NEW DOCK AT 919 BAYSIDE DRIVE PROJECT
CEQA DOCUMENTATION
April 7, 2006
PROJECT UNDERSTANDING
The City has received an application for a project that proposes to remove existing boat docks
at 919 Bayside Drive, install an Americas with Disabilities Act (ADA) compliant gangway and
landing, and install a new dock system and supporting pilings consisting of fourteen 60-foot long
slips, three 19-foot long slips, and one 45-foot long transient slip. No dredging is proposed at the
current time. However, water turbidity may occur during the pile removal and re -construction
process and there is the potential that eelgrass habitat within the project area may be degraded
during construction activities. Mitigation measures and best management practices (BMPs)
would be employed during construction to minimize these potential impacts.
Based on a preliminary review of the project information, it appears that a Mitigated Negative
Declaration (MND) prepared pursuant to the California Environmental Quality Act (CEQA) will
be the appropriate form of environmental documentation for the project. The City of Newport
Beach (City) will be the lead agency for the project. An Initial Study (IS) will be prepared as the
basis for the MND.
SCOPE OF WORK
TASK 1 PROJECT INITIATION
BonTerra Consulting will meet with the City and the project applicant, if necessary, to discuss
the project and the proposed scope of work. This coordination effort is intended to ensure that
there is agreement regarding the scope of work, studies to be completed, and appropriate
environmental documentation for the project. The project schedule will also be discussed at this
meeting.
Task 1 Deliverable:
1. Attendance at one meeting
TASK 2 PREPARATION OF ENVIRONMENTAL DOCUMENTATION
BonTerra Consulting will prepare the environmental document. This scope of work assumes
that an IS, leading to the preparation of a MND, is required. The IS and MND will be prepared
pursuant to CEQA and the State CEQA Guidelines. Following is a discussion of specific tasks to
be completed in preparing the IS and MND.
Task 2.1 Prepare Initial Study / Mitigated Negative Declaration for Review
In compliance with Section 15063 of the CEQA Guidelines, the IS/MND will contain a
description of the project, including the location of the project; a discussion of the environmental
setting; an identification of environmental effects; and a discussion of mitigation measures. This
scope of work assumes that City and/or the project applicant will provide BonTerra Consulting
the necessary information to prepare the project description. The discussion of environmental
setting will be based on a review of existing literature, including the Invasive Algae Survey

Report and Pre -Construction Eelgrass Survey Report (both prepared by Coastal Resources
Management in March 2006). BonTerra Consulting recently conducted site visits of the study
area, during preparation of the IS/MND for the 919 Bayside Drive Residential Project; therefore,
another site visit would not be required. The discussion of environmental effects will follow the
City of Newport environmental checklist. In compliance with the Sundstrom vs. Mendocino case
(1988), an explanation for all checklist answers will be included to provide the City with an
understanding of how the IS conclusions were reached. Mitigation measures, if necessary, will
be clearly identified to facilitate the development of the mitigation monitoring program.
Based on the project understanding, and discussions with City staff and the project applicant, it
is expected that the project will not result in significant impacts related to the following issues.
This will be documented in the IS/MND:
Aesthetics: BonTerra Consulting will qualitatively discuss any anticipated changes resulting from
removal of the existing dock and subsequent development of the new dock. This scope
assumes that visual simulations will not be required.
Agricultural Resources: BonTerra Consulting will reference relevant information from the City's
General Plan and Zoning Code as a means of documenting that the proposed project will have
no impact on agricultural resources.
Cultural Resources: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project will have no impact on
cultural resources.
Geology/Soils: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
to geology or soils.
Hazards and Hazardous Materials: BonTerra Consulting will summarize data presented in the
919 Bayside Drive Residential Development Project to verify that the proposed project would
not result in impacts related to hazards or hazardous materials.
Land Use/Planning: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project would not result in
impacts to land use and planning.
Noise: BonTerra Consulting will qualitatively discuss potential short-term construction -related
noise. The project would not result in long-term operational noise impacts.
Population/Housing: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project would not result in
impacts to population or housing.
Public Services: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
to public services.
Recreation: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
related to recreation.
I:,
Transportation and Traffic: BonTerra Consulting will qualitatively discuss potential short-term
project -related traffic impacts resulting from construction worker trips to the project site. The
project would not result in long-term traffic impacts.
Utilities/Service Systems: BonTerra Consulting will summarize data presented in the
919 Bayside Drive Residential Development Project to verify that the proposed project would
not result in impacts to public utilities and services. It should be noted that this approach
assumes that no additional power would be brought to the site for the new docks. If information
to the contrary becomes available during preparation of the MND, then additional analysis and a
budget augment may be required.
BonTerra Consulting's approach for addressing the above topical issues assumes that the City
and/or the project applicant will be able to provide project -specific, detailed information to
support CEQA findings. If BonTerra needs to perform additional research, data gathering, or
analysis to adequately address any of these topical issues, a contract augment will be required.
It should also be noted that the approach described above relies heavily on BonTerra
Consulting's ability to pull information from the IS/MND that was recently prepared for the
919 Bayside Drive Residential Development Project. If it is determined, during the project
definition or public review process, that a more information or analysis is required, a contract
amendment and budget augment will be necessary.
Following is a description of BonTerra Consulting's work effort for assessing potential
environmental effects relative to each topical issue requiring analysis in the IS/MND.
Air Quality: BonTerra Consulting will quantitatively discuss potential short-term construction -
related air quality impact associated with the removal and reconstruction of the gangway,
landing, and dock system. Appropriate findings and mitigation measures, including Best
Management Practices, will be presented in the IS. The proposed project would not be expected
to result in long-term operational air quality impacts; thus, a qualitative discussion will be
provided.
Biological Resources: BonTerra Consulting will summarize available information from the City
and/or the project applicant and document the proposed project's potential impacts to biological
resources. Appropriate findings and mitigation measures, including Best Management
Practices, will be presented in the IS.
Water Quality/Hydrology: BonTerra Consulting will summarize data provided by the City and/or
the project applicant and document the proposed project project's potential impacts to water
quality/hydrology. It should be noted that the information provided must be adequate for CEQA
review purposes. Appropriate findings and mitigation measures, including Best Management
Practices, will be presented in the IS.
Task 2.2 Prepare Public Review Draft IS/ND or MND for City Review
Based on the comments received from the City and the project applicant (if included in the
review process), BonTerra Consulting will revise the IS/MND and submit an approval draft
document to the City for an expedited second review. Following the City's review, BonTerra
Consulting will revise the IS/MND to address comments/suggested revisions that are within the
scope of work. Should the comments received require any technical studies, an amendment to
the budget will be required.
BonTerra Consulting will prepare a legal notice that the City proposes to adopt an MND. This
notice should be published in a local newspaper or at a minimum, posted at the project site. It is

assumed that the City will be responsible for preparing and publishing the notice.' Because
Coastal Commission approval will be required, the IS/MND will be submitted to the State
Clearinghouse for review; a 30-day public review period is therefore required.
Task 2.3 Distribute IS/MND
BonTerra Consulting will prepare and distribute twenty-five (25) copies of the finalized IS/MND.
The distribution list will be determined in coordination with the City.
Task 2.4 Coordinate Publication of Public Notice
Prior to adoption of the MND, BonTerra Consulting will prepare and submit a legal notice for
publication in a local newspaper to advise the public that the City proposes to adopt an MND.
The appropriate local newspaper for publication of the legal notice will be determined in
coordination with the City.
Task 2.5 Prepare Responses to Comments
Once the 30-day MND review period has ended, BonTerra Consulting will review the comments
received and develop an approach to respond to these comments. Responses to comments are
not required by CEQA, but they are recommended to assist the lead agency in the decision
making process. Topical responses, with a brief summary of the response and reference back
to the larger response, will be used if multiple comments are received on the same issue. This
will allow a more complete response without undue repetition. The draft responses to comments
will be submitted to the City (and the project applicant, if appropriate) for review. The responses
to comments will be revised based on comments received.
In compliance with Section 15074 of the CEQA Guidelines, the decision making body of the
lead agency must consider the proposed MND together with any comments received during the
public review process.
Task 2.6 File Notice of Determination
Following adoption of the MND by the City, a Notice of Determination (NOD) must be filed with
the County Clerk. This scope of work assumes BonTerra will prepare and file the NOD. The
project applicant will be responsible for payment of required fees to the California Coastal
Commission with the NOD.

If requested by the City to do so, BonTerra Consulting could coordinate distribution of the IS/MND and publication
of the public notice. The cost for providing these services is presented in the attached Fee Estimate.

TASK 3 MITIGATION MONITORING
If mitigation measures are necessary, BonTerra Consulting will prepare a mitigation monitoring
program (MMP) for adoption with the MND in compliance with Public Resources Code 21081.6.
The MMP is required to ensure compliance with adopted mitigation requirements during project
implementation. The program will be prepared in matrix format and will provide the timing and
responsibility for each mitigation measure. A draft copy of the MMP will be submitted to the City
for review. Revisions will be made accordingly.
Task 3 Deliverables:
1. Three (3) copies of the draft MMP

TASK 4 PROJECT MANAGEMENT AND MEETINGS
BonTerra Consulting will coordinate with the City and the project applicant, as necessary,
throughout the CEQA documentation process to ensure compliance with the scope and
schedule. In addition to the meeting previously identified in Task 1, this scope of work assumes
the need for one additional coordination meeting with City staff and/or the project applicant. If
BonTerra is required to attend additional meetings, a contract augment will be necessary.

Beach (City) will be the lead agency for the project. An Initial Study (IS) will be prepared as the
basis for the MND.
SCOPE OF WORK
TASK 1 PROJECT INITIATION
BonTerra Consulting will meet with the City and the project applicant, if necessary, to discuss
the project and the proposed scope of work. This coordination effort is intended to ensure that
there is agreement regarding the scope of work, studies to be completed, and appropriate
environmental documentation for the project. The project schedule will also be discussed at this
meeting.
Task 1 Deliverable:
1. Attendance at one meeting
TASK 2 PREPARATION OF ENVIRONMENTAL DOCUMENTATION
BonTerra Consulting will prepare the environmental document. This scope of work assumes
that an IS, leading to the preparation of a MND, is required. The IS and MND will be prepared
pursuant to CEQA and the State CEQA Guidelines. Following is a discussion of specific tasks to
be completed in preparing the IS and MND.
Task 2.1 Prepare Initial Study / Mitigated Negative Declaration for Review
In compliance with Section 15063 of the CEQA Guidelines, the IS/MND will contain a
description of the project, including the location of the project; a discussion of the environmental
setting; an identification of environmental effects; and a discussion of mitigation measures. This
scope of work assumes that City and/or the project applicant will provide BonTerra Consulting
the necessary information to prepare the project description. The discussion of environmental
setting will be based on a review of existing literature, including the Invasive Algae Survey
Report and Pre -Construction Eelgrass Survey Report (both prepared by Coastal Resources
A-1
Management in March 2006). BonTerra Consulting recently conducted site visits of the study
area, during preparation of the IS/MND for the 919 Bayside Drive Residential Project; therefore,
another site visit would not be required. The discussion of environmental effects will follow the
City of Newport environmental checklist. In compliance with the Sundstrom vs. Mendocino case
(1988), an explanation for all checklist answers will be included to provide the City with an
understanding of how the IS conclusions were reached. Mitigation measures, if necessary, will
be clearly identified to facilitate the development of the mitigation monitoring program.
Based on the project understanding, and discussions with City staff and the project applicant, it
is expected that the project will not result in significant impacts related to the following issues.
This will be documented in the IS/MND:
Aesthetics: BonTerra Consulting will qualitatively discuss any anticipated changes resulting from
removal of the existing dock and subsequent development of the new dock. This scope
assumes that visual simulations will not be required.
Agricultural Resources: BonTerra Consulting will reference relevant information from the City's
General Plan and Zoning Code as a means of documenting that the proposed project will have
no impact on agricultural resources.
Cultural Resources: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project will have no impact on
cultural resources.
Geology/Soils: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
to geology or soils.
Hazards and Hazardous Materials: BonTerra Consulting will summarize data presented in the
919 Bayside Drive Residential Development Project to verify that the proposed project would
not result in impacts related to hazards or hazardous materials.
Land Use/Planning: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project would not result in
impacts to land use and planning.
Noise: BonTerra Consulting will qualitatively discuss potential short-term construction -related
noise. The project would not result in long-term operational noise impacts.
Population/Housing: BonTerra Consulting will summarize data presented in the 919 Bayside
Drive Residential Development Project to verify that the proposed project, would not result in
impacts to population or housing.
Public Services: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
to public services.
Recreation: BonTerra Consulting will summarize data presented in the 919 Bayside Drive
Residential Development Project to verify that the proposed project would not result in impacts
related to recreation.
Transportation and Traffic: BonTerra Consulting will qualitatively discuss potential short-term
project -related traffic impacts resulting from construction worker trips to the project site. The
project would not result in long-term traffic impacts.

Utilities/Service Systems: BonTerra Consulting will summarize data presented in the
919 Bayside Drive Residential Development Project to verify that the proposed project would
not result in impacts to public utilities and services. It should be noted that this approach
assumes that no additional power would be brought to the site for the new docks. If information
to the contrary becomes available during preparation of the MND, then additional analysis and a
budget augment may be required.
BonTerra Consulting's approach for addressing the above topical issues assumes that the City
and/or the project applicant will be able to provide project -specific, detailed information to
support CEQA findings. If BonTerra needs to perform additional research, data, gathering, or
analysis to adequately address any of these topical issues, a contract augment will be required.
It should also be noted that the approach described above relies heavily on BonTerra
Consulting's ability to pull information from the IS/MND that was recently prepared for the
919 Bayside Drive Residential Development Project. If it is determined, during the project
definition or public review process, that a more information or analysis is required, a contract
amendment and budget augment will be necessary.
Following is a description of BonTerra Consulting's work effort for assessing potential
environmental effects relative to each topical issue requiring analysis in the IS/MND.
Air Quality: BonTerra Consulting will quantitatively discuss potential short-term construction -
related air quality impact associated with the removal and reconstruction of the gangway,
landing, and dock system. Appropriate findings and mitigation measures, including Best
Management Practices, will be presented in the IS. The proposed project would not be expected
to result in long-term operational air quality impacts; thus, a qualitative discussion will be
provided.
Biological Resources: BonTerra Consulting will summarize available information from the City
and/or the project applicant and document the proposed project's potential impacts to biological
resources. Appropriate findings and mitigation measures, including Best Management
Practices, will be presented in the IS.
Water Quality/Hydrology: BonTerra Consulting will summarize data provided by the City and/or
the project applicant and document the proposed project project's potential impacts to water
quality/hydrology. It should be noted that the information provided must be adequate for CEQA
review purposes. Appropriate findings and mitigation measures, including Best Management
Practices, will be presented in the IS.
Task 2.2 Prepare Public Review Draft IS/ND or MND for City Review
Based on the comments received from the City and the project applicant (if included in the
review process), BonTerra Consulting will revise the IS/MND and submit an approval draft
document to the City for an expedited second review. Following the City's review, BonTerra
Consulting will revise the IS/MND to address comments/suggested revisions that are within the
scope of work. Should the comments received require any technical studies, an amendment to
the budget will be required.
BonTerra Consulting will prepare a legal notice that the City proposes to adopt an MND. This
notice should be published in a local newspaper or at a minimum, posted at the project site. It is
assumed that the City will be responsible for preparing and publishing the notice.' Because
Coastal Commission approval will be required, the IS/MND will be submitted to the State
Clearinghouse for review; a 30-day public review period is therefore required.
If requested by the City to do so, BonTerra Consulting could coordinate distribution of the IS/MND and publication
of the public notice. The cost for providing these services is presented in the attached Fee Estimate.

Task 2.3 Distribute IS/MND
BonTerra Consulting will prepare and distribute twenty-five (25) copies of the finalized IS/MND.
The distribution list will be determined in coordination with the City.
Task 2.4 Coordinate Publication of Public Notice
Prior to adoption of the MND, BonTerra Consulting will prepare and submit a legal notice for
publication in a local newspaper to advise the public that the City proposes to adopt an MND.
The appropriate local newspaper for publication of the legal notice will be determined in
coordination with the City.
Task 2.6 Prepare Responses to Comments
Once the 30-day MND review period has ended, BonTerra Consulting will review the comments
received and develop an approach to respond to these comments. Responses to comments are
not required by CEQA, but they are recommended to assist the lead agency in the decision
making process. Topical responses, with a brief summary of the response and reference back
to the larger response, will be used if multiple comments are received on the same issue. This
will allow a more complete response without undue repetition. The draft responses to comments
will be submitted to the City (and the project applicant, if appropriate) for review. The responses
to comments will be revised based on comments received.
In compliance with Section 15074 of the CEQA Guidelines, the decision making body of the
lead agency must consider the proposed MND together with any comments received during the
public review process.
Task 2.6 File Notice of Determination
Following adoption of the MND by the City, a Notice of Determination (NOD) must be filed with
the County Clerk. This scope of work assumes BonTerra will prepare and file the NOD. The
project applicant will be responsible for payment of required fees to the California Coastal
Commission with the NOD.
Task 2 Deliverables:

4. One (1) PDF version of the IS/MND on CD -Rom

TASK 3 MITIGATION MONITORING
If mitigation measures are necessary, BonTerra Consulting will prepare a mitigation monitoring
program (MMP) for adoption with the MND in compliance with Public Resources Code 21081.6.
The MMP is requiredr to ensure compliance with adopted mitigation requirements during project
implementation. The program will be prepared in matrix format and will provide the timing and

responsibility for each mitigation measure. A draft copy of the MMP will be submitted to the City
for review. Revisions will be made accordingly.
Task 3 Deliverables:
1. Three (3) copies of the draft MMP
2. Three (3) copies of the final MMP
TASK 4 PROJECT MANAGEMENT AND MEETINGS
BonTerra Consulting will coordinate with the City and the project applicant, as necessary,
throughout the CEQA documentation process to ensure compliance with the scope and
schedule. In addition to the meeting previously identified in Task 1, this scope of work assumes
the need for one additional coordination meeting with City staff and/or the project applicant. If
BonTerra is required to attend additional meetings, a contract augment will be necessary.
Task 4 Deliverables:
1. Attendance at one team meeting. BonTerra Consulting's project manager will attend this
meeting.
