direct the Commission to initiate public hearing$ on e-n-e-

The matters of reducing density drastically, and elemirating. the
pollution in the bay is to mangy* of us a real Cris here in Newport
.Beach. These matters are a challenge to be sure, but one•:vhich :e

Site. He expressed concern with the ability of
persons having no financial interest in specific
property to institute amendment proceedings. He
requested that the amendment pertaining to the
Castaway Site not be set for hearing and that .the
Irvine Company be given the opportunity to present

within the next thirty days.
Claudia Hirsch appeared before the Commission and
stated she felt the matter should be heard .

The Irvine Company appeared before the Commission.
to comment on amending the Land Use Element by
designating the southeast corner of Irvine and
University for Retail and Service Commercial. He
felt the matter should be heard since it is adjacent
to property in the county which has been designate
as commercial.and the area would lend itself to a
neighborhood shopping center serving the immediate
area.
Planning Commission held a general discussion as
to the policies regarding Amendments to the Genera
Plan.
Motion was made to set a public hearing on October
17, 1974 for consideration of an Amendment to the
Land Use Element of the General Plan by designatin
the southeast corner of Irvine and University for
Retail and Service Commercial.

which was requested by Shirley Moore and William
Gold.' He reported on negotiations now taking plac
in an'attempt to resolve the problems related to
development of the property and felt that if the
matter was heard, there would be further delays in
the negotiations and as of the present, the proper

has been in escrow for two and one-half years.
Community Development Director Hogan commented on
the number of public hearings and appeals which
have been heard in connection with this property
by both the'Planning Commission and City Council.

The next General Plan amendment session, according, to Council
Policy Q-1, will commence with Planning Commission public
hearings in October.
Following is a list of all proposed General Plan amendments
including those directed from the City Council, those suggested
by the Planning Commission, and those requested by citizens
and property owners (all letters are attached):

Staff would suggest that the Planning Commission set a public
hearing at the October 3, 1974 Planning Commission meeting for those
suggested amendments that the Commission desires to consider
further. Council Policy Q-1 provides that:, "If the Planning
Commission, after examination, is convinced that the proposed change
is worthy of consideration, it may initiate amendment as set
..forth above. If not, the Commission shall forward the request to
the City Council with its recommendation that consideration of
amendment is unwarranted."

The obvious intent is that the Planning Commission assume di$cretion
in initiating amendments and that the General Plan amendment
process not become a forum for lot -by -lot complaints.
