This cost overrun is primarily due to the additional time required to 1) obtain basic project description information. This task was further complicated due to the lack of a designated Irvine Company Project Manager for this project; 2) to coordinate with Western Pacific Engineering regarding the geotechnical and biological technical studies, and 3) to review these studies and to revise the initial study to incorporate pertinent data. The above tasks were not an- ticipated in our original scope of work. We are not requesting a contract amendment at this time, however we felt it was necessary to alert you to this matter at this time. We will submit a formal request for contract amendment following receipt of the City's comments on the revised Initial Study. At that time, we will have a better understanding of the tasks required to complete this project. (LSA) is pleased to submit this proposal to prepare an Initial Study for the storm drain improvements from Corporate Plaza West to the Newport Back Bay. The purpose of this analysis is to determine the appro- priate environmental documentation for the proposed project. The tasks asso- ciated with the expanded Initial Study include the following: Task 1 - Proiect Definition. LSA will prepare a project description from information provided by the applicant and the project engineer. We have also budgeted for two meetings with the City for project start and review of project description. Task 2 - Prepare Initial Study. The Initial Study will cover all envi- ronmental issues associated with the project. However, significant issues such as water quality and construction impacts will be analyzed at a greater level of detail than other topics. To determine water quality impacts, LSA's hydrologist will review exist- ing documentation and will contact the Regional Water Quality Control Board to determine existing water quality in the outfall area, and agency concerns and jurisdictions. We will describe existing water quality, and identify existing local storm drain outlets and flow volumes. Then we will review the proposed storm drain project plans and assess the operational and construction impacts associated with the new storm drain. Operational impacts will focus primarily on discharges of oil, grease, pesticides and herbicides into Newport Bay. This assessment will be based on standard runoff contaminant factors, and will not include any laboratory testing. Construction impacts including erosion and sedimentation, both along the alignment and at the outfall, will also be dis- cussed. finally, the intensity of the project's impacts on water quality in Newport Bay will be discussed, and appropriate mitigation measures will be identified. ❑ 1 Park Plaza, Suite 500 • Irvine, California 92714 • (714) 553-0666 ❑ 157 Park Place • Pt. Richmond, California 94801 • (415) 236-6810 lsa Also, the project's short-term impacts on traffic along Pacific Coast Highway and adjacent residents will be assessed and discussed. We have budgeted for a review of water quality in this portion of Newport Back Bay, as well as the project's impacts on the Back Bay. It is anticipated that LSA will prepare this study, however if preparing the study in-house results in a schedule delay, we will consider using a subconsultant to prepare this analysis. If it is determined that an Environmental Impact Report is needed, the Initial Study will provide the basis for focusing the EIR. Once the Initial Study has been reviewed by the City, LSA will make minor revisions as necessary to finalize it. Task 3 - Coordination and Attendance at Meetings. LSA will coordinate the Initial Study with the City, and will obtain project information from the applicant. We have budgeted for two meetings to discuss the results of the Initial Study, as well as to determine the remaining tasks necessary to com- plete the environmental precess. We propose to accomplish these tasks on an hourly basis consistent with the attached rates and provisions. We estimate that a budget of $12,000 will be required to accomplish the scope of work. If a fixed -fee proposal, the professional services described in the Scope of Services section of the attached proposal shall be provided for the fixed .fee noted in the Compensation and Terms section of the proposal. All other professional services are considered extra services. Extra services shall be provided on a time -and -expenses basis at the same rates specified for hourly contracts unless other arrangements are made in advance. Hourly Contracts. If an hourly -plus -expenses proposal, the professional services described in the Scope of Services section of the attached proposal shall be provided on a time basis at current hourly rates. These rates are as shown on a Rate Schedule that is attached or can be made available. Hourly rates are subject to review at least annually on or about July 1 each year and may be adjusted to reflect changing labor costs at our discretion at that time. The cost of such a program shall be the responsibility of the City of Newport Beach. With regard to the potential siltation increase, according tto Warner Younis of Western Pacific Engineers, the following statement can be made: Area runoff and sedimentation will not increase substantially with the proposed storm drain project. The project will increase the velocity/ intensity of the water flow into the bay. This is true because the paved surface area (the source of the runoff) will only increase incrementally, while the capacity of the storm drain will be expanded. Therefore, ap- proximately the same amount of water will be flowing through an expanded drainage system, thus increasing the velocity of the flow. The increased velocity at the outfall will actually spread the sediment load farther out into the bay, thereby further reducing the potential for increased sedimentation at or near the outfall. Total mitigation of the siltation problem would require the installation of a complex and unreal- istic filter system at the outfall, and/or the expansion of existing filters and siltation basins above the project site. HOAG MASTER PLAN EIR Per our meeting on March 20, 1990, Tony Petros has provided you with an outline (under separate memo) of the data which LSA needs from the City traffic model in order to complete the Master Plan build out circulation analysis. In the interim, we will proceed with completion of the Phase 1 traffic analysis. In terms of the overall Master Plan EIR, LSA committed staff to meet the schedule that was established last summer/fall, 1989. However, since we sub- mitted the Screencheck document on August 9, 1989, approximately seven months have passed. As a result of this situation, staff that were originally commit- ted to this project are currently committed to other projects and, in one case, have gone on maternity leave. We will commit staff to completing individual sections per the attached schedule. The City's review of individual section(s) would help to expedite final review of the entire document. However, even with early review of individual sections, I cannot comfortably commit to a circula- tion date before May 25, 1990. In order to initiate the EIR work, as we discussed in our meeting, I am awaiting receipt of the revised PC Text. In addition, at your earliest con- venience I would like to set up a meeting to discuss the visual analysis, height limits and LSA renderings. Please advise me on who should be involved in this meeting. Also, I am assuming I have all comments that were generated by either the City or Hoag on the Screencheck EIR submitted last year. Please let me know whether or not this is the case. Suggested Action If desired, accept as complete and certify the Negative Declaration for the Corporate Plaza Storm Drain project with the Findings and Condition in Exhibit "A". Proposed Project The environmental document under consideration is for the Corporate Plaza Storm Drain project. The project consists of a storm drain facility of reinforced concrete pipe (RCP) that would run parallel to an existing storm drain from East Coast Highway to lower Newport Bay near the Bahia Corinthian Yacht Club. The first 1660 feet of the storm drain will be 75 inch RCP, and the final 130 feet will be 96 inch RCP. The proposed storm drain will serve storm flows from the drainage area illustrated on Exhibit 1. Environmental Significance In accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines and City Policy, an Initial Study has been prepared for the project. Based upon the information contained in the Initial Study, it has been determined that the project will not have a significant effect on the environment. A Negative Declaration has, therefore, been prepared for the consideration of the City Council. Public review of the environmental document commenced on April 4, 1990, and closed on May 4, 1990. Written comments have been received from the Department of Transportation and the California Regional Water Quality Control Board, and are attached to this report. These comments provide additional permitting information, and do not request additional information. They are, therefore, incorporated into the environmental document. A verbal comment was received by staff from Mr. David Hook regarding the response to initial study item 3e. This item indicates that there is a possibility that the proposed project may result in a discharge into surface waters, or in the alteration of surface water quality, including, but not limited to temperature, dissolved oxygen or turbidity. The item was checked "maybe" because the added storm drain facility could result in an TO: City Council - 2. increase in the velocity of stormflow through the drainage system. While no increase in sediment is expected, this possible added velocity could alter the deposition of silt coming through the storm drain system. A thourough analysis of existing and proposed hydrology constraints and capacities should be undertaken. Proposed Project The environmental document under consideration is for the Corporate Plaza Storm Drain project. The project consists of a storm drain facility of reinforced concrete pipe (RCP) that would run parallel to an existing storm drain from East Coast Highway to lower Newport Bay near the Bahia Corinthian Yacht Club. The first 1660 feet of the storm drain will be 75 inch RCP, and the final 130 feet will be 96 inch RCP. The proposed storm drain will serve storm flows from the drainage area illustrated on Exhibit 1. Environmental Significance In accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines and City Policy, an Initial Study has been prepared for the project. Based upon the information contained in the Initial Study, it has been determined that the project will not have a significant effect on the environment. A Negative Declaration has, therefore, been prepared for the consideration of the City Council. Public review of the environmental document commenced on April 4, 1990, and closed on May 4, 1990. Written comments have been received from the Department of Transportation and the California Regional Water Quality Control Board, and are attached to this report. These comments provide additional permitting information, and do not request additional information. They are, therefore, incorporated into the environmental document. A verbal comment was received by staff from Mr. David Hook regarding the response to initial study item 3e. He noted that the Coastal Permit cannot be applied for until the subject Environmental Document is certified, and he therefore urged the parties to consummate their agreement as soon as possible. Barry Ross, Attorney representing Dave Hook, 1617 Bayside Drive, addressed the Council in support of continuing this item to June 25, 1990 in order that his client and The Irvine Company can "work out their differences." In response to question raised by Council Member Sansone, the Public Works Director stated that the new storm drain parallels the existing storm drain and connects to the existing drain immediately adjacent to Bayside Drive. The City Attorney noted that there is no increase in size of the drainage area. In response to question raised as to why a new storm drain is needed, the Public Works Director advised that the existing drain was constructed a number of years ago in accordance with Orange County Flood Control District design criteria at the time, and subsequent to that time their drainage manual has been revised and their requirements are more conservative. The Negative Declaration has indicated that dregding and dewatering would be involved during the construction. Therefore an a National Pollutant Discharge Elimination System (NPDES) permit for any discharge of wastes to surface waters or a Waste Discharge Requirements (WDR) permit for any discharge of wastes to land will be required from this Regional Board. Please note that the time frame for issuance of a permit can be as long as 180 days from the time the permit application is accepted as complete. As a responsible agency Caltrans District 12 provides the following general comments regarding the proposed project: The proposed project will impact Pacific Coast Highway, a Caltrans facility. Caltrans is therefore a responsible agency and must review any proposed plans involving any portion of the proposed project that infringes, cross over or under any part of this Caltrans Facility. The proposed project will require an 1ncroachment Permit be issued should any part of the proposed project infringe on any portion of a State Facility, in this case, Pacific Coast Highway. A thourough analysis of existing and proposed hydrology constraints and capacities should be undertaken. This analysis should be made part of the submittal information when requesting application for an Encroachment Permit. At that time, it may be possible special conditions of approval will be required. The costs of any proposed mitigation measures which could potentially affect State Facilities such as restriping, signalling and so forth will be the responsibility of others and not Caltrans. WYLIE CARLYLE, Camiy R000rdor INDEMNITY AGREEMENT THIS AGREEMENT; made and entered into this day of !:�rl/ / , 1970, by and between THE IRVINE COMPANY, a West Virginia corporation, hereinafter referred to as "Subdivider", 9II and the CITY OF NEWPORT BEACH, a municipal corporation, organized 1011 and existing under and by virtue of its Charter and the Constitut 11 and laws of the State of California, hereinafter referred to as 12 "City"; 13 WHEREAS, Subdivider has subdivided land designated as 14 Tract No. 6927 within The City of Newport Beach, the map for which 15 is hereby referred to and incorporated herein; and 16 WHEREAS, it was necessary for Subdivider to reconstruct 17 an existing storm drain system in conjunction with the development 18 of said tract; and 19 WHEREAS, one of the conditions of approval for the final 20 map of Tract No. 6927 specified that Subdivider accept the discharge 21I from the revised storm drain, and that City not be responsible for 22I any problems occurring in the boat basin bayward of the bulkhead 23 resulting from the operation of the storm drain; such problems could 24 include, but not be limited to, siltation and damage to piers or 25 boats; and 26 WHEREAS, the parties hereto desire to execute an agreement 27 providing for the fulfillment of the condition of approval for the 28 final map of Tract No. 6927 as stated in the preceding paragraph; 29.1 NOW, THEREFORE, in consideration of their mutual promises, 301 the parties hereto agree as follows: 311 1. That Subdivider agrees to accept the discharge into 3011Lot C from the revised storm drain, -1- 1 2. That Subdivider agrees to indemnify and hold harmless 2 City and its officers, agents, and employees from all demands, 3 claims, losses, or liability on account of injury or damage to 4 persons or property suffered or claimed to be suffered in or on said 5 Lot C as a result of the reconstruction of the storm drain by 6 Subdivider to discharge into Lot C; such injury or damage to includ 7 but not be limited to, siltation of the boat basin, damage to piers, 8 floats, docks or boats caused by floating'or submerged debris 9 emanating from the drain, or by hydraulic surges or wave action 10 resulting from the operation of the reconstructed drain. 11 3.
