SUBJECT: Proposed Extension of Emergency -Parking Ordinance
The City Council was at their last meeting presented with a
proposed time schedule for parking ordinance amendment pur-
poses.
It set forth the basis upon which staff is requesting an ex-
tension of the interim zoning ordinance applying the provi-
sions of Chapter 20.40 entitled "-Z" District to all commer-
cial districts not presently required to provide parking.
A six month extension to accommodate all of"the steps and
public hearings that appear necessary has been suggested.
I know of,no significant hardships placed on any developers
as a result of the existence of the emergency ordinance thus
far.

AN EMERGENCY ORDINANCE OF THE CITY OF NEWPORT
BEACH EXTENDING THE EXPIRATION DATE OF CERTAIN
INTERIM ZONING REGULATIONS REQUIRING MINIMUM
PARKING REQUIREMENTS FOR ALL PROPERTY LOCATED
WITHIN COMMERCIAL ZONING DISTRICTS IN THE CITY
WHICH DOES NOT OTHERWISE HAVE PARKING REQUIRE-
MENTS AS PROVIDED IN ORDINANCE NO. 1235
WHEREAS, there is considerable property located within
commercial zoning districts in the City which is not required to
provide any off-street parking as a condition of the development
or redevelopment of said property; and
WHEREAS, the rapid growth of the City has resulted in
a severe shortage of off-street parking facilities; and
WHEREAS, the City Council has retained a traffic and
parking consultant to make a study of the future parking needs
of the City and has directed the Planning Commission to make
recommendations to the Council concerning legislation to impose
minimum off-street parking requirements in all commercial zoning
districts of the City; and
WHEREAS, the City Council of the City of Newport Beach,
on the 23rd day of October, 1967, adopted Ordinance No. 1235,
entitled "AN EMERGENCY ORDINANCE OF THE CITY OF NEWPORT BEACH
ESTABLISHING INTERIM ZONING REGULATIONS REQUIRING MINIMUM
PARKING REQUIREMENTS FOR ALL PROPERTY LOCATED WITHIN COMMERCIAL
ZONING DISTRICTS IN THE CITY WHICH DOES NOT OTHERWISE HAVE
PARKING REQUIREMENTS"; and
WHEREAS, Section 3 of said Ordinance No. 1235 pro-
vides as follows*
"This ordinance shall be effective for a period
of ninety (90) days from the date of its adoption; pro-
vided, however, that after notice pursuant to Section
65856 of the California Government Code and public
hearing, the City Council may by a four -fifths vote
extend this ordinance for one year."; and
WHEREAS, said ordinance will automatically expire
,and -become -null -and void on January 22, 1968.unless the City Coun-
cil acts to extend the expiration date of said ordinance; and
a
WHEREAS, the City Planning Commission is conducting
studies to determine whether the adoption of legislation impos-
ing appropriate off-street parking requirements in commercial
zones is required; and
WHEREAS, the City Council has determined that addi-
tional time is needed for the Planning Commission to make its
studies and recommendations and for the City Council to make
its studies after receipt of a report from the Planning Com-
mission; and
WHEREAS, Section 412 of the City Charter provides
that any ordinance declared by the City Council to be neces-
sary as an emergency measure for preserving the public peace,
health or safety and containing a statement of the reasons for
its emergency may be introduced and adopted at one and the same
meeting if passed by at least five affirmative votes; and
WHEREAS, Section 65858 of the California Government
Code specifically authorizes the legislative body of a city,
by a four -fifths vote, to extend any interim zoning ordinance
adopted as an emergency measure for an additional period of
one year;
NOW, THEREFORE, the City Council of the City of New-
port Beach does ordain as followss
SECTION to The restrictions relating to minimum
parking requirements for all property located within commercial
zoning districts in the City which does not otherwise have
parking requirements, as set forth in Ordinance No, 1235, are
hereby extended to July, 22 __, 1968, or
until such time as the City Council shall repeal this ordinance,
whichever first occurs.
SECTION 2e This ordinance is declared by the City
Council to be necessary as an emergency measure for preserving
the public peace, health, safety and welfare for the reasons
previously stated herein, and shall take effect immediately
upon its adoption.

SECTION 3. This ordinance shall be published once in
the official newspaper of the City.
This ordinance was introduced and adopted as an
emergency ordinance at a regular meeting of the City Council
of the City of Newport Beach held on the 22nd day of January,
1968.

Subjecto Extension of interim zoning ordinance applying the
provisions of Chapter 20.40, entitled "-mZ' District
to all commercial districts
Pursuant to staff request, we have prepared an ordinance which,
if adopted, would extend the expiration date of emergency Ordi-
nance No. 1235, adopted by the City Council on October 23, 1967.
In substance, that ordinance imposed a ninety -day moratorium on
the issuance of building permits for the construction of any new
structure or the addition of any floor space in commercial dis-
tricts unless the subject property included parking in accordance
with the provisions of Chapter 20.40 of the Newport Beach Munici-
pal Code, entitled "--Z" District. The regulations are not
applicable to uses in existence on the date the emergency ordi-
nance was originally adopted; e.g., October 23, 1967, or to
buildings or structures being remodeled so long as the work does
not involve any new area or floor space.
A blank space has been left in Section 1 of the proposed ordi-
nance in which the date of expiration of the moratorium should
be inserted. A suggested date is July 22, 1968, which would
extend the moratorium for eriod of an additional six months
from today (date of adoption However, any date up to January
21, 1969 is -legally permissible.
Due to the critical timing involved here, this proposed ordinance
extending the moratorium has been prepared in emergency form and
will, therefore, require a minimum of five affirmative votes for
its adoption.

adoption of ordinances as emergency measures when declared by the
City Council to be necessary for preserving the public peace,
health or safety; and
WHEREAS, in enacting this ordinance the City Council
hereby declares that it is acting pursuant to the authority of
said Section 65858 of the California Government Code and pursuant
to its powers as set forth in Section 412 of the City Charter;
NOW, THEREFORE9 the City Council of the City of Newport
Beach does ordain as followso
SECTION to The off-street parking requirements as set
forth in Chapter 20.40 of the Newport Beach Municipal Code
entitled "®Z" DISTRICT shall be applicable to all property within
the City located within any of the following zoning districts.
A-F, C-N, Cm0, Cml, C-2, and Io If any such property is subject
to more extensive parking requirements than are provided for in
the regulations for the "-Z" District, the more extensive require-
ments shall apply.
SECTION 20 The provisions of Section 1 of this ordi-
nance shall be applicable to any property located within any of
the zoning districts described .therein for which an application
for a building permit is made for the purpose of constructing any
new building or structure or for adding additional floor area to
an existing building or structure, but, in the case of an addition
to an existing building or structure, said parking requirements
shall be applicable only to the area or floor space being added.
Said off-street parking regulations shall not be applicable to
uses in existence on the date this ordinance is adopted or to
buildings or structures being remodeled so long as the work does

Subject: Emergency ordinance No. 1235 establishing off-street
parking requirements for commercial zones
On October 23, 1967, the City Council adopted Ordinance No. 1235
which has the effect of requiring that all property in the City
located within commercial zones must meet the off-street parking
standards of the "-Z" parking district as set forth in Chapter
20.40 of the Municipal Code. The zoning districts covered by
this requirement are A-P, C-N, C-02 C-1, C-2, and I.
It should be clearly understood that these requirements are mini-
mum standards. Therefore, in the case of any property which is
subject to greater off-street parking standards by virtue of
being within an "-Hn district or because it is subject to added
parking requirements imposed as a condition of a use permit or
variance, the higher standards shall be applicable.
The ordinance was adopted as an emergency ordinance. It is,
therefore, effective immediately. Its requirements are appli-
cable to any property for which an application for a building
permit is made for the purpose of any new construction. The
requirements do not apply to buildings or structures which are
being remodeled, provided that the work does not involve the
addition of any new area or floor space to the existing building
or structure. If the work does involve the addition of space to
an existing building or structure, the off-street parking require-
ments shall be applied, but only upon the basis of the space being
added.
The requirements of the ordinance shall be applicable to all com-
mercially zoned properties for which building permit applications
had been made prior to the effective date of the ordinance, pro-
vided that the issuance of the building permits had not been
completed before the adoption of the ordinance.
