This has been given considerable study by all departments relative to servicest utilities, dto. We have all con- cluded that it is a worthy project and are making efforts to move ahead through the local merchants, We are attempt- ing to have the local merchants and p7ropertY owners take the initiatile in requesting'this abandonmeint and assuming the financial obligations. Apparently some of the subordinate members of your department are not completely aware of this and the mer- chants attempting, to promote the project seem to be meet- ing resistance. I wish you to immediately advise all of your em- ployees that might be contacted on this matter that this is a program we Want to support and foster and that they should give it full. cooperation. The pedestrian mall concept is worthy of support and approval. I think that there are several problems requiring solution, and sug- gest they should be researched by the City Attorney. 1. Can the abutting properties be served.adequately from othdr public ways? In other words, under existing or possible statutes can these ways be restricted to use by pedestrians only without creating access limitations resulting in justifiable claims for remuneration? 2.• Can a pedestrian preserve be created by normal traffic regulations rather than by formal procedures abandoning vehicular, access? If abandonment proceedings be required, would they work against the City's best interests in future planning? 3. •What provisions can be made for continued maintenance and repair of existing utilities? If these•questions can be.answered satisfactorily and the abutting property owners dan reach agreement, we should proceed. Robert L. The water mains have an expected life of at least ten years. 2. Four water service laterals will require replacement before any alley surface improvement can be made. This can be accomplished at any time by City forces. 3. The sewer main is concrete. The remaining life is very diffi- cult to predict, however, ten years may be a fair estimate. 4. A study of the lighting of 21st Place indicates the following: The types of street light standards used throughout the City are not considered to be the most desirable for this use. The existing types are either too high (tne cast iron type used around City Hall,) or are too heavy in appearance (the concrete standards on the Arches overpass.) Lights of special design, gas lights, or'wall mounted bracket type, may be more desirable. Anticipating that this division will -be requested to do as much as possible with a minimum expenditure, the following alternatives are.offered. Plan "A" (Red) Install three standards as shown, either cast iron or concrete, and remove the existing standards. o...i . Plan'"H" (Green) Install three standards as shown, either cast iron or concrete, and remove the existing standards. Plan "C" (Blue) This plan was suggested by Mr. Rick Lawrence, and would require four standards. This plan is the least acceptable as it would require one additional standard, and more important, that it would place these standards over the existing water main. Plan "A" using concrete standards is recommended.;,. Three concrete standards are available in the City yard. The direct cost would be approximately $150. for wiring foundations,'etc., and would require approximately four days labor. Mr. Rick Lawrence was contacted by this offioe,regarding the installation Public Works Director ti June 6, 1968 Page 2 of an Edison Company light on the existing power pole in the alley. Edison's program provides for energy charges to be paid by the adjacent property owners. Mr. Lawrence stated that he almost would be willing to pay for this himself because of the difficulty in collecting monies from the property owners. It adjoins a public alley on the easterly side of,said property. There is also a 10' public alley to the rear of said property. PROPERTY BACKGROUND: The building is one of the oldest in the McFadden area, but with minor structural improvement, is a sound building. The most previous use was a drug store containing approximately 3,750 square feet. The building is non -conforming in that it is located on the rear property line adjacent to an alley. Section 20.24.060 of the Muni- cipal Code states: "Rear yards abutting alleys shall have a minimum width of 10 feet." PROPOSAL: The property owner proposes to establish a restaurant having a seat- ing capacity of 100 persons. Said restaurant will have on -sale liquor, live entertainment and dancing. In addition, there will be•incidental shops facing both the ocean front and the alley. CODE REQUIREMENTS: Section 20.08.030 requires that a Use Permit be secured for the live entertainment, dancing and on -sale liquor portion of the restaurant. In addition, since the building is non -conforming in so far as it's rear setback, any structural alterations or. -modifications are subject to a Use Permit. This requirement is outlined in Section 20.44.070. It is felt that all of this could be handled under one Use Permit application. Suggested wording of the application: "Request the establishment of on -sale liquor, live entertainment and dancing in conjunction with a bonafi'de restaurant and structural alterations be permitted to an existing hon-conforming building." There is no specific requirement for the provision of parking. Under normal circumstances, this type of use would require 35 off-street parking places. The Planning Commission has the power to require parking as a condition of approval of the Use Permit, however, it is felt that the Planning Commission would recognize the nearby public metered parking as adequate. There are 247 parking spaces in the Ocean Front lot and 66 spaces in the McFadden Place lot. Additional on -street metered spaces are also available. Rapp analysis cont'd. p.2 • ALLEY IMPROVEMENT: The City may instigate action to close the adjoining alley to vehicular traffic and create a pedestrian mall. This would require the cooperation of the adjoining property owners and some expend- iture of money on their part. Tree wells and landscaping could be provided in cooperation with the Parks, Beaches and Recreation Department. Provisions should be made for adequate irrigation of the trees and ground cover. Adequate street lighting should be provided. It is the City's policy not to provide alley lighting, therefore the adjoining property owners would have to join into an agreement to provide lighting for said alley. (ie: Balboa Island Alley Lighting District) The alley surface should be sandblasted and painted green. Street furniture such as benches, trash receptacles should be provided by the city. The curb -cut adjoining the ocean front should be closed and provision made for a loading zone. It would also undoubtedly serve to minimize even further the occasional misconduct which occurs. There are, however, two factors which operate against the idea: 1. We are already assigning an officer during the summer months (admittedly, a Reserve Officer) for purposes of meter enforcement. 2. Our total committment precludes this assignment which would amount to unwarranted use of man- power. The incidence of crime and the frequency of calls are simply not sufficient to warrant the assignment.
